RESOLUTION
On some specific regimes in prevention and control of the COVID-19 pandemic

THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated June 19, 2015;
Pursuant to the Law on Prevention and Control of Infectious Diseases dated November 21, 2007;
Pursuant to the Government’s Decree No. 138/2016/ND-CP dated October 01, 2016 on promulgating the Working Regulation of the Government;
At the proposal of the Minister of Health;
Based on the opinions of the Government members,
RESOLVES:
Article 1.To apply some specific regimes in the prevention and control of the COVID-19 pandemic as follows:
1. Meals of people subject to medical isolation
a) Subjects of application: Vietnamese and foreigners being subject to medical isolation measures at medical examination and treatment establishments or other establishments or locations (not applicable to the isolation at home, residence places, hotels, resorts and enterprises).
b) A meal allowance is VND 80,000/day during the isolation period.
For localities that are providing the meal allowance other than a that of VND 80,000/day for an isolated person before March 29, 2020, the payment shall be made in accordance with the amounts paid. Based on the local budget capacity, the Chairpersons of the People s Committees of provinces or centrally-run cities shall decide to provide the higher allowance.
Based on the actual situation and the local budget capacity, such localities may continue providing the current meal allowance or adjust to the new allowance of VND 80,000/day
c) Authorities and units that are assigned to implement the medical isolation shall be responsible for providing meals for the isolated persons in a timely and favorably manner. In case the isolated person request other meals (if any), he/she shall have to pay for the extra cost. The isolated person’s requirement for different meals must comply with conditions of the facilities that carry out the medical isolation.
2. A person subject to medical isolation as prescribed in Point a, Clause 1 of this Article shall be provided with free drinking water, face towels, medical masks, hand sanitizers, oral antiseptic solutions, toothbrushes, shower soaps and other essentials to meet daily needs during the isolation period with total costs of VND 40,000/day.
3. Regarding payment of other medical examination and treatment expenses for a person who is in the medical concentrated isolation period and suffer other disease requiring medical examination and treatment.
a) For those with health insurance cards, the health insurance fund shall pay the medical examination and treatment expenses within the scope of health insurance coverage like cases of medical examination and treatment on the right route. The State budget shall cover the co-payments of patients and other expenses that are not covered by health insurance.
b) For a person without health insurance card: If he/she is Vietnamese, the medical examination and treatment expenses shall be covered by the State budget; if he/she is foreigner, such expenses shall be paid by himself/herself.
4. Allowances regimes for health staff and employees participating in the pandemic prevention and control
a) The pandemic prevention and control allowance of VND 300,000/day, including weekends and holidays is provided for:
- A person performing the monitoring, investigation and verification of the pandemic;
- A person directly examining, diagnosing and treating the infected cases in the medical examination and treatment establishment.
b) The pandemic prevention and control allowance of VND 200,000/day, including weekends and holidays, is provided for:
- A person transiting patients and patients samples; preserving patients corpses; washing cloth, doctors and patients’ clothes; collecting chemical bottles and containers; protecting the isolation treatment areas; cleaning, disinfecting and killing pathogens in isolation areas in the medical examination and treatment establishments;
- Health staff carrying out epidemiological surveillance and medical surveillance at home and medical isolation establishments as directed by state management agencies.
b) The pandemic prevention and control allowance of VND 150,000/day, including weekends and holidays, is provided for:
- A person performing duties (other than medical expertise) at concentrated isolation establishments (not applicable to isolation at home, residence places, hotels, resorts and enterprises).
- A person participating in coercive medical isolation with those subject to isolation but does not comply with medical isolation measure.
- An interpreter, emergency team 115 and a crew transporting isolated people.
5. The regime for a person participating in the 24/24 hours pandemic prevention includes:
a) The 24/24 hours pandemic prevention allowance of VNN 130,000/day, including weekends and holidays.
b) An employee participating in the 24/24 hours pandemic prevention shall be supported a meal allowance of VND 80,000/duty.
6. Health staff, army and police who performs duties at the medical concentrated isolation establishments (not applicable to isolation at home, residence places, hotels, resorts and enterprises); a person who participates in the medical separation and carrying out procedures for people on their entry; a person who protects the isolation areas in residential areas under the designation of the State management authorities and health staff who are available 24 hours a day at a medical isolation clinic to take care of and treat people infected with COVID-19 or suspected of having COVID-19 shall be provided with the meal allowance of VND 80,000/day.
7. The allowance regimes for collaborators and volunteers participating in pandemic prevention during the COVID-19 pandemic period:
a) An allowance of VND 130,000/day shall be provided for a collaborator, volunteer directly participating or coordinating in the pandemic prevention activities.
b) An allowance of VND 80,000/day shall be provided for a collaborator and volunteer, who directly propagates, mobilizes people and distributes leaflets or participates in the maneuvers.
Article 2.Funds for implementation
1. The State budget shall be arranged in accordance with current laws on State budget and decentralization of State budget. The Central budget shall support the budget of localities which are still difficult and cannot balance the budget according to the regulations of the Prime Minister.
2. The health insurance fund shall pay for the medical examination and treatment expenses covered by health insurance.
3. Aid, funding and support from domestic and foreign organizations and individuals and other lawful capital sources.
Article 3.Implementation provisions
1. This Resolution takes effect on the date of its signing.
2. The specific regimes prescribed in this Resolution shall be applied during the COVID-19 pandemic prevention and control period. Other regimes not mentioned in this Resolution shall comply with current regulations of law.
3. A person who participated in the COVID-19 pandemic prevention and has enjoyed the allowances as prescribed in the Decision No. 73/2011/QD-TTg dated December 28, 2011 of the Prime Minister on some specific allowances for civil servants, public employees and employees in public health establishments (hereinafter referred to as the Decision No. 73/2011/QD-TTg) and the pandemic prevention allowance regimes shall be entitled to retrospectively receive the increase (if any) corresponding to the allowances specified in this Resolution form the date of enjoying the pandemic prevention allowances according to the Decision No. 73/2011/QD-TTg.
4. For a person who is assigned to be on duty 24 hours a day, the time to start enjoying the on-duty allowance is from the date of receiving the first COVID-19 suspected case but not earlier than the date of occurrence of the pandemic as prescribed in Clause 2, Article 1 of the Decision No. 173/QD-TTg dated February 01, 2020 of the Prime Minister till the end of the announcement date of termination of the acute respiratory infection causing by a new strain of Coronavirus according to the Prime Minister’s decision.
Article 4.Implementation responsibility
1. The Ministry of Finance and the Ministry of Health shall be responsible for directing and implementing this Resolution.
2. State authorities, units, organizations and enterprises shall be responsible for fully implementing the Ministry of Health s guidance on the COVID-19 pandemic prevention and control measures at working and study place, dormitories or concentrated accommodation of employees to minimize the spread of the pandemic, protect the employee s health, occupational safety and hygiene. Funding for the implementation of this task shall be arranged in accordance with law provisions on the state budget and the Prime Minister s decision or the operation funds in accordance with law provisions or shall be accounted to the deductible expenses when determining the taxable income under the law on enterprise income tax.
3. Ministers, heads of ministerial-level agencies, heads of Government-attached agencies, and Chairpersons of Peoples Committees of provinces and centrally-run cities shall be responsible for implementing this Resolution./.
