RESOLUTION

On special policies to support frontline workers participating in COVID-19 prevention and control

THE X^th PEOPLE'S COUNCIL OF HO CHI MINH CITY AT ITS 2^nd SESSION

Pursuant to the Law on Prevention and Control of Infectious Diseases dated November 21, 2007;

Pursuant to the Law on Organization of the Government dated June 19, 2015; Law on Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on Promulgation of Legal Documents dated June 22, 2015, the Law on Amending and Supplementing a Number of Articles of the Law on Promulgation of Legal Documents dated June 18, 2020;

Pursuant to the Law on the State Budget dated June 25, 2015;

Pursuant to the Resolution No. 54/2017/QH14 dated November 24, 2017 of the National Assembly on pilot implementation of special mechanisms and policies for development of Ho Chi Minh City;

Pursuant to the Government’s Decree No. 101/2010/ND-CP dated September 30, 2010 detailing a number of articles of the Law on Prevention and Control of Infectious Diseases;

Pursuant to the Government's Decree No. 34/2016/ND-CP dated May 14, 2016 detailing a number of articles of, and providing measures for implementing, the Law on Promulgation of Legal Documents and the Government's Decree No. 154/2020/ND-CP dated December 31, 2020 amending and supplementing a number of articles of the Government’s Decree No. 34/2016/ND-CP dated May 14, 2016, detailing a number of articles of, and providing measures for implementing, the Law on Promulgation of Legal Documents;

Pursuant to the Government’s Decree No. 163/2016/ND-CP dated December 21, 2016 on detailing a number of articles of the Law on the State Budget;

Considering the Report No. 2819/TTr-UBND dated August 22, 2021 of the City People's Committee on the promulgation of the Resolution on special policies to support frontline workers participating in COVID-19 prevention and control; Verification Report No. 479/BC-HDND dated August 23, 2021 of the Economic and Budgetary Department of the City People's Council;
the delegates' unified conclusion at the City People's Council's meeting.

RESOLVES:

Article 1. In order to support and encourage the frontline workers participating in the COVID-19 prevention and control, continue to promote their synergy and solidarity in carrying out the task of pandemic control, the City People's Council approves special policies to support frontline workers participating in COVID-19 prevention and control in Ho Chi Minh City as follows:

1. Beneficiaries:

The frontline workers participating in COVID-19 prevention and control include:

a) The frontline medical workers performing direct works (including those who take samples for testing, provide medical examination, treatment and care for patients at COVID-19 treatment hospitals and concentrated quarantine establishments; 115 emergency crews and people involved in transporting F0 cases).

b) The frontline medical workers performing indirect works (including people involved in managing, operating, coordinating directly the pandemic prevention and control, those who participate local pandemic prevention and control teams; the frontline non-medical workers who perform indirect works at COVID-19 treatment hospitals and concentrated quarantine establishments).

c) Community-based COVID-19 teams.

d) Volunteers mobilized for the pandemic prevention and control by the municipal authorities.

e) Volunteers mobilized to participate in the frontline anti-pandemic forces supporting Ho Chi Minh City by the Ministry of Health.

2. One-off support levels

One person performing many works shall only be entitled to the highest support level.

3. Implementation expenses City’s budget, including the resource for salary reform.

Article 2. In the course of administration, the City People's Council assigns the City People's Committee to perform the following contents:

1. Focus on immediately implementing the above-mentioned support policies to promptly encourage frontline workers participating in COVID-19 prevention and control in accordance with regulations of the State Budget Law and current law regulations.

2. Direct relevant agencies and units to be responsible for guiding and identifying specifically the frontline subjects participating in COVID-19 prevention and control that are entitled to the support policies specified in Clause 1, Article 1, ensuring the support in accordance with the support levels specified in this Resolution.

3. Use the resource for wage reform in accordance with regulations, ensuring sufficient resources to implement the reform of wage and social security policies for the whole budget stabilization period according to regulations of competent authorities before using the wage reform resource for implementation of the policy.

4. Direct relevant agencies and units to implement the above-mentioned policies, ensuring support for the right beneficiaries with right support levels in a public, transparent and consistent manner according to regulations.

Article 4. The Standing Committee of the City People's Council, the committees, delegations and delegates of the City People's Council shall strictly supervise the process of organizing and implementing this Resolution.

This Resolution was approved on August 24, 2021 by the X^th People's Council of Ho Chi Minh City at its 2^nd session and takes effect from the date of approval by the City People's Council./.
