Ordinance 09/2025/UBTVQH15 amending and supplementing articles of the Ordinance on Environmental Police

ORDINANCE

Amending and Supplementing a Number of Articles of the Ordinance on Environmental Police^[1]

Pursuant to the Constitution of the Socialist Republic of Vietnam, which has a number of articles amended and supplemented by Resolution No. 203/2025/QH15;

The National Assembly Standing Committee promulgates the Ordinance Amending and Supplementing a Number of Articles of Ordinance No. 10/2014/UBTVQH13 on Environmental Police.

Article 1. To amend and supplement a number of articles of the Ordinance on Environmental Police

1. To amend and supplement Clause 5, Article 7 as follows:

“5. To inspect the observance of law by agencies, organisations and individuals in accordance with law; to inspect vehicles, objects and places when directly detecting signs of crime or administrative violation or receiving denunciations or reports on crimes or administrative violations in accordance with law.

The inspection shall be decided in writing by the Head of the Environmental Crime Prevention and Combat Police Office under the Ministry of Public Security or heads of provincial-level Police Departments; or by directors of provincial-level Police Departments, heads of commune-level police offices or heads of police stations;”.

2. To amend and supplement Article 8 as follows:

“Article 8. Environmental Crime Prevention and Combat Police forces

The Environmental Crime Prevention and Combat Police forces include:

1. Units in the People’s Public Security forces, which have specialised functions and tasks of environmental crime prevention and combat;

2. Environmental Crime Prevention and Combat Police officers and men, including:

a/ Officers, non-commissioned officers and men of units in the People’s Public Security forces, who have specialised functions and tasks of environmental crime prevention and combat;

b/ People’s Public Security officers, non-commissioned officers and men, who are assigned to directly take charge of, command or perform the environmental crime prevention and combat task at commune-level police offices or police stations.”.

3. To amend and supplement Article 14 as follows:

“Article 14. Responsibilities of the Ministry of Agriculture and Environment

1. To direct its subordinate agencies and units to coordinate with and assist the Environmental Crime Prevention and Combat Police in performing its functions and tasks and exercising its powers.

2. To support the Environmental Crime Prevention and Combat Police in the implementation of projects on or themes of research, professional training, coaching and further training, international cooperation and consultancy.”.

4. To replace the phrase “the Environmental Police” in the title of the Ordinance and grounds for promulgation of the Ordinance; the titles of Chapters II, III and IV; and Articles 1, 2, 3, 4, 5, 6, 7, 9, 10, 11, 12, 13, 15, 16 and 17, with the phrase “the Environmental Crime Prevention and Combat Police”.

Article 2. Effect

This Ordinance takes effect on December 15, 2025.-

This Ordinance was adopted on December 3, 2025, by the 15^th National Assembly Standing Committee of the Socialist Republic of Vietnam at its 52^nd session.
