ORDINANCE

Amending and Supplementing a Number of Articles of the Ordinance on Environmental Police

Pursuant to the Constitution of the Socialist Republic of Vietnam, which is amended and supplemented under Resolution No. 203/2025/QH15;

The National Assembly Standing Committee promulgates the Ordinance Amending and Supplementing a Number of Articles of Ordinance No. 10/2014/UBTVQH13 on Environmental Police.

Article 1. To amend and supplement a number of articles of the Ordinance on Environmental Police

1. To amend and supplement Clause 5, Article 7 as follows:

“5. To inspect the observance of law by agencies, organizations and individuals in accordance with law; to inspect vehicles, objects and places when directly detecting signs of crime or administrative violation or receiving denunciations or reports on crimes or administrative violations in accordance with law.

The inspection shall be decided in writing by the head of the Environmental Crime Prevention and Combat Police Agency under the Ministry of Public Security or provincial-level Departments of Public Security; or by directors of provincial-level Departments of Public Security, heads of commune-level public security divisions or heads of police stations;”.

2. To amend and supplement Article 8 as follows:

“Article 8. The Environmental Crime Prevention and Combat Police Force

The Environmental Crime Prevention and Combat Police Force comprises:

1. Units within the People’s Public Security forces that have the specialized functions and tasks of prevention and combat of environmental crimes;

2. Officers and men of the Environmental Crime Prevention and Combat Police Force, including:

a/ Officers, non-commissioned officers and men of units of the People’s Public Security forces that have the specialized functions and tasks of prevention and combat of environmental crimes;

b/ People’s Public Security officers, non-commissioned officers and men who are assigned to directly take charge of, command and perform the tasks of preventing and combating environmental crimes at commune-level public security divisions or police stations.”.

3. To amend and supplement Article 14 as follows:

Article 14. Responsibilities of the Ministry of Agriculture and Environment

1. To direct its agencies and units to coordinate with and assist the Environmental Crime Prevention and Combat Police Force in performing its functions and tasks and exercising its powers.

2. To support the Environmental Crime Prevention and Combat Police Force in the implementation of projects, research topics, professional training, drill and further training, and international cooperation, and provide consultancy for the Environmental Crime Prevention and Combat Police Force.”.

4. To replace the phrase “Environmental Police” with the phrase “Environmental Crime Prevention and Combat Police Force” in the title of the Ordinance and legal grounds for promulgation of the Ordinance; the title of Chapters II, III and IV; and Articles 1, 2, 3, 4, 5, 6, 7, 9, 10, 11, 12, 13, 15, 16 and 17.

Article 2. Effect

This Ordinance takes effect on December 15, 2025.-
