On strengthening the reduction of late payment of social insurance, health insurance and unemployment insurance premiums in 2023

Recently, Social Security Offices of provinces and centrally-run cities (hereinafter referred to as provincial Social Security Offices) have adhered to directions of Vietnam Social Security and taken different solutions to urge the collection and reduction of the amount of late payment of social insurance, health insurance and unemployment insurance premiums (hereinafter referred to as social insurance). To be specific: disseminating the interests, obligations and rights of participating in social insurance for employers and employees; sending a notice on social insurance contribution results on a monthly basis; assigning officers to strictly follow and grasp information about the enterprises’ operation, production and business, especially those with large number of employees and huge revenues; actively analyzing collected data to promptly detect cases with abnormal signs on the number of employees, the salary used as a basis for social insurance contribution; conducting inspection and examination of units with outstanding debts of 3 months or more; reporting to the party committees and local government on the contribution of social insurance by enterprises in the localities, etc. Therefore, by the end of 2022, the late payment rate of such units accounted for only 2.91% of the receivable sum, which is the lowest rate of late payment ever. To continue to ensure the interests of employees and reduce the amount of late payment of social insurance contributions to the lowest rate, Vietnam Social Security requires Directors of provincial Social Security Offices and relevant units to implement a number of measures as follows:

I. Regarding provincial Social Security Offices:
1. To strictly follow regulations and procedures for managing the collection of Vietnam Social Security; improve the responsibility of the head, and assign specific tasks and responsibilities to staff. On a monthly basis, to inform and notify results of social insurance contributions to employers and employees for timely and sufficient contribution of social insurance.
- An urgent notice shall be sent to an employer with late payment from one month to less than three months. In case an employer fails to make payment, a record of violations shall be made according to regulations.
- In case an employer delays its payment from 3 months or more, the irregular specialized inspections shall be organized, and fines shall be imposed for acts of administrative violations; the enforcement of decisions to sanction administrative violations shall be conducted if the employer fails to follow the inspection conclusion. Provincial Social Security Offices shall closely coordinate with police offices in making and transferring dossiers and documents for consideration and punishment in accordance with law provisions.
- To report to the Steering Committees for implementation of social insurance and health insurance policies of the provinces the late payment of social insurance contributions of units in localities. To actively propose solutions to improve the operation quality of the inter-sectoral debt collection teams and strictly handle violating units in accordance with law provisions to protect the employees’ rights.
- To make and publicize the list of units with late payment that have received urgent notices, or have been irregularly inspected, and units with administrative violations that intentionally refuse to make social insurance contributions, on local and central mass media.
2. To continue organizing communication activities and holding dialogues with local employers in a flexible and appropriate manner to disseminate new regulations and polices, remove difficulties in implementation and organization. To urge units to pay social insurance premiums timely to avoid incurring new late payment amounts. To coordinate with grassroots trade unions and employers to mobilize employees to install VssID - a digital social insurance application so that the employees can monitor and supervise the payment process and benefits of social insurance and health insurance regimes.
3. Leaders and relevant functional offices shall make weekly and monthly plans; responsibility shall be assigned to leaders and officers in charge to implement, grasp, process information and urge enterprises to make social insurance, health insurance and unemployment insurance payment in a timely manner. The above shall be considered as criteria for assessing and scoring for quarterly and annual commendation and reward for collectives and individuals.
II. 
Regarding units affiliated to Vietnam Social Security
1. The Management Board for Collection of Health Insurance Cards and Social Insurance Books shall
Urge and inspect the implementation of provincial Social Security Offices, make a monthly report to the General Directors of localities failing to follow regulations, resulting in the late payment of social insurance contributions, and request the General Directors of provincial Social Security Offices to directly explain.
2. The Department of Inspection shall assume the prime responsibility and coordinate with relevant units in, examining and urging provincial Social Security Offices to organize irregular specialized inspection and examination of the social insurance, health insurance and unemployment insurance contributions according to regulations.
3. The Communication Center shall
- Coordinate with provincial Social Security Offices to publicize information about units that delay or evade payment and intentionally violate social security regulations and laws on mass media.
- Guide the provincial Social Security Offices to disseminate the laws on social insurance on social networks, newspapers, or magazines, etc. in a flexible and diverse manner.
4. The Information Technology Center shall
Complete software functions to meet the requirements on management, time-based updating, late payment amount and status of employees at units with late payment.
5. The Customer Care Center shall strengthen instructions and supervise the localities’ installation of VssID on mobiles for employees and citizens.
Any difficulties arising in the course of implementation should be reported to Vietnam Social Security (via the Management Board for Collection of Health Insurance Cards and Social Insurance Books) for consideration and settlement./.
