Interim Regulation on measures for "safe and flexible adaptation and effective control over the COVID-19 pandemic" in Da Nang City

PEOPLE’S COMMITTEE OF DA NANG CITY

Pursuant to the Law on Organization of Local Administration dated June 19, 2015;

Pursuant to the Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Resolution No. 128/NQ-CP dated October 11, 2021 of the Government on promulgating Interim Regulation on “safe and flexible adaptation and effective control over the COVID-19 pandemic”;

Pursuant to the Decision No. 4800/QD-BYT dated October 12, 2021 of the Ministry of Health on promulgating Interim Guidance for implementation of the Resolution No. 128/NQ-CP;

Pursuant to the Resolution No. 08-NQ/TU dated July 30, 2021 of the Standing Committee of Da Nang City Party Committee on strengthening a number of urgent measures to prevent and control COVID-19 pandemic in Da Nang City;

Pursuant to the Resolution No. 43/NQ-HDND dated August 12, 2021 of the People's Council of Da Nang City on the tasks of the last 6 months of 2021;

Pursuant to the Directive No. 08/CT-UBND dated September 28, 2021 of the People's Committee of Da Nang City on the implementation of the policy of "safe and flexible adaptation and effective control over the COVID-19 pandemic" in Da Nang City in the current situation;

At the proposal of the Director of the Department of Health in Report No. 5729/TTr-SYT dated November 21, 2021.

DECIDES:

Article 1. Defining Interim Regulation on measures for "safe and flexible adaptation and effective control over the COVID-19 pandemic" in Da Nang City with the following contents:

1. Regulations on assessment of pandemic risk levels in the City (details in the attached Appendix 1).

2. Regulations on measures for safe and flexible adaptation and effective control over the COVID-19 pandemic (details in the attached Appendix 2):

a) General conditions for participating in activities when applying measures under each pandemic risk level in the whole city (Appendix 2.1).

b) Administrative measures corresponding to each pandemic risk level (Appendix 2.2).

c) Health measures corresponding to each pandemic risk level (Appendix 2.3).

Article 2. Effect

1. This Decision takes effect from the date of signing.

2. This Decision replaces the regulations of the City People's Committee in Official Dispatch No. 7009/UBND-KGVX dated October 15, 2021 on interim application of a number of measures for "safe and flexible adaptation and effective control over the COVID-19 pandemic" in Da Nang City. The contents of regulations on administrative measures for Covid-19 prevention and control in Da Nang City contrary to this Decision cease to be effective.

3. The application of the current pandemic risk levels shall be continued until the City organizes assessment of, updates and announces the new pandemic risk levels according to this Decision.

Article 3. Implementation organization

1. The Chief of Office of the City People's Committee, heads of the city's departments and sectors, chairpersons of People's Committees of districts, communes and wards and relevant organizations and individuals are responsible for the implementation of this Decision and ensuring the following points of view and principles:

a) Strictly follow the direction of the Government, the Prime Minister, the National Steering Committee for COVID-19 Prevention and Control, regulations and instructions of the Ministry of Health. For application of personal QR code for health and domestic travel declarations, people can use Danang Smart City app when participating in the activities specified in this Decision (or "PC-COVID" app until there is an official document of the National Steering Committee for COVID-19 Prevention and Control or the City People's Committee).

b) Socio-economic activities shall comply with the Ministry of Health’s guidance on COVID-19 prevention and control.

c) The application of socio-economic activities and measures shall be based on the assessment and development of the pandemic.

d) Promote the initiative of people, enterprises and authorities in COVID-19 prevention and control and the city's socio-economic recovery and development.

2. Heads of the city's departments and sectors, chairpersons of People's Committees of districts, communes and wards shall, within the assigned functions and tasks, urgently issue detailed guidance for effective implementation of this Decision at the agencies, units, fields, areas under their management; manage and organize the inspection, supervision and handling of violations according to regulations.

3. The Department of Health shall assume the prime responsibility, and coordinate with relevant units in, promptly advising the City People's Committee to consider and adjust this Decision in line with the actual situation of the COVID-19 pandemic in the City.
