Official Dispatch No. 180/BXD-KTXD dated October 03, 2011 of the Ministry of Construction guiding the application of the Circular No. 09/2008/TT-BXD dated April 17, 2008
To: Song Thao Cement Joint Stock Company
The Ministry of Construction has confirmed the Official Dispatch No. 439/XMST-KTKH dated August 25, 2011 of Song Thao Cement Joint Stock Company guiding the application of the Circular No. 09/2008/TT-BXD dated April 17, 2008. After studying, the Ministry of Construction has opinions as follows:
1. The objectives to receive cost of material price in accordance with regulations at the Circular No. 09/2008/TT-BXD are building contractors.
2. Packaged EPC contract is signed and takes effect on the effective date of the Circular No. 09/2008/TT-BXD dated April 17, 2008 and the building construction projects with costs of material prices are adjustment objective of this Circular. Meanwhile, the cost of material price is implemented in accordance with specific implementation in the Circular and the Official Dispatch No. 1551/BXD-KTXD dated August 01, 2008 of the Ministry of Construction.
3. According to the guidance at the Official Dispatch No. 2057/BXD-KTXD dated October 13, 2008 for processing and producing equipments by Vietnam contractors domestically, adjustments of construction prices at the guidance of Circular No. 09/2008/TT-BXD dated April 17, 2008; therefore, equipments which are processed and produced domestically by Song Thao Cement Joint Stock Company at the Official Dispatch No. 439/XMST-KTKH dated August 25, 2011 performed by Vietnam contractors will be adjusted in prices and construction contracts in accordance with the Circular No. 09/2008/TT-BXD dated April 17, 2008.
With above contents, Song Thao Cement Joint Stock Company shall implement in accordance with regulations./.
