Circular 17/2023/TT-BNNPTNT List of HS codes for goods being endangered, precious and rare forest plants and animals, animals and plants in CITES

CIRCULAR

Promulgating the List of HS codes for goods being endangered, precious and rare forest plants and animals, and animals and plants provided in Appendices to the Convention on International Trade in Endangered Species of Wild Fauna and Flora^[1]

Pursuant to the Government’s Decree No. 105/2022/ND-CP of December 22, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Convention on International Trade in Endangered Species of Wild Fauna and Flora;

Pursuant the Government’s Decree No. 69/2018/ND-CP of May 15, 2018, detailing a number of articles of the Law on Foreign Trade Management;

Pursuant to the Government’s Decree No. 84/2021/ND-CP of September 22, 2021, amending and supplementing a number of articles of the Government’s Decree No. 06/2019/ND-CP of January 22, 2019, on the management of endangered, precious and rare forest plants and animals and implementation of the Convention on International Trade in Endangered Species of Wild Fauna and Flora;

At the proposal of the Director of the Vietnam Administration of Forestry;

The Minister of Agriculture and Rural Development promulgates the Circular promulgating the List of HS codes for goods being endangered, precious and rare forest plants and animals, and animals and plants provided in Appendices to the Convention on International Trade in Endangered Species of Wild Fauna and Flora.

Article 1. To promulgate together with this Circular the List of HS codes for goods being endangered, precious and rare forest plants and animals, and animals and plants provided in Appendices to the Convention on International Trade in Endangered Species of Wild Fauna and Flora.

Article 2. Effect

1. This Circular takes effect on January 30, 2024.

2. The Minister of Agriculture and Rural Development’s Decision No. 924/QD-BNN-TCLN of March 24, 2017, promulgating the List of HS codes for goods being endangered, precious and rare wild animals and plants, ceases to be effective on the effective date of this Circular.

3. In case new legal documents contain changes in names of species and groups of species on the List of endangered, precious and rare forest plants and animals and Appendices to the Convention on International Trade in Endangered Species of Wild Fauna and Flora, such legal documents shall prevail.

4. In case there are changes in HS codes or types of goods, the Minister of Finance’s regulations on Vietnam’s Nomenclature of Exports and Imports shall be applied.

Article 3. Implementation responsibility

1. The Chief of the Office, Director of the Vietnam Administration of Forestry, and heads of units under the Ministry of Agriculture and Rural Development, and related organizations and individuals shall implement this Circular.

2. Any problems arising in the course of implementation of this Circular should be promptly reported to the Ministry of Agriculture and Rural Development for guidance and settlement.-
