CIRCULAR
Promulgating the list of articles liable to plant quarantine; list of articles liable to quarantine and subject to pest risk analysis
before being imported into Vietnam

Pursuant to the Government’s Decree No. 105/2022/ND-CP dated December 22, 2022, on defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Law on Plant Protection and Quarantine dated November 25, 2013;
At the proposal of the Director of the Department of Plant Protection;
The Minister of Agriculture and Rural Development promulgating the list of articles liable to plant quarantine; list of articles liable to quarantine and subject to pest risk analysis before being imported into Vietnam.
Article 1. List of articles liable to plant quarantine
1. Vegetation:
Plants and parts of plants.
2. Plant products:
a) Various types of tubers, bulbs, fruits, seeds, flowers, leaves, plant bodies, stems, roots, barks;
b) Various types of broken rice, bran, oil cakes, cassava slices, raw natural fibers and vegetable fibers;
c) Flour extracted from plants, manioc (cassava) starch;
d) Tobacco stems, raw cotton, cotton waste, straw and aquatic plants (except for seaweed, algae, and marine aquatic plants);
dd) Round woods, sawlogs, wooden pallets, sawdust, coconut coir;
e) Animal feed materials extracted from plants (except for food in finished product form that has been tightly packaged and labeled);
g) Growing medium made from plants.
3. Various types of mushrooms (except for salted, frozen, canned mushrooms and yeasts).
4. Cocoons, silk wastes.
5. Various types of insects, spiders, pathogenic fungus, nematodes, bacteria, viruses, phytoplasmas, viroids and weeds (excluding specimens) serving the work of examination, training, biological control and scientific research.
6. Where the exportation of articles that are not specified in the List defined in this Article, the plant quarantine shall be carried out at the request of importing countries and under treaties of which Vietnam is the signatory or has acceded.
Article 2. List of articles liable to quarantine and subject to pest risk analysis before being imported into Vietnam
1. Propagating material: Seedlings, seeds, tubers, and other plant parts that can be used for propagation (excluding tissue-cultured plants, seeds of cruciferous plants, seeds of rice, maize, millet, bulbs of shallots, garlic for propagation).
2. Fresh fruits, fresh sweet potatoes, fresh potatoes
3. Weeds and weed seeds for planting purposes.
4. Beneficial organisms used in plant protection (excluding beneficial organisms imported in the form of biological pesticides).
5. Other articles liable to quarantine with a high risk of carrying plant quarantine objects, as identified by the Department of Plant Protection and reported to the Minister of Agriculture and Rural Development for decision.
Article 3. Articles liable to quarantine exempt from pest risk analysis
Articles liable to quarantine defined in Article 2 of this Circular shall be exempted from pest risk analysis in the following cases:
1. Imported propagating materials for scientific research or testing and evaluation in laboratories.
2. Beneficial organisms used in plant protection imported for scientific research or testing and evaluation in laboratories.
3. Other cases, as reported by the Department of Plant Protection to the Minister of Agriculture and Rural Development for decision.
4. For the import of articles specified in Clauses 1, 2 and 3 of this Article, import plant quarantine permits and implementation of plant quarantine according to regulations are required.
Article 4. Transitional provisions
1. For dossiers of request for phytosanitary certificates, for articles in the list of articles liable to plant quarantine; or for import plant quarantine permits, for articles in the list of articles liable to quarantine and subject to pest risk analysis before being imported into Vietnam that have been submitted before the effective date of this Circular, the Circular No. 30/2014/TT-BNNPTNT dated September 05, 2014 of the Minister of Agriculture and Rural Development, on promulgating the list of articles liable to plant quarantine; list of articles liable to quarantine and subject to pest risk analysis before being imported into Vietnam shall apply.
2. For articles liable to quarantine and subject to pest risk analysis before being imported into Vietnam that have been licensed for import prior to the effective date of this Circular, if evidence of Vietnam’s plant quarantine objects newly appearing in the exporting country is found, the plant quarantine authority of the exporting country must provide the related information to the Department of Plant Protection to take necessary measures to prevent such plant quarantine objects.
Article 5. Implementation provisions
1. This Circular takes effect on December 15, 2024.
2. The Circular No. 30/2014/TT-BNNPTNT dated September 05, 2014 of the Minister of Agriculture and Rural Development, on promulgating the list of articles liable to plant quarantine; list of articles liable to quarantine and subject to pest risk analysis before being imported into Vietnam shall cease to be effective from the effective date of this Circular.
Article 6. Implementation responsibility
1. The Chief of Office of the Ministry, Director of the Department of Plant Protection, relevant organizations and individuals shall be responsible for implementing this Circular.
2. Any difficulties or problems arising during the process of implementing the Circular should be promptly reported to the Ministry of Agriculture and Rural Development (Department of Plant Protection) for synthesis and submission to the Minister for consideration and decision./.
