CIRCULAR

Prescribing the adjustment in the monthly allowance for demobilized, retired, or discharged army men and persons engaged in the cipher work who are salaried like army men

Pursuant to the Government’s Decree No. 01/2022/ND-CP of November 30, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of National Defence;

Pursuant to the Government’s Decree No. 75/2024/ND-CP of June 30, 2024, adjusting pensions, social insurance benefits and monthly allowances;

Pursuant to the Prime Minister’s Decision No. 142/2008/QD-TTg of October 27, 2008, implementing policies for army men participating in the resistance war against the U.S. to save the nation, with less than 20 years of service in the military, that have been demobilized and returned to their localities;

Pursuant to the Prime Minister’s Decision No. 38/2010/QD-TTg of May 6, 2010, amending and supplementing the Prime Minister’s Decision No. 142/2008/QD-TTg of October 27, 2008 implementing policies for army men participating in the resistance war against the U.S. to save the nation, with less than 20 years of service in the military, that have been demobilized and returned to their localities;

Pursuant to the Prime Minister’s Decision No. 62/2011/QD-TTg of November 9, 2011, implementing regimes and policies for individuals that participated in the war to defend the homeland, carried out international missions in Cambodia, and assisted Laos after April 30, 1975, and have been demobilized, retired or discharged;

At the proposal of the Chairman of the General Political Department;

The Minister of National Defence promulgates the Circular prescribing the adjustment in the monthly allowance for demobilized, retired, or discharged army men and persons engaged in the cipher work who are salaried like army men.

 

Article 1. Scope of regulation

This Circular prescribes the adjustment in the monthly allowance for demobilized, retired, or discharged army men and persons engaged in the cipher work who are salaried like army men.

Article 2. Subjects of application

1. Army men that have been demobilized or retired and are currently receiving monthly allowances as prescribed in the Prime Minister’s Decision No. 142/2008/QD-TTg of October 27, 2008 implementing policies for army men participating in the resistance war against the U.S. to save the nation, with less than 20 years of service in the military, that have been demobilized and returned to their localities (below referred to as Decision No. 142/2008/QD-TTg); and the Prime Minister’s Decision No. 38/2010/QD-TTg of May 6, 2010, amending and supplementing Decision No. 142/2008/QD-TTg.

2. Demobilized, retired or discharged army men and persons engaged in the cipher work who are salaried like army men that are currently receiving monthly allowances as prescribed in the Prime Minister’s Decision No. 62/2011/QD-TTg of November 9, 2011, implementing regimes and policies for individuals that participated in the war to defend the homeland, carried out international missions in Cambodia, and assisted Laos after April 30, 1975, and have been demobilized, retired or discharged.

3. Relevant agencies, units, organizations, and individuals.

Article 3. Calculation and adjustment rates

1.   An additional 15% increase on the monthly allowance for June 2024 shall be applied to the individuals prescribed in Clauses 1 and 2 of Article 2 of this Circular, according to the following formula:

2. The monthly allowance for the individuals prescribed in Clauses 1 and 2 of Article 2 of this Circular, after the increase, is specified as follows:

a) From 15 years to under 16 years of service, the allowance is VND 2,628,000/month;

b) From 16 years to under 17 years of service, the allowance is VND 2,746,000/month;

c) From 17 years to under 18 years of service, the allowance is VND 2,868,000/month;

d) From 18 years to under 19 years of service, the allowance is VND 2,988,000/month;

dd) From 19 years to under 20 years of service, the allowance is VND 3,105,000/month.

Article 4. Funding for implementation

The funding for adjusting the monthly allowance for the subjects prescribed in this Circular shall be covered by the State budget. The Ministry of Finance shall allocate the necessary funds based on the proposal from the Ministry of Labor, Invalids and Social Affairs to authorize the Departments of Labor, Invalids, and Social Affairs of provinces and cities to make payments to the beneficiaries.

Article 5. Organization of implementation

1. The General Political Department shall direct the Policy Department to:

a) Assume the prime responsibility for, and coordinate with relevant agencies inside and outside the military in, implementing, guiding, and inspecting the implementation of this Circular by agencies, units, and localities.

b) Make the adjustment of the allowance levels as guided in Article 3 of this Circular for subjects that are entitled to receive monthly allowances from the effective date of this Circular onwards.

2. The Departments of Labor, Invalids, and Social Affairs of provinces and centrally-run cities shall adjust and pay monthly allowances as guided in Article 3 of this Circular for subjects that are entitled to receive monthly allowances before the effective date of this Circular.

Article 6. Effect

1. This Circular takes effect from November 1, 2024. The provisions of this Circular shall be implemented from July 1, 2024.

2. The Minister of National Defence’s Circular No. 82/2023/TT-BQP of November 3, 2023, prescribing the adjustment in the monthly allowance for demobilized, retired, or discharged army men and persons engaged in the cipher work who are salaried like army men, shall cease to be effective from the effective date of this Circular.

Article 7. Transitional provisions

Continue to implement the calculation and adjustment of monthly allowances for demobilized, retired, or discharged army men and persons engaged in the cipher work who are salaried like army men, as prescribed in the joint circulars or circulars issued by the Minister of National Defence before the effective date of this Circular, for subjects entitled to monthly allowances under Decision No. 142/2008/QD-TTg and Decision No. 62/2011/QD-TTg from the effective date of this Circular as decided the competent authorities, ensuring the consistency in the beneficiaries and the monthly allowance levels corresponding to the effective period of each document.

Article 8. Implementation responsibility

1. The heads of relevant agencies, units, organizations, and individuals shall implement this Circular.

2. The agencies, units, and localities should promptly report any problem arising in the course of implementation to the Ministry of National Defence (through the Policy Department/General Political Department) for compilation and submission to the leadership of the Ministry of National Defence for consideration and decision./.
