DECREE

Defining the functions, tasks, powers and organizational structure of the Ministry of Science and Technology[1]

 

Pursuant to the February 18, 2025 Law on Organization of the Government;

At the proposal of the Minister of Science and Technology;

The Government promulgates the Decree defining the functions, tasks, powers and organizational structure of the Ministry of Science and Technology.

Article 1. Position and functions

The Ministry of Science and Technology is an agency of the Government, performing the function of state management of scientific research, technological development, innovation, development of high technologies and strategic technologies, and development of scientific and technological potential; intellectual property; standards, measurement and quality; atomic energy, and radiation and nuclear safety; post; telecommunications; radio frequencies; information technology industry and digital technology industry; application of information technology; e-transactions; national digital transformation; and public services in the sectors and fields under the Ministry’s management in accordance with law.

Article 2. Tasks and powers

The Ministry of Science and Technology shall perform the tasks and exercise the powers in accordance with the Law on Organization of the Government, the Government’s regulations on the functions, tasks, powers and organizational structures of ministries and ministerial-level agencies, and has the following specific tasks and powers:

1. To submit to the Government draft laws and draft resolutions of the National Assembly, and draft ordinances and draft resolutions of the National Assembly Standing Committee; the Government’s draft decrees under the Government’s annual lawmaking programs and plans, and resolutions, projects and schemes as assigned by the Government or the Prime Minister.

2. To submit to the Government or the Prime Minister strategies, master plans, and long-term, medium-term and annual development plans; national important works, programs, projects and schemes in the sectors and fields assigned to the Ministry for management; and decisions, directives and other documents within the Prime Minister’s competence.

3. To promulgate circulars, decisions, directives and other documents on the management of the sectors and fields falling under the Ministry’s state management.

4. To approve 5-year and annual orientations, objectives, tasks and plans on science, technology and innovation, and science, technology and innovation tasks under the Ministry’s state management in conformity with the science and technology development and innovation strategy and as decentralized or authorized by the Government or the Prime Minister.

5. To direct, guide, inspect and organize the implementation of approved legal documents, strategies, master plans, programs, schemes and plans; to carry out public communication, dissemination and education about the law on sectors and fields under the Ministry’s state management.

6. To grant, modify, supplement, extend, suspend, terminate and revoke licenses, certificates, letters of confirmation and registration papers within the scope of the Ministry’s state management of sectors and fields in accordance with law.

7. Regarding science, technology and innovation activities

a/ To direct and guide the implementation of science, technology and innovation orientations, objectives and tasks, and promote the development of key economic-technical sectors and fields on the basis of application, innovation and mastery of technologies, development of new technologies, high technologies, digital technologies, strategic technologies, and commercialization of technologies and outcomes of scientific research and technological development;

b/ To perform the state management of research, development and application of technologies in economic-technical sectors and fields; to provide ministries, sectors and localities with professional guidance on the management of science, technology and innovation activities;

c/ To formulate, and guide and organize the implementation of, mechanisms and policies on high technology and hi-tech parks; to manage and organize the certification of hi-tech activities and certification of hi-tech enterprises; to build databases and information infrastructure on high technologies;

d/ To perform the state management of strategic technologies; to formulate, and guide and organize the implementation of, mechanisms, policies, programs and measures to promote the development of strategic technologies in Vietnam;

dd/ To guide the identification, order placement, selection, direct assignment, evaluation and acceptance testing of science, technology and innovation tasks; to coordinate with the Ministry of Finance in guiding the determination of the value of assets being outcomes of scientific and technological tasks and intellectual assets in accordance with law; the assignment of ownership and use rights over outcomes of state budget-funded scientific research, technological development and innovation; to utilize, apply and commercialize technologies and scientific research and technological development outcomes; to announce and disseminate outcomes of scientific research, technological development and innovation;

e/ To manage the performance of science, technology and innovation tasks in the fields under the Ministry’s management; to formulate, and guide and organize the performance of, national-level scientific and technological tasks; to manage and organize the performance of tasks in national science, technology and innovation programs and schemes approved by the Prime Minister;

g/ To inspect, supervise and evaluate the implementation of state budget-funded scientific, technological and innovation programs and projects and resolve issues arising from the acceptance testing thereof as authorized; to organize the independent evaluation of outcomes of scientific research, technological development and innovation;

h/ To guide and register the operation of science and technology organizations in accordance with law;

i/ To formulate, and guide and organize the implementation of, mechanisms and policies to promote and support the research and application of technologies and technical advances and technology incubation;

k/ To assist organizations and individuals in evaluating technologies, innovating technologies, seeking technologies, and transferring, decoding and mastering technologies from foreign countries, and utilizing inventions; to guide and evaluate technological qualifications and capacity and formulate technological development orientations and national technological innovation roadmaps in accordance with law;

l/ To formulate and submit to the Government for promulgation specific regulations on the competence, order, procedures and conditions for grant of certificates of eligibility for provision of technology evaluation and assessment services; and specific conditions on human resources and physical and technical foundations for organizations engaged in technology evaluation, and organize the implementation thereof after they are promulgated;

m/ To formulate, and guide and organize the implementation of, mechanisms and policies on technology evaluation, appraisal, assessment and transfer; to manage the import of used machinery, equipment and technological lines; to manage the identification of investment projects using outdated technologies that are likely to cause environmental pollution and involve excessive use of resources; to assess the quality and value of machinery, equipment and technological lines of investment projects in accordance with law; to appraise, or give appraisal opinions on, technologies; to give opinions on scientific and technological contents of national-level, regional and provincial master plans, master plans on special administrative-economic units, urban and rural master plans, technically specialized master plans, and scientific research and technological development programs and schemes serving technology transfer and development of the science and technology market.

8. Regarding innovation and technology market development

a/ To uniformly manage innovative activities; to formulate, and guide, inspect and organize the implementation of, incentive and support mechanisms and policies for the innovation promotion, and mobilize investment resources for innovation;

b/ To manage, guide and organize the implementation of innovation activities; to develop the science and technology market and the national innovation system centering on enterprises; to create and promote a legal environment in support of innovation;

c/ To guide the establishment, management and development of the system of innovation organizations and innovation support organizations; to identify innovation and innovation support centers in accordance with law; to build, operate and develop innovation networks;

d/ To manage, guide and organize the development of the science and technology market; to promote regional, national and international technology markets; to develop intermediary organizations of the science and technology market, technology trading centers and technology exchanges;

dd/ To support the improvement of technological capacity for enterprises in accordance with law; to formulate and implement programs and projects to support the development of the science and technology market;

e/ To direct and organize technology and equipment marketplaces, and technology supply-demand connection activities; technology trading, technology transfer promotion; and exhibition activities concerning science, technology and innovation.

9. Regarding innovative startup activities and science and technology enterprises

a/ To uniformly manage technology incubation and innovative startup activities, and science and technology enterprises; to formulate, and guide, inspect and organize the implementation of, mechanisms and policies on identification and recognition, and incentives, support and promotion for the development of technology incubators, science and technology enterprise incubators, technical facilities, co-working spaces, individuals, groups of individuals and enterprises engaged in innovative startup activities, innovative startup consultants, innovative startup support organizations, innovative startup investors, and other subjects of the innovative startup ecosystem;

b/ To manage and develop the national innovative startup ecosystem; to create and promote a legal environment and mobilize investment resources for innovative startups, technology incubators, and science and technology enterprise incubation activities;

c/ To manage, guide and organize the development of the system of innovative startup support organizations, technology incubators, science and technology enterprise incubators, technical facilities, and co-working spaces to support innovative startup activities; to establish, operate and develop the national innovative startup network, and experts, advisors, and investors engaged in innovative startup activities;

d/ To formulate and implement programs, schemes and projects to provide support for technology incubation, science and technology enterprise incubation and innovative startup activities; support for public higher education institutions, public vocational education institutions and other public science and technology organizations to establish, jointly establish or contribute capital to enterprises in order to commercialize outcomes of scientific research and technological development; to direct and organize local and international events on technology incubation, science and technology enterprise incubation, and innovative startup activities.

10. Regarding development of science, technology and innovation potential

a/ To assume the prime responsibility for, and coordinate with ministries, sectors and localities in, formulating and submitting to competent authorities for approval the master plan on the network of public science and technology organizations, and organize the implementation thereof after it is promulgated; to guide the implementation of the autonomy mechanism for public science and technology organizations; to submit to the Prime Minister for promulgation the list of basic and essential public non-business services in the field of science and technology; to assume the prime responsibility for, and coordinate with the Ministry of Finance and related ministries and agencies in, submitting to competent authorities for promulgation, and organize the implementation of, mechanisms and policies to increase the autonomy of public science and technology organizations;

b/ To specify criteria for classification, ranking and conditions for establishment, merger, consolidation, reorganization and dissolution of science and technology organizations; to establish, and appraise conditions for the establishment, reorganization and dissolution of, public science and technology organizations in accordance with law; to guide the functions, tasks, powers, organizational structure and operation regulation of management councils in public science and technology organizations;

c/ To formulate, and organize the implementation of, long-term training plans for scientific and technological human resources, plans on training and further training for improvement of professional qualifications of science and technology human resources; to organize professional training and further training in science and technology for science and technology human resources under the Ministry’s management;

d/ To promulgate according to the Ministry’s competence or submit to competent authorities for promulgation, and organize the implementation of, mechanisms and policies on training, further training, employment and preferential treatment of individuals engaged in scientific and technological activities; and policies to attract scientists, experts and intellectuals who are overseas Vietnamese;

dd/ To manage, guide and organize science, technology and innovation information, library and statistics collection activities; to manage domestic scientific and technological publications; to build science, technology and innovation information and statistics infrastructure; to build and develop the national database on science and technology, and science, technology and innovation databases; to supplement international scientific and technological information sources in a centralized manner; to invest in the development of the national scientific and technological information network connected to the region and the world;

e/ To plan, guide and organize public communication activities on science, technology and innovation.

11. Regarding intellectual property

a/ To assume the prime responsibility for, and coordinate with ministries, sectors and localities in, formulating, and guiding and organizing the implementation of, intellectual property mechanisms, policies, strategies, master plans, plans, programs and schemes;

b/ To formulate, and guide, organize and inspect the implementation of, the law on intellectual property; to specify order and procedures for establishment and transfer of industrial property rights of organizations and individuals;

c/ To perform the state management of initiative activities;

d/ To guide and organize the establishment and transfer of industrial property rights, including also the management of the use of national geographical indications (“Việt Nam”, “Việt”, “Viet Nam”, “Viet”) for registration of certification marks and collective marks for Vietnam’s national products and services; to take measures to protect the lawful interests of the State, organizations and individuals in the field of industrial property;

dd/ To provide guidance on industrial property operations to management agencies, and organizations and individuals; to guide and support organizations and individuals in managing, exploiting and developing intellectual assets under the Ministry’s state management in accordance with law;

e/ To manage industrial property representation, industrial property assessment and other intellectual property services;

g/ To assume the prime responsibility for settling industrial property disputes and industrial property-related commercial disputes in accordance with law;

h/ To coordinate with the Ministry of Culture, Sports and Tourism, the Ministry of Agriculture and Environment and the Ministry of Industry and Trade in performing the state management of intellectual property in relevant sectors as assigned by the Government.

12. Regarding standards, measurement and quality

a/ To manage activities in the field of standards and technical regulations; to appraise and declare national standards; to guide the formulation and appraisal of national technical regulations; to participate in the formulation of international standards and regional standards; to guide the application of international standards, regional standards and foreign standards in Vietnam; to guide the formulation of local technical regulations; to guide the formulation and declaration of in-house standards; to manage the operation of the notification and enquiry agencies and the Interdisciplinary Committee on Technical Barriers to Trade; to manage the national database on national standards and national technical regulations; to perform the state management of goods labels and article numbers, barcodes and traceability of products and goods;

b/ To organize the formulation and guide the application of national standards, and formulate, promulgate, and guide the application of, national technical regulations in the fields assigned to the Ministry for management; to perform the functions and tasks of the notification and enquiry agency on technical barriers to trade in the fields falling under the Ministry’s state management;

c/ To manage the establishment, maintenance, preservation, use, development and application of the system of measurement standards; to approve national measurement standards; to organize the research, implementation, application, development, manufacturing and production of products, standard substances and measuring devices; to designate organizations preserving national measurement standards; to organize the measurement-related management of measuring devices, measurements, pre-packaged goods quantity and measurement standards; to organize the management of inspection, calibration and testing of measuring devices and measurement standards; to support the renovation and development of measurement activities at enterprises; to carry out the state inspection of measurement, product quality and goods labels in accordance with law;

d/ To assume the prime responsibility for, and coordinate with related ministries and sectors in, organizing the state management of product and goods quality and traceability in the production of goods for export and import and goods circulated on the market and during their use in accordance with law;

dd/ To guide and manage conformity assessment of standards and technical regulations, and recognize the capacity of conformity assessment organizations;

e/ To organize the research, application and improvement of productivity and quality in sectors and fields; to assume the prime responsibility for implementing the national program to improve productivity and quality of products and goods; to assume the prime responsibility for implementing and applying traceability of products and goods; to carry out research, consultancy, training and application of science, technology and innovation in the field of standards, measurement and quality; to assume the prime responsibility for, and coordinate with related ministries and sectors in, organizing the implementation of international agreements and treaties in the field of standards, technical regulations, measurement, productivity, product and goods quality, goods labels, article numbers, barcodes and traceability of products and goods, and conformity assessment; to manage, guide and organize the application of the advanced quality management system in the operation of agencies and organizations in the state administrative system, and other organizations and enterprises; to manage, guide and organize the implementation of the National Quality Award; to manage the consideration and awarding of product and goods quality awards for organizations and individuals;

g/ To organize the establishment, management, operation, maintenance and exploitation of the system of databases on article numbers, barcodes and traceability of products and goods; to organize professional training and further training in the field of article numbers, barcodes and traceability of products and goods for agencies and organizations within the state administrative system, and organizations and enterprises.

13. Regarding atomic energy, radiation and nuclear safety

a/ To perform the state management of research, development and application of atomic energy in the economic-technical sectors; to assume the prime responsibility for, and coordinate with ministries and sectors in, formulating, and guiding and organizing the implementation of, master plans and plans on development of atomic energy application for the socio-economic development;

b/ To perform the state management of radiation and nuclear safety assurance, nuclear security and inspection, and response to radiation and nuclear incidents;

c/ To formulate and submit to competent authorities for promulgation or promulgate according to the Ministry’s competence, and organize the implementation of, mechanisms, policies and legal documents on atomic energy, and radiation and nuclear safety under regulations;

d/ To carry out inspection and handle violations in the assurance of radiation safety and nuclear safety for atomic energy activities;

dd/ To manage the national environmental radiation monitoring and warning network and the system of radiation and nuclear measurement standards;

e/ To perform the state management of safety and security of nuclear fuels, spent nuclear fuels, nuclear materials, source nuclear materials, radioactive wastes, and the provision of services for the atomic energy application; to manage the import and export of radiation equipment technology, nuclear fuels, spent nuclear fuels, nuclear materials and radioactive sources nationwide;

g/ To regulate the control and handling of radiation incidents and nuclear incidents;

h/ To regulate the control of occupational exposure, medical exposure and radiation safety for the public.

14. Regarding post

a/ To guide, organize and inspect the implementation of mechanisms, policies, strategies, master plans, plans, projects, schemes and programs on post; to organize the inspection of the list of, support mechanisms for, and activities of, provision of public postal services in accordance with law;

b/ To set and manage prices and quality of public postal services, private postal services, postal services serving agencies of the Party and the State, and other postal services in accordance with law;

c/ To manage postage stamps and safety in postal activities according to the Ministry’s competence;

d/ To manage the national postal codes and Vietnam’s postage stamp codes;

dd/ To provide according to the Ministry’s competence, and guide the operation of, the public postal network and the postal network serving the operation of agencies of the Party and the State;

e/ To coordinate the management of competition-related issues and settlement of disputes in the post sector, and protect the lawful interests of postal service users in accordance with law.

15. Regarding telecommunications

a/ To guide, direct and organize the implementation of strategies, master plans, plans, programs, mechanisms and policies on telecommunications, the Internet and digital infrastructure;

b/ To promulgate the list, scope, subjects and charge rates of public telecommunications services and mechanisms for provision of support for enterprises that provide public telecommunications services, support for the use of public telecommunications services, and support for the provision of terminal equipment in accordance with law; to organize the implementation of the program on provision of public telecommunications services;

c/ To assume the prime responsibility for formulating, and organizing the implementation of, regulations on market surveillance and competition in the field of telecommunications and the Internet; to protect the interests of telecommunications service users and Internet users in accordance with law;

d/ To promulgate, and organize the implementation of, the master plan and regulations on management and use of telecommunications number stores and Internet resources; to allocate, grant and recover telecommunications number stores and Internet resources; to organize the auction and transfer of the right to use telecommunications codes and numbers and the Vietnam national domain name “.vn”;

dd/ To promulgate mechanisms, policies and regulations on, and organize the management of, charge rates in the field of telecommunications and the Internet in accordance with law; to control, and terminate the application of, telecommunications service charge rates when telecommunications enterprises impose or dump telecommunications service charge rates, making the telecommunications market unstable and harming the lawful rights and interests of telecommunications service users, other telecommunications enterprises and the State; to coordinate the management of sales promotion in the telecommunications sector; to direct and guide the implementation of the regulations on reporting, accounting and auditing serving the management of telecommunications and Internet service charge rates;

e/ To promulgate, and organize the implementation of, regulations on management of the connection of telecommunications networks;

g/ To provide according to the Ministry’s competence and guide the operation of private telecommunications networks serving the agencies of the Party and the State;

h/ To guide the formulation and implementation of plans and options on development of the telecommunications network; to direct, guide and inspect the sharing and shared use of telecommunications infrastructure;

i/ To assume the prime responsibility for ensuring the safety of telecommunications infrastructure, and coordinate with the Ministry of Public Security in ensuring information security in telecommunications activities in accordance with law;

k/ To manage telecommunications and Internet quality; to build, manage and operate testing and calibration laboratories specialized in telecommunications and the Internet in accordance with law;

l/ To establish, manage, operate and exploit the telecommunications data collection and management system and the land mobile telecommunications switching system with telecommunications subscriber numbers unchanged (switching centers);

m/ To establish, manage, operate and exploit safely the national domain name server system, the Vietnam National Internet eXchange (VNIX) and the national Internet resource management system connected with the regional and international systems;

n/ To establish the system and platforms for measuring Internet speed, IPv6; to collect and publicize statistics on the Internet and Internet resources;

o/ To formulate programs on, and promote, the application and transformation of the Internet to the new generation of IPv6, and develop industrial Internet and Internet of Things (IoT); to promote the safe and sustainable development of Internet resources, and universalize the Vietnam national domain name “.vn”;

p/ To carry out international coordination, registration, receipt, transfer and maintenance of Vietnam’s Internet resources with regional and international organizations.

16. Regarding radio frequencies

a/ To guide and organize the implementation of the master plan on national radio frequency spectra; and transmission and broadcasting activities under the Prime Minister-approved master plan on information and communication infrastructure;

b/ To assume the prime responsibility for, and coordinate with the Ministry of National Defense and Ministry of Public Security in, allocating frequency bands for national defense and security purposes and submit them to the Prime Minister for approval;

c/ To promulgate the master plan on frequency bands, the master plan on frequency channel demarcation, and the master plan on the use of frequency channels, and specify conditions for allocation, determination and use of radio frequencies;

d/ To manage the quality of radio emissions, electromagnetic compatibility and radio radiation safety in accordance with law;

dd/ To specify technical conditions and conditions for exploitation of radio equipment exempt from licenses;

e/ To provide training and guidance on radio operations; to manage the training of radio operators and the grant of radio operator certificates;

g/ To manage the fee for grant of radio frequency use permits, radio frequency use charge, and fee for grant of the radio frequency use right in accordance with law;

h/ To inspect and control radio frequencies and equipment, and handle harmful interferences;

i/ To carry out international registration and coordination on radio frequencies and satellite orbits;

k/ To submit to competent authorities for promulgation, and organize the implementation of, regulations on auction, selection, and transfer of the right to use, radio frequencies.

17. Regarding the information technology industry and the digital technology industry

a/ To guide, direct and organize the implementation of strategies, plans, policies, programs, schemes and projects on development of the information technology industry, the digital technology industry and the semiconductor industry;

b/ To submit to competent authorities for promulgation or promulgate according to the Ministry’s competence policies, incentives and priorities for investment in the development of the information technology industry, the digital technology industry and the semiconductor industry; to announce the list, and formulate programs for the development, of key and important information technology and digital technology products and services;

c/ To appraise programs, plans and projects on development of the information technology industry, the digital technology industry and the semiconductor industry;

d/ To issue or submit to competent authorities for issuance criteria for evaluation and certification of functions and technical properties of products and services of the information technology industry and the digital technology industry; and mechanisms and policies for the management and development of information technology and digital technology parks;

dd/ To issue and recognize according to the Ministry’s competence standards on information technology and digital technology skills;

e/ To organize investment and trade promotion support activities for the information technology industry and the digital technology industry;

g/ To perform quality management and conformity assessment activities for products and services in the fields of information technology industry and digital technology in accordance with law.

18. Regarding national digital transformation

a/ To perform tasks of the standing body of the National Committee for Digital Transformation; to act as a focal point for summing up and giving advices on the interdisciplinary coordination among ministries, sectors and localities in the implementation of guidelines, strategies, programs, plans, schemes, mechanisms and policies to create a legal environment to intensify the application of information technology and national digital transformation;

b/ To formulate, and guide and organize the implementation of, mechanisms, policies, strategies, plans, programs and joint schemes on national digital transformation;

c/ To promulgate a set of indicators for evaluating the digital transformation level at the national, ministerial and provincial levels; to annually evaluate and announce evaluation results.

19. Regarding building and development of e-government and digital government

a/ To formulate, and guide and organize the implementation of, national mechanisms, policies, strategies, plans, programs and schemes on application of information technology in state agencies, building of e-government, digital government and smart cities; to guide, appraise, examine, evaluate and rank the formulation and implementation of programs, plans, schemes and projects on application of information technology, building of e-government, digital government and smart cities by ministries, sectors and localities according to the Ministry’s competence; to evaluate and inspect the quality of information technology application products and solutions, and the building of e-government, digital government and smart cities;

b/ To formulate and promulgate the list of shared-use digital platforms of state agencies; to announce the list of key digital transformation tasks of state agencies, place orders and assign tasks to digital technology enterprises for performance;

c/ To guide, supervise and examine activities of data governance, sharing and exploitation in the building of e-government and digital government in accordance with law;

d/ To build, maintain, update and operate Vietnam’s E-Government and Digital Government Architecture Framework and the ICT Reference Framework for Smart City Development; to build, and guide the realization of, the model of intelligent operations centers of state agencies;

dd/ To build and operate information system testing laboratories; to develop, manage and operate platforms for national data integration and sharing, platforms for monitoring and measurement of digital government service provision and use level, the Government’s cloud computing platform, platforms for  management of investment in information technology application, and digital platforms serving the application of information technology in state agencies and the building of e-government and digital government according to the Ministry’s competence;

e/ To carry out public communication about, and organize training and further training in, the application of information technology and digital transformation in state agencies, and building and development of e-government and digital government.

20. Regarding digital economy and digital society

a/ To guide and organize the implementation of national mechanisms, policies, strategies, laws, plans, programs and schemes on development of digital economy and digital society;

b/ To guide and evaluate the formulation and implementation of programs, plans, schemes and projects related to digital economy and digital society;

c/ To manage and promote the development of platform digital economy and national digital platform to serve the development of digital economy and digital society; to carry out public communication about, and organize training and further training for promotion of digital transformation in enterprises, new business models applying digital technologies, digital skills, digital citizenship, digital connectivity, and digital culture, and observance of the code of conduct in the digital environment by members of the society and communities;

d/ To build, manage and operate information systems and databases on national digital economy and digital society development in accordance with law.

21. Regarding e-transactions

a/ To guide, direct and organize the implementation of strategies, plans, policies, programs and schemes on development of e-transactions; legal documents on e-transactions; and technical requirements, technical auditing and quality of products and services in e-transactions; 

b/ To manage e-transaction reporting, measurement and statistics; to manage the safety supervision of information systems serving e-transactions by information system administrators; to build, manage and operate the system for receiving and synthesizing data to serve the state management of e-transactions by state agencies;

c/ To manage digital signatures, trust services and trust service providers; to recognize foreign e-signatures, foreign e-signature certificates, and foreign e-signature authentication service providers in accordance with law;

d/ To manage and organize the establishment, exploitation and development of national electronic authentication infrastructure, the inspection maintenance system of digital signature certificate status; and issuance and revocation of digital signature certificates.

dd/ To stipulate the interoperability between systems providing public digital signature services and those providing official digital signatures.

22. To build, manage, operate and exploit private post and telecommunications networks and special-use data transmission networks to serve the direction and administration by agencies of the Party and the State.

23. To decide on measures to mobilize information transmission networks, services, media and equipment to serve the handling of cases of national security emergency, disasters and enemy sabotage as assigned by the Government or the Prime Minister.

24. To manage civil servants and specialized public employees under the Ministry’s management in accordance with law.

25. To manage, guide and organize the conferment of the Ho Chi Minh Prize and State Prizes in science and technology; and other awards in the sectors and fields under the Ministry’s management in accordance with law; to organize the conferment of prizes and perform the emulation and commendation work in accordance with law.

26. To decide on, and organize the implementation of, preventive and deterrent measures against information-related violations within ambit of the Ministry’s functions and tasks in accordance with law.

27. To carry out inspection and examination, settle complaints and denunciations, receive citizens, prevent and combat corruption, negative practices and waste, and handle violations in the fields under the Ministry’s state management in accordance with law.

28. To train, further train and develop human resources in the fields under the Ministry’s management; to forecast demands and set orientations for development of human resources in the sectors and fields under the Ministry’s management.

29. To manage the Ministry’s organizational apparatus, employment positions, payroll of civil servants, and number of employees of public non-business units; to decide on the appointment, reappointment, transfer, rotation, dismissal, resignation from office, relief from duty and secondment of personnel, and implement the salary regime, preferential treatment policies, commendation and disciplining, and other regimes toward cadres, civil servants and public employees; to formulate, and organize the implementation of, plans on professional training and further training for cadres, civil servants, public employees and workers under the Ministry’s management in accordance with law.

30. To manage finances and assets and organize the implementation of the Ministry’s assigned budget estimates in accordance with law; to formulate proposals for structure and levels of state budget expenditures for scientific and technological activities.

31. Regarding international cooperation and integration

a/ To guide and organize the implementation of international integration activities in the sectors and fields under the Ministry’s management under regulations;

b/ To assume the prime responsibility for negotiating and consider donations for joint programs and projects with international partners in the sectors and fields under the Ministry’s management within the framework of bilateral, multilateral, regional and inter-regional agreements; to organize the implementation of approved bilateral and multilateral cooperation programs and agreements as well as schemes on international and regional integration in the sectors and fields under the Ministry’s management; to establish a network of overseas science and technology representatives as directed by the Government or the Prime Minister.

c/ To act as an official representative of Vietnam at international organizations in the sectors and fields under the Ministry’s management as assigned or authorized by the Government or the Prime Minister.

32. To perform the state management of public non-business services in the sectors and fields under the Ministry’s management; to carry out supervision, evaluation and quality inspection of public non-business services, operation efficiency of public non-business units under the Ministry’s management; to perform the state management of prices of public non-business services in accordance with law.

33. To exercise rights and fulfill responsibilities and obligations of the state owner’s representative with respect to state enterprises and state capital amounts invested in other enterprises in accordance with law.

34. To organize the management of associations and non-governmental organizations operating in the sectors and fields falling under the Ministry’s state management in accordance with law.

35. To manage off-budget state financial funds under the Ministry’s management in accordance with law; to manage and organize the implementation of investment projects falling within the Ministry’s competence in accordance with law.

36. To organize the implementation of the Ministry’s administrative reform plan under the state administrative reform program approved by the Government or the Prime Minister;

37. To perform other tasks and exercise other powers as assigned by the Government or the Prime Minister and as prescribed by law.

13. The Authority of Central Posts.

14. The Authority of Information Technology Industry.

15. The Authority of National Digital Transformation.

16. The State Agency for Technology Innovation.

17. The Department of Startups and Technology Enterprises.

18. The Intellectual Property Office of Vietnam.

19. The Authority of Radio Frequency Management.

20. The National Agency for Science and Technology Information and Statistics.

21. The Vietnam Telecommunications Authority.

22. The National Committee for Standards, Metrology and Quality.

23. The Information Technology Center.

24. The Institute of Science and Technology Strategy.

25. The VnExpress online newspaper.

The units specified in Clauses 1 thru 22 of this Article are administrative organizations assisting the Minister in performing the state management functions; the organizations specified in Clauses 23 thru 25 of this Article are public non-business units serving the Ministry’s state management function. The National Committee for Standards, Metrology and Quality may use the official seal bearing the national emblem.

The Minister of Science and Technology shall submit to the Prime Minister for promulgation a decision defining the functions, tasks, powers and organizational structure of the Institute of Science and Technology Strategy and a list of other public non-business units attached to the Ministry.

The Minister of Science and Technology shall define the functions, tasks, powers and organizational structures of units attached to the Ministry according to his/her competence.

Article 4. Transitional provisions

1. The Academy of Science, Technology and Innovation, and the Vietnam Science and Technology Magazine (specified in the Government’s Decree No. 28/2023/ND-CP of June 2, 2023, defining the functions, tasks, powers and organizational structure of the Ministry of Science and Technology), the National Institute of Information and Communications Strategy, the Information and Communications Public Management Institute, and the Information and Communications Journal (specified in the Government’s Decree No. 48/2022/ND-CP of July 26, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Information and Communications) may continue to operate until the Prime Minister promulgates a decision defining the functions, tasks, powers and organizational structure of the Institute of Science and Technology Strategy. The time limit for implementation is 3 months from the effective date of this Decree.

2. The Authority of Information Security (specified in the Government’s Decree No. 48/2022/ND-CP of July 26, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Information and Communications) may continue to operate to address issues related to finance, state budget, public assets, programs and projects; personnel; and other outstanding matters (if any) for a period not exceeding 3 months from the effective date of this Decree.

3. The VietNamNet newspaper (specified in the Government’s Decree No. 48/2022/ND-CP of July 26, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Information and Communications) may continue to operate until the competent authority approves the transfer of the VietNamNet newspaper to the Ministry of Ethnic and Religious Affairs. The Minister of Science and Technology shall report such in March 2025 to competent authorities for consideration and approval.

Article 5. Effect

1. This Decree takes effect on March 1, 2025.

2. This Decree replaces the Government’s Decree No. 28/2023/ND-CP of June 2, 2023, defining the functions, tasks, powers and organizational structure of the Ministry of Science and Technology, and the Government’s Decree No. 48/2022/ND-CP of July 26, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Information and Communications.

Article 6. Implementation responsibility

Ministers, heads of ministerial-level agencies, heads of government-attached agencies, and chairpersons of provincial-level People’s Committees shall implement this Decree.-
