CIRCULAR
Amending and supplementing a number of provisions of the Minister of Justice’s Circular No. 01/2022/TT-BTP of January 4, 2022, detailing a number of articles of, and providing measures to implement, the Government’s Decree No. 87/2020/ND-CP of July 28, 2020, on the Electronic Civil Status Database and online civil status registration
Pursuant to the November 20, 2014 Law on Civil Status;
Pursuant to the Government’s Decree No. 98/2022/ND-CP of November 29, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Justice;
Pursuant to the Government’s Decree No. 87/2020/ND-CP of July 28, 2020, on the Electronic Civil Status Database and online civil status registration;
Pursuant to the Government’s Decree No. 42/2022/ND-CP of June 24, 2022, on online provision of information and public services by state agencies in the cyber environment;
Pursuant to the Government’s Decree No. 30/2020/ND-CP of March 5, 2020, on clerical work;
Pursuant to the Government’s Decree No. 45/2020/ND-CP of April 8, 2020, on performance of administrative procedures in the electronic environment;
Pursuant to the Government’s Decree No. 47/2020/ND-CP of April 9, 2020, on the management, connection and sharing of digital data of state agencies;
Pursuant to the Government’s Decree No. 61/2018/ND-CP of April 23, 2018, on the implementation of the single-window mechanism and inter-agency single-window mechanism for settlement of administrative procedures; and the Government’s Decree No. 107/2021/ND-CP of December 6, 2021, amending and supplementing a number of articles of the Government’s Decree No. 61/2018/ND-CP of April 23, 2018, on the implementation of the single-window mechanism and inter-agency single-window mechanism for settlement of administrative procedures;
Pursuant to the Government’s Decree No. 13/2023/ND-CP of April 17, 2023, on personal data protection;
At the proposal of the Director of the Civil Status, Citizenship and Notarization Department;
The Minister of Justice promulgates the Circular amending and supplementing a number of provisions of the Minister of Justice’s Circular No. 01/2022/TT-BTP of January 4, 2022, detailing a number of articles of, and providing measures to implement, the Government’s Decree No. 87/2020/ND-CP of July 28, 2020, on the Electronic Civil Status Database and online civil status registration.
Article 1. To amend and supplement a number of provisions of the Minister of Justice’s Circular No. 01/2022/TT-BTP of January 4, 2022, detailing a number of articles of, and providing measures to implement, the Government’s Decree No. 87/2020/ND-CP of July 28, 2020, on the Electronic Civil Status Database and online civil status registration
1. To amend and supplement Clause 1, Article 9 of the Minister of Justice’s Circular No. 01/2022/TT-BTP of January 4, 2022, detailing a number of articles of, and providing measures to implement, the Government’s Decree No. 87/2020/ND-CP of July 28, 2020, on the Electronic Civil Status Database and online civil status registration (below referred to as Circular No. 01/2022/TT-BTP), as follows:
“1. Promulgated together with this Circular are:
a/ Forms of: certification of civil status information; declaration-cum-request for certification of civil status information; and death certificate (Appendix 1);
b/ Interactive and integrated e-civil status forms to serve online civil status registration (Appendix 2);
c/ E-versions of forms of civil status papers (Appendix 3)”.
2. To add or replace the appendices to Circular No. 01/2022/TT-BTP as follows:
a/ To add Appendix 3 to this Circular.
b/ To replace Appendices 1 and 2 to Circular No. 01/2022/TT-BTP with Appendices 1 and 2 to this Circular.
Article 2. Responsibility for organization of implementation and effect
1. This Circular takes effect on August 2, 2023.
2. The dossiers for civil status registration received before the effective date of this Circular but not yet completely processed shall be processed under Circular No. 01/2022/TT-BTP.
3. The Director of the Civil Status, Citizenship and Notarization Department, and heads of units of the Ministry of Justice, directors of provincial-level Departments of Justice and related agencies, organizations and individuals shall implement this Circular.
Provincial-level People’s Committees, provincial-level Departments of Justice and related agencies, organizations and individuals should promptly report any problems arising in the course of implementation of this Circular to the Ministry of Justice for study and guidance.-
