THE PRIME MINISTER

Directive No. 16/CT-TTg dated July 29, 2013 of the Prime Minister on enhancing thrift practice and waste combat in the management, exploitation and use of resources, assets and employees at the State owned enterprises

In recent times, authorities, branches pay attention to thethrift practice and waste combat and achieve some results.

State owned enterprises are currently managing, exploiting and using many resources, capital and assets of State property. However, in some enterprises, the management, exploitation and use of resources are still being wasted especially land and mineral resources; the debt ratio of total debt to total equity dramatically increases. The external investment is still high, but the divestment in external investment is facing difficulties. The selection and use of employees as well as allocation of the management staff is still inconsistent. The wage and reward is not in accordance with the labor productivity and production efficiency of the enterprises.

To face the situations, in order to enhance thrift practice and waste combat in the management, exploitation and use of resources, assets and employees at the State owned enterprises, the Prime Minister requested ministers, heads of ministerial-level agencies, Government-attached agencies, other agencies at the central level, chairman of the Board of Members, chairman of the company, General Director, Director of State economic groups, corporations and enterprises, and authorized representatives based on its functions and tasks shall implement these following tasks:

1. To enhance thrift practice and waste combat in the management, exploitation and use of resources at the State owned enterprises:

a) Review, arrange and handle the land agencies not complying with the regulations under the Decision No. 09/2007/QD-TTg dated January 19, 2007 of the Prime Minister on rand the Decision No.140/2008/QD-TTgdated October 21, 2008 of the Prime Minister on amending and supplementing the Decision No.09/2007/QD-TTg.

b) Tightly control the licensing for the management of exploiting resources and mineral; suspend the operation and retrieve the license for resources and minerals exploitation of enterprises causing the waste or not complying with the requirements on environmental protection in accordance with the law.

2. To enhance thrift practice and waste combat in the management, and use of capital and assets at the State owned enterprises:

a) Review the investment decision, capital contribution decision that must be in accordance with the business scope of the enterprise; avoid the investment spread which causes the waste and capital loss of the State; cut down on and remove the inefficient and unnecessary projects.

b) Make the research on the measures and roadmap to withdraw the capital that is invested in sector that is not in the business scope.

c) Enhance the management, examination and supervision in investment of the investor and the disbursement for projects that are in accordance with the law. Implementing the publicity of management, use of state capital and assets such as: declare the standards, regimes that are promulgated; publicly declare the use of state budget and other financial sources; publicly declare the use of public assets, the planning and list of the investment projects, sources of investment capital

d) Review and supplement the economics and technical norms on consumption of raw material, fuel and material; the norms to exploit and use the machines, equipments; wage unit and other expenses on the basis to ensure the efficiency of business and in accordance with the law. Enterprises that haven’t worked out the norms in this area must promptly work out to implement.

3. To enhance thrift practice and waste combat in the management, and use of employees at the State owned enterprises:

a) Review, amend and supplement the regulations, standards on the recruitment, arrange the employees. Enterprises that are not promulgated the regulations, standards in this area must promptly work out to implement.

b) Review and supplement the output quota, determine the position, title as a basis to recruit, use the employees effectively.  Enterprises that are not promulgated the regulations, standards must promptly work out to implement.

c) Review and re-arrange the management staff and key public servants in the state enterprises and ensure the efficient employment and the number of recruited employees as regulated.

d) the appointment and re-arrangement of the key leaders, managers or appoint the state capital representativesat the enterprises must comply with the standards, conditions, orders, procedures and other requirements as stipulated under the Decree No. 66/2011/ND-CP dated August 01, 2011 of the Government on stipulating the application of the Law on Officers and Civil Servants to the leaders and managers of limited liability one-member companies, which are under ownership of the State, and the representatives to the State capital at the companies having State capital.

dd) Ensure the publicity, democracy in accordance with the regulation on the recruitment, appointment of the employees; the arrangement and appointment of public servants must be based on the requirements and when it is really necessary.

e) Enhance the supervision and examination; handle the cases of violation, terminate the contract for public servants who violate the regulations on thrift practice and waste; handle the cases of paying the salary, reward that is not in accordance with the subjects, labor productivity and business result.

4. Implementation organization

a) State owned economic groups, corporations, enterprises:

- To work out thrift practice and waste combat programs in the management, exploitation and use of resources, assets and employees at the enterprises. The action program must state clearly the objectives, targets, tasks, measures and level of commendation, responsibilities for each individual in each area;

- Quarterly, report the situation of implementation of thrift practice and waste combat programs to the owner and the Ministry of Finance before the 20th of the final month in the quarter.

b) Ministries, ministerial-level agencies, Government-attached agencies, other agencies at the central level, provincial/municipal People s Committees:

- Focus on directing units, organizations, individuals under its management to implement this Directive;

- Quarterly, report the situation and results of implementation of thrift practice and waste combat programs and send them to the Ministry of Finance before the 20th of the final month in the quarter.

c) The Ministry of Finance shall review and supervise the results of implementation of the Directive of ministries, agencies, localities, State owned economic groups, corporations, enterprises; quarterly report to the Prime Minister./.
