DIRECTIVE

ON INTENSIFYING THE ASSURANCE OF SAFETY AND SECURITY FOR POST, TELECOMMUNICATION AND INTERNET INFORMATION IN THE NEW SITUATION

 

In the present situation, the hostile forces are increasingly taking advantage of postal, telecommunication and Internet services, to infringe upon our national security and undermine our social order and safety.

In implementation of the Party Secretariat s Directive No. 26-CTITW of August 18, 2003 on organization of the study, thorough understanding and implementation of the Resolution of the 8th plenum of the Party Central Committee (the IXthCongress) and Action Program No. 44A-CTHD/BCS of October 15, 2003 of the Caucus Commission of the Party organization of the Ministry of Post and Telematics in the implementation of the Resolution of the 8thplenum of the Party Central Committee (the IXthCongress) on the national defense strategy in the new situation; Joint Circular No. 0 11200 1ITTLT- TCBD-BCA of June 7, 2001 of the General Department of Post (now the Ministry of Post and Telematics) and the Ministry of Public Security,. in order to intensify the assurance of information safety and security in service of the State management over the provision and use of postal, telecommunication and Internet services, the use of radio transmitter and receivers nationwide, the Minister of Post and Telematics hereby directs the agencies and units attached to the Ministry of Post an Telematics and postal, telecommunication an Internet enterprises to well perform the following tasks:

1. To strictly observe the legislation on post, telecommunications and Internet; have the responsibility to assure information security in postal, telecommunication and internet activities; to comply with the requirements of the Ministry of Post and Telematics, the Ministry of Public Security and competent State bodies on assurance of network safety and information security according to law provisions and

2. Postal, telecommunication and internet enterprises shall coordinate with the local police in drawing up action plans to cope with violent incidents and riots undermining social safety and order or infringing upon national security:

a/ To ensure information and communication in service of the direction of the Party and State agencies and armed forces according to law provisions when violent incidents or riots break out;

b/ To organize the guard forces, procure equipment to safeguard the postal and telecommunication networks and works under their management; not to take advantage of, or let other persons take advantage of, the subscriber networks and equipment and log-in passwords to cause interference to, and disrupt, their equipment, to infringe upon national security or undermine social safety and order;

c/ To coordinate with the professional units of the Ministry of Public Security in urgently stopping the provision of services in cases of provoking violence or riots, using postal, telecommunication and Internet services to infringe upon national security and opposing the State of the Socialist Republic of Vietnam.

3. Postal, telecommunication and internet enterprises shall intensify examination and close supervision of activities of internet and telecommunication service agents; propagate and guide the agents’ owners to firmly grasp the State s regulations on assurance of information safety and security and to strictly observe the regulations on provision of postal, telecommunication and internet services; to supply fully data as requested so that the police agencies take necessary measures to protect national security and social safety and order.

4. The Planning and Finance Department shall study and establish a mechanism for exemption and reduction of charges to support the professional units of the Ministry of Public Security when using the postal, telecommunication and internet networks and services upon the breaking out of violent incidents or riots undermining social safety and order or infringing upon national security.

5. The units attached to the Ministry and the postal, telecommunication and internet enterprises shall have to assist in the professional training and send technically capable staff to work with the relevant professional units of the Ministry of Public Security in studying technical solutions to satisfy the requirements on assurance of safety and security for information on telecommunications network and on the Internet.

The heads of the agencies and units attached to the Ministry of Post and Telematics, postal, telecommunication and Internet enterprises shall have to organize the implementation of this Directive and report the implementation results to the Ministry of Post and Telematics (the Telecommunications Department); in the course of implementation if they face any problems, they should report them to the Ministry of Post and Telematics for consideration and settlement.

The Telecommunications Department and the Post Department shall have to examine and urge the implementation of this Directive and report thereon to the Minister.
