Decree 83/2026/ND-CP amend Decree 06/2022/ND-CP mitigation of greenhouse gas emissions and protection of the ozone layer

DECREE

Amending and supplementing a number of articles of the Government's Decree No. 06/2022/ND-CP dated January 07, 2022, providing the mitigation of greenhouse gas emissions and protection of the ozone layer, as amended and supplemented under the Government's Decree No. 119/2025/ND-CP dated June 09, 2025

Pursuant to the Law on Organization of the Government No. 63/2025/QH15;

Pursuant to Law on Environmental Protection No. 72/2020/QH14, amended and supplemented under Law No. 11/2022/QH15, Law No. 16/2023/QH15, Law No. 18/2023/QH15, Law No. 47/2024/QH15, Law No. 54/2024/QH15 and Law No. 146/2025/QH15;

Pursuant to the Government's Resolution No. 66.7/2025/NQ-CP providing for the reduction and simplification of administrative procedures based on data;

At the proposal of Minister of Agriculture and Environment;

The Government hereby promulgates the Decree amending and supplementing a number of articles of the Government's Decree No. 06/2022/ND-CP dated January 07, 2022, providing the mitigation of greenhouse gas emissions and protection of the ozone layer, as amended and supplemented under the Government's Decree No. 119/2025/ND-CP dated June 09, 2025.

Article 1. Amending and supplementing a number of clauses of Article 24

1. To amend and supplement Clause 3 as follows:

“3. A registration dossier comprises:

a) Application for registration for the use of controlled substances, made according to Form No. 01 in Appendix VI to this Decree: 01 original;

b) Document evidencing the legal status of the registering organization in accordance with the law on enterprises, the law on investment or relevant laws: 01 certified copy bearing the certification and true copy seal of the registering organization or an electronic copy from the original register or a certified electronic copy from the original, except in case where such information can be extracted from the National Database on Enterprise Registration or other specialized databases.

In case where information of the registering organization cannot be extracted or can be extracted but is incomplete or inaccurate from the aforementioned databases, the Ministry of Agriculture and Environment shall request the organization to additionally provide a certified copy bearing the certification and true copy seal of the registering organization or an electronic copy from the original register or a certified electronic copy from the original of the document specified at this Point.”.

2. To amend and supplement Clause 4 as follows:

“4. Within 02 working days from the date of receipt of the registration dossier, the Ministry of Agriculture and Environment shall notify the registering organization of the acceptance of a valid dossier or request supplementation and completion of the dossier. The time limit for supplementation and completion of the registration dossier shall not exceed 05 working days from the date of issuance of the notification requesting supplementation and completion of the dossier.”.

3. To amend and supplement Clause 5 as follows:

“5. Within 05 working days from the date of receipt of a valid registration dossier, the Ministry of Agriculture and Environment shall synthesize and evaluate the registration dossier and disclose information on organizations that have completed registration for the use of controlled substances on the administrative procedures information system and the portal of the Ministry of Agriculture and Environment.”.

Article 2. Amending and supplementing a number of clauses of Article 26

1. To amend and supplement Clause 2 as follows:

“2. Based on the provisions of Article 24 and Article 25 of this Decree, within 22 working days, the Ministry of Agriculture and Environment shall consider and decide on the allocation of production and import quotas to organizations in accordance with Form No. 03A in Appendix VI to this Decree through the following activities:

a) Reviewing and evaluating registration information and reports on the use of controlled substances of the organization;

b) Comparing the total national consumption with the objectives and management requirements for controlled substances;

c) Conducting on-site inspections to verify registration information and assess capacity dossiers, technical capacity and production technology where necessary;

d) Obtaining written opinions from the Ministry of Industry and Trade on the proposed quota allocation. The time limit for providing opinions by the Ministry of Industry and Trade shall not exceed 07 working days from the date of receipt of the written request for opinions. Upon the expiry of the above time limit without any written response from the consulted agency, such agency shall be deemed to have agreed with the contents of the dossier.”.

2. To amend and supplement Clause 3 as follows:

“3. Organizations having demand for adjustment or supplementation of production and import quotas of controlled substances shall submit an application made according to Form No. 04 in Appendix VI to this Decree to the Ministry of Agriculture and Environment either directly, online or via postal services for consideration and adjustment or supplementation before July 10 each year. The adjustment and supplementation of quotas shall be carried out in accordance with the procedures for quota allocation. The Ministry of Agriculture and Environment shall consider and decide on the adjustment and supplementation of production and import quotas within 22 working days in accordance with Form No. 03B in Appendix VI to this Decree.”.

3. To amend and supplement Clause 4 as follows:

“4. Within 02 working days, the specialized agency in charge of climate change management shall notify the allocation, adjustment or supplementation of production and import quotas of controlled substances to the registering organization on the administrative procedures information system in accordance with Form No. 05A and Form No. 05B in Appendix VI to this Decree.”.

Article 3. Replacing a number of forms in Appendix VI

1. To replace Form No. 01.

2. To replace Form No. 02.

3. To replace Form No. 04.

Article 4. Effect

1. This Decree takes effect from the date of its signing for promulgation.

2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of People’s Committees at all levels, and related organizations and individuals shall implement this Decree.

Article 5. Transitional provisions

Valid dossiers of registration or request for allocation, adjustment or supplementation of production and import quotas of controlled substances under Clause 3 and Clause 6 Article 24 and Clause 3 Article 26 of the Government's Decree No. 06/2022/ND-CP dated January 07, 2022, providing the mitigation of greenhouse gas emissions and protection of the ozone layer, as amended and supplemented under the Government's Decree No. 119/2025/ND-CP dated June 09, 2025, which have been received by the Ministry of Agriculture and Environment before the effective date of this Decree, are not required to be resubmitted and shall continue to be processed in accordance with this Decree.

In case dossiers were submitted to the Ministry of Agriculture and Environment before the effective date of this Decree but are requested to be supplemented and completed, such supplementation and completion shall be carried out in accordance with the Government's Decree No. 06/2022/ND-CP dated January 07, 2022, providing the mitigation of greenhouse gas emissions and protection of the ozone layer, as amended and supplemented under the Government's Decree No. 119/2025/ND-CP dated June 09, 2025; subsequent order and procedures shall be carried out in accordance with this Decree”.
