DECREE
PRESCRIBING THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF VIETNAM TELEVISION STATION
THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decree No. 30/2003/ND-CP dated April 1, 2003 of the Government prescribing the functions, tasks, powers and organizational structures of the Government-attached agencies;
At the proposals of the General Director of Vietnam Television Station and the Minister of the Interior,
DECREES:
Article 1. Position and functions
Vietnam Television Station is a Government-attached national television station which performs the function of informing and propagating the Party's guidelines and policies as well as the State's laws; contributes to educating people, and raising their intellectual standards and serving their spiritual life through television programs; performs a number of specific tasks and exercises a number of specific powers of the representative of the owner of State capital portions at the State-invested enterprises under Vietnam Television Station according to law provisions.
Vietnam Television Station is subject to the State management over press activities by the Ministry of Culture and Information and the State management over television-wave transmission and broadcasting by the Ministry of Post and Telematics.
Article 2. Tasks and powers
Vietnam Television Station has the responsibility to perform the tasks and exercise the powers of a Government-attached agency engaged in non-business activities as prescribed in the Government's Decree No. 30/2003/ND-CP dated April 1, 2003 defining the functions, tasks, powers and organizational structures of the Government-attached agencies as well as the following specific tasks and powers:
1. To submit to the Government or the Prime Minister its strategies, plannings, long-term, five-year and annual plans as well as important projects; to organize the implementation of such strategies, plannings and plans after they are approved;
2. To submit to the Prime Minister for decision the mechanism on autonomy and self-responsibility for its organizational apparatus, payroll and finance.
3. To participate in drawing up strategies and plannings on development of Vietnam's television system.
4. To assume the prime responsibility and coordinate with local television stations and radio-television stations in working out plans for production of national television programs.
5. To decide on its daily broadcasting programs and time volume therefor.
6. To provide local television stations with guidance on television operations and techniques.
7. To directly manage its special-use technical system for the production of programs, the transmission of signals and the broadcasting of national television programs at home and abroad.
8. To submit to the minister assigned by the Prime Minister to sign for promulgation the legal documents on professional standards and processes as well as econo-technical norms, the regulations on the uniform management of television techniques to be applied nationwide.
9. To manage investment and construction projects under its competence according to law provisions; to participate in evaluating important schemes and projects within its professional operations at the request of the Government or the Prime Minister.
10. To decide on, and direct the implementation of, its administrative reform program according to the objectives and contents of the State's administrative reform program already approved by the Prime Minister.
11. To provide professional training and fostering on television specialization.
12. To conduct scientific research and the application of television scientific and technological advances.
13. To enter into international cooperation on television according to law provisions.
14. To organize business and service activities according to law provisions.
15. To perform a number of specific tasks and exercise a number of specific powers of the representative of the owner of State capital portions at the State-invested enterprises under Vietnam Television Station according to law provisions;
16. To manage its organizational apparatus and payroll; direct the implementation of wage regime as well as preferential treatment, commendation and discipline regimes and policies for State officials and public employees as well as laborers under its management;
17. To manage the assigned finance and assets, and organize the implementation of budget allocations and revenue amounts according to law provisions.
18. To abide by the regime of reporting to the Government, the Prime Minister and competent Party and State agencies according to law provisions.
Article 3. Organizational structure of Vietnam Television Station
a) Organizations assisting the General Director:
1. The Editorial Secretariat;
2. The Organizational and Personnel Department;
3. The Planning-Finance Department;
4. The International Cooperation Department;
5. The Inspectorate;
6. The Office.
b) Program-producing organizations:
1. The News Department;
2. The Science and Education Department;
3. The Department for Special Subjects;
4. The Department for Television Broadcast in Ethnic Minority Languages;
5. The Television for Foreign Service Department;
6. The Literature and Arts Department;
7. The Sports-Recreation-Economic Information Department;
8. The Cable Television Editorial Department;
9. Vietnam Television Station's Center in Ho Chi Minh city;
10. Vietnam Television Station's Center in Hue city;
11. Vietnam Television Station's Center in Da Nang city;
12. Vietnam Television Station's Center in Phu Yen province;
13. Vietnam Television Station's Center in Can Tho city;
14. The Technical Center for Program Production;
15. The Technical Center for Wave Transmission and Broadcasting;
16. The Center for Television Film Production.
c) Other organizations;
1. The Center for Television Scientific and Technical Research and Application;
2. The Television Operations Training and Fostering Center;
3. The Television Advertisement and Service Center;
4. The Informatics and Metrology Center.
The setting up of Vietnam Television Station's foreign-based resident offices shall be decided by the General Director of Vietnam Television Station after it is permitted by the Prime Minister.
Vietnam Television Station's General Director is assigned to organize and arrange other existing non-business units according to law provisions.
Article 4. Implementation effect
This Decree takes implementation effect 15 days after its publication in the Official Gazette and replaces the Government's Decree No. 52/CP dated August 16, 1993 on the functions, tasks, powers and organizational apparatus of Vietnam Television Station.
Article 5. Implementation responsibilities
The General Director of Vietnam Television Station, the ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government and the presidents of the People's Committees of the provinces and centrally-run cities shall have to implement this Decree.
