Decree No. 77/2013/ND-CP of July 17, 2013, detailing the Law on Prevention and Control of Tobacco Harms regarding measures for prevention and control of tobacco harms

Pursuant to the December 25, 2001 Law on Organization of the Government;

Pursuant to the June 18, 2012 Law on Prevention and Control of Tobacco Harms;

At the proposal of the Minister of Health,

The Government promulgates the Decree detailing the Law on Prevention and Control of Tobacco Harms regarding measures for prevention and control of tobacco harms.

Chapter I

GENERAL PROVISIONS

Article 1. Scope of regulation

This Decree details Clause 4 of Article 12, Clause 7 of Article 15, and Clauses 2 and 4 of Article 17, of the Law on Prevention and Control of Tobacco Harms on conditions for establishment and organization of tobacco use cessation and tobacco use cessation counseling activities, change of no-smoking indoor places with separate smoking areas into completely smoke-free indoor places, and increase of the area for printing health warnings on tobacco packages.

Article 2. Interpretation of terms

1. Tobacco use cessation means taking measures to help tobacco users quit tobacco use.

2. Tobacco use cessation counseling means providing information for tobacco users to make decision and voluntarily quit tobacco use.

Chapter II

CONDITIONS FOR ESTABLISHMENT AND ORGANIZATION OF TOBACCO USE CESSATION AND TOBACCO USE CESSATION CONSELING ACTIVITIES

Article 3. Forms of organizing tobacco use cessation and tobacco use cessation counseling activities

1. Agencies, organizations and individuals establish tobacco use cessation establishments and tobacco use cessation counseling establishments in accordance with this Decree.

2. Medical examination and treatment establishments organize tobacco use cessation and tobacco use cessation counseling activities.

Article 4. Conditions for setting up a tobacco use cessation establishment

1. Having an establishment decision issued by a competent state agency, for state establishments, or a business registration certificate issued by a competent state agency, for private establishments.

2. Having sufficient physical foundations for tobacco use cessation and tobacco use cessation counseling activities:

a/ Having communication materials on tobacco use cessation and tobacco use cessation counseling, including books, posters, leaflets, tapes and discs providing information on tobacco use cessation and tobacco use cessation counseling;

b/ Managing information and data on tobacco use cessation and tobacco use cessation counseling on computers;

c/ Having separate rooms for tobacco use cessation and tobacco use cessation counseling with a minimum area of 10 m²; having sufficient equipment for tobacco use cessation and tobacco use cessation counseling activities.

3. Having persons directly conducting tobacco use cessation activities who fully meet the following conditions:

a/ Having a practice certificate of medical examination and treatment;

b/ Strictly following the tobacco use cessation process.

4. Having persons directly counseling tobacco use cessation who have knowledge and understanding about tobacco harms to health, tobacco-related diseases and the tobacco use cessation counseling contents specified in Clause 3, Article 8 of this Decree.
