DECREE
PRESCRIBING RESPONSIBILITIES OF MINISTRIES, SECTORS AND PEOPLE S COMMITTEES AT ALL LEVELS FOR ENSURING THE PARTICIPATION IN THE STATE MANAGEMENT BY THE VIETNAM WOMEN S UNION AT ALL LEVELS
Pursuant to the December 25, 2001 Law on Organization of the Government;
Pursuant to the November 29, 2006 Law on Gender Equity;
At the proposal of the Minister of Home Affairs;
The Government issues this Decree prescribing responsibilities of ministries, sectors and People s Committees at all levels for ensuring the participation in the state management by the Vietnam Women s Union at all levels,
Article 1. Scope of regulation, subjects of application
This Decree prescribes the responsibilities of ministries, ministerial-level agencies and government-attached agencies (below referred to as ministries and sectors); People s Committees of provinces and centrally run cities, People s Committees of suburban districts, districts, towns, and provincial cities; People s Committees of communes, wards and townships (below referred to as People s Committees at all levels) for ensuring the participation in the state management under legal regulations by the Vietnam Women s Union, Women s Unions of provinces and centrally run cities, Women s Unions of suburban districts, districts, towns, and provincial-level cities, and Women s Unions of communes, wards and townships (below referred to as Women s Unions at all levels).
Article 2. Principles of coordination
1. The work relation between ministries and sectors and the Vietnam Women s Union; between People s Committees of a level and Women s Unions of the same level is coordination in facilitating the proper performance of the functions, tasks and powers of each agency under legal regulations.
2. Ministries, sectors and People s Committees at a level shall create favorable conditions in terms of funding and facilities for Women s Unions of the same level to participate in the state management and implement related activities.
Article 3. Responsibilities of ministries and sectors
1. To invite the Vietnam Women s Union:
a/ To join the elaboration of mechanisms, policies, legal documents, programs, projects and plans related to the rights and interests of women and children; and economic, cultural and social activities under the state management of ministries and sectors under law;
b/ To join the propagation, dissemination and education of policies and laws;
c/ To join the examination and supervision of the implementation of laws on women and children, prevention and control of domestic violence, and gender equity in related fields.
2. To create conditions for the Vietnam Women s Union to fulfill other tasks under the Law on Gender Equity.
3. In addition to Clauses 1 and 2 of this Article, the Ministries of Public Security and National Defense shall provide support in terms of funds, working conditions and facilities, and fund raising activities and support female cadres, civil servants and public employees in settling social issues related to women s advancement and equity in accordance with the state s law and policies.
Article 4. Responsibilities of People s Committees at all levels
1. To invite Women s Unions of the same levels:
a/ To join the elaboration, amendment and supplementation of mechanisms, policies, programs and plans on socio-economic development and social order and safety related to the rights and interests of women, children and gender equity under law;
b/ To coordinate with specialized agencies under People s Committees in propagating, disseminating and educating policies and laws;
c/ To join as official members of consultative organizations (Councils, Committees, Steering Committees, etc.) related to women, children and gender equity;
d/To join teams inspecting and supervising matters related to the rights and interests of women and children, gender equity, prevention and control of domestic violence, and related fields under law.
2. To coordinate with Women s Unions of the same levels in organizing meetings to gather opinions on the implementation of undertakings, laws and policies; studying, considering and promptly handling acts of infringing upon the rights and lawful and legitimate interests of women and children, and other matters under law.
3. To create favorable conditions for activities of Women s Unions of the same levels, such as supporting funds and working conditions and facilities, fund raising for the Union, organizing production and service activities, and supporting women in settling social issues related to women s advancement and equity in accordance with the state s law and policies.
Article 5. Responsibilities of the Ministry of Home Affairs, the Vietnam Women s Union and Women s Unions at all levels.
1. The Ministry of Home Affairs shall:
a/ Guide, monitor, and supervise ministries, sectors and People s Committees at all levels in fulfilling the responsibilities specified in Articles 3 and 4 of this Decree;
b/ Assume the prime responsibility for, and coordinate with the Vietnam Women s Union in, examining, inspecting and supervising the implementation of this Decree.
2. The Vietnam Women s Union and Women s Unions at all levels:
a/ Send representatives to participate in the state management;
b/ Proactively study and propose measures and policies related to the rights and lawful and legitimate interests of women, children, family and gender equity; and promptly provide information related to women, children and gender equity;
c/ Closely coordinate with ministries, sectors and People s Committees at all levels in fulfilling the responsibilities under the Law on Gender Equity;
d/ Observe the law on rights and responsibilities of Women s Unions at all levels;
e/ Guide and support Women s Unions at all levels in implementing this Decree.
Article 6. Organization of implementation 1. Working schedules:
a/ Biannually, People s Committees of communes and suburban districts shall work with Women s Unions of the same levels to review and assess the implementation of regimes and policies and the latter s proposals related to the rights and interests of women, children and other matters under law;
b/ Annually, leaders of provincial-level People s Committees shall work with the Standing Committees of Women s Unions of the same levels to review and assess the implementation of mechanisms and policies and the latter s proposals related to the rights and interests of women, children and other matters under law;
c/ Annually, the Ministry of Home Affairs shall assume the prime responsibility for, and coordinate with the Government Office in, including in the regular working schedule between the Prime Minister and the Presidium of the Vietnam Women s Union the assessment of the fulfillment of responsibilities of ministries, sectors and People s Committees at all levels for ensuring the participation in the state management by Women s Unions at all levels.
2. Preliminary and final reviews:
a/ At the communal level, People s Committees of communes shall annually assume the prime responsibility for, and coordinate with the Women s Unions of the same level in, assessing the implementation of this Decree, and send reports to district-level People s Committees for summarization and assessment and submission to provincial-level People s Committees;
b/ At the ministerial and provincial levels, ministries, sectors and provincial-level People s Committees shall conduct preliminary reviews every two years and send reports to the Ministry of Home Affairs;
c/ Every five years, the Ministry of Home Affairs shall assume the prime responsibility for, and coordinate with the Vietnam Women s Union in, conducting a national review.
Article 7. Effect
1. This Decree takes effect on September 5, 2012.
2. This Decree replaces the Government s Decree No. 19/2003/ND-CP of March 7,2003
3. Prescribing responsibilities of state administrative agencies at all levels for ensuring the participation in the state management by the Vietnam Women s Union at all levels.
Article 8. Implementation responsibilities
Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People s Committees, Women s Unions at all levels and related organizations shall implement this Decree.-
