On October 14, 2026, the Government issued Decree No. 389/2026/ND-CP on sanctioning of administrative violations in lottery business, effective from November 30, 2026.

This Decree applies to Vietnamese and foreign individuals and organizations committing administrative violations in the field of lottery business. Subjects to be sanctioned include lottery enterprises, lottery agents, and related organizations.

- Forms of sanction and remedial measures

The Decree prescribes two main forms of sanction: warning and fine. Additional sanctions include temporary suspension of lottery business activities and confiscation of violating materials and means. Remedial measures may include the requirement to return altered business certificates, annul incorrect winning results, and return illegal profits.

- Fine levels

The maximum fine for organizations is 200,000,000 VND, while the fine for individuals is 100,000,000 VND. The  fine for individuals is half of that for organizations for the same violation.

- Statute of limitations for sanctions and transfer of violation dossiers

The statute of limitations for administrative sanctions in the field of lottery business is implemented according to the Law on Handling of Administrative Violations. If the violation shows signs of a crime, the dossier will be transferred to the criminal procedure authorities for criminal prosecution.

- Authority to impose sanctions

The Director of the Department of Finance, the Head of the inspection team established by the Minister of Finance, and the Heads of organizations under the Ministry of Finance may issue warnings, impose fines, temporarily suspend lottery business activities, and confiscate violating materials and means. The Chairpersons of the People's Committees and the People's Police also have the competence to impose sanctions within their management scope.

This Decree replaces previous regulations on administrative sanctions in the field of lottery business, aiming to ensure transparency and efficiency in managing lottery business activities.
