DECREE

Providing for the prevention and combat of fake news and false information

 

Pursuant to the Law on Organization of the Government No. 63/2025/QH15, which is amended and supplemented by Law No. 137/2025/QH15;

Pursuant to the Law on Organization of Local Administration No. 72/2025/QH15;

Pursuant to the Law on National Security No. 32/2004/QH11, which is amended and supplemented by Law No. 30/2023/QH15;

Pursuant to the Law on Cybersecurity No. 116/2025/QH15;

Pursuant to the Law on Handling of Administrative Violations No. 15/2012/QH13, which is amended and supplemented by Law No. 54/2014/QH13; Law No. 18/2017/QH14; Law No. 67/2020/QH14; Law No. 09/2022/QH15; Law No. 11/2022/QH15; Law No. 56/2024/QH15; and Law No. 88/2025/QH15;

Pursuant to the Law on Artificial Intelligence No. 134/2025/QH15;

Pursuant to the Law on State of Emergency No. 104/2025/QH15;

At the proposal of the Minister of Public Security;

The Government promulgates the Decree providing for the prevention and combat of fake news and false information.

 

Chapter I

GENERAL PROVISIONS

 

Article 1. Scope of regulation

1. Classification of fake news and false information, principles, state management, and international cooperation in the prevention and combat of fake news and false information.

2. Procedures for handling fake news and false information; and a number of measures for preventing and combating fake news and false information.

3. Powers and responsibilities of ministries, ministerial-level agencies, People’s Committees at all levels, and related organizations and individuals in the prevention and combat of fake news and false information.

Article 2. Subjects of application

1. Vietnamese agencies, organizations and individuals.

2. Persons of Vietnamese origin whose nationality has not yet been determined and who are living in Vietnam.

3. International organizations and foreign organizations operating in Vietnam, and foreigners residing in Vietnam; organizations and enterprises providing telecommunications services, Internet services, social networks and cross-border information that operate in the territory of Vietnam or provide services to Vietnamese organizations and individuals.

4. Foreign agencies, organizations and individuals involved in violations of the law on fake news and false information that affect the lawful rights and interests of individuals, organizations or the Socialist Republic of Vietnam, unless otherwise provided by a treaty to which the Socialist Republic of Vietnam is a contracting party.

Article 3. Interpretation of terms

1. Fake news and false information means information that is untrue or only partly true and infringes upon national security, reputation or image, social order and safety, or the lawful rights and interests of individuals or organizations, including the following types of information: fake information, false information, misleading information, forged information, fabricated information, defamatory information and distorted information.

2. Information showing signs of being fake or false means information that may be fake news or false information.

3. Publicizing fake news and false information means making public information confirming news or information as fake news or false information, and the identities of individuals and organizations that state, create, store, possess, post, disseminate, share or comment on fake news or false information.

4. Labelling fake news and false information means the marking or display by a competent agency of a warning in the form of a sign, symbol or the words “FAKE NEWS, FALSE INFORMATION” in respect of the information concerned.

5. Prevention and combat of fake news and false information means the aggregate of activities carried out by competent state agencies to prevent, detect, combat, block, remove, inspect and handle fake news and false information; in combination with the exercise by organizations and individuals of their rights and responsibilities to supervise, denounce and provide support in accordance with law.

6. Victim of fake news or false information means an individual whose honour, dignity, reputation, property or other lawful rights and interests are harmed by fake news or false information.

7. Organization affected by fake news or false information means an organization that is harmed by fake news or false information.

Article 4. Classification of fake news and false information

1. Classification by degree of danger includes:

a) Fake news and false information that causes or risks causing particularly serious consequences, including information that has large-scale adverse impacts on national security, national defence, external relations, or social order and safety; infringes upon the reputation of the Party or the State; upon the reputation and honour of senior leaders of the Party or the State; or is capable of causing a media crisis, inciting riots or causing profound public anxiety;

b) Dangerous fake news and false information, including information that has impacts within a limited scope and directly infringes upon the reputation, honour, dignity, or lawful rights and interests of a specific agency, organization or individual.

2. Classification under the law on access to information includes:

a) Fake news and false information containing information to which citizens may not have access;

b) Fake news and false information containing information to which citizens may have access under certain conditions;

c) Fake news and false information containing information to which citizens may have access.

Article 5. Principles of preventing and combating fake news and false information

1. Complying with law; respecting and guaranteeing the lawful rights and interests of agencies, organizations and individuals.

2. Proactively preventing; promptly detecting and stopping, and strictly handling all violations of the law on fake news and false information.

3. Ensuring publicity and transparency.

4. Ensuring the interests of the country and the nation, national defence, security and external relations.

5. The procedures for handling fake news and false information specified in this Decree do not apply to fake news and false information in the following cases:

a) Fake news and false information currently under investigation or adjudication;

b) Fake news and false information on which a competent agency has issued a conclusion or which has previously been publicized;

c) Fake news and false information currently being handled by competent agencies in accordance with other laws.

6. Ensuring coordinated and close cooperation among ministries, sectors, localities, and organizations and enterprises providing services on the network.

Article 6. State management of the prevention and combat of fake news and false information

1. Formulating and improving legal documents on the prevention and combat of fake news and false information.

2. Organizing, directing and guiding the implementation of measures for preventing and combating fake news and false information.

3. Developing contents and organizing public communication and dissemination of the law on the prevention and combat of fake news and false information.

4. Conducting examination and inspection, and settling complaints and denunciations concerning the handling of fake news and false information.

5. Conducting international cooperation in the prevention and combat of fake news and false information.

Article 7. International cooperation in the prevention and combat of fake news and false information

1. Establishing international cooperation mechanisms with foreign countries, organizations and enterprises for the effective enforcement of Vietnam’s law on the prevention and combat of fake news and false information.

2. Participating in mutual legal assistance with other countries concerning the prevention and combat of fake news and false information in accordance with the law on mutual legal assistance.

3. Conducting international cooperation in preventing and combating fake news and false information; requiring enterprises providing telecommunications services, enterprises providing Internet services, organizations and enterprises providing social networks, and cross-border information that operate in the territory of Vietnam or provide services to Vietnamese organizations and individuals to comply with Vietnam’s law on the prevention and combat of fake news and false information.

4. Training human resources, conducting scientific research, applying science and technology, and transferring technologies for the prevention and combat of fake news and false information.

5. Exchanging experience in formulating and implementing laws on the prevention and combat of fake news and false information.

 

Chapter II

MEASURES FOR PREVENTING AND COMBATING FAKE NEWS AND FALSE INFORMATION

 

Article 8. Procedures for handling fake news and false information

1. Detecting information showing signs of being fake or false:

a) Detecting through reports and denunciations of fake news and false information by individuals, agencies and organizations;

b) Detecting through the monitoring, review and control of information in the prevention and combat of fake news and false information by competent functional agencies;

c) Detecting through reviews and warnings by enterprises providing Internet services, organizations and enterprises providing social networks, cross-border information services operating in the territory of Vietnam;

d) Detecting when ministries, ministerial-level agencies or People’s Committees at all levels forward requests to competent functional agencies for fact-checking, verification and clarification of fake news and false information;

dd) Detecting through requests for fact-checking, verification and clarification made by victims or organizations affected by information showing signs of being fake or false.

2. Fact-checking, verifying and clarifying information showing signs of being fake or false.

3. Labelling fake news and false information: After information is concluded to constitute fake news or false information, the unit directly conducting the fact-checking shall label it as fake news or false information.

4. Publicizing and warning about fake news and false information: Agencies and units directly fact-checking, verifying and clarifying fake news and false information shall publicize and warn about the information in compliance with the law on access to information.

5. Blocking and removing fake news and false information.

6. Applying handling measures.

Article 9. Fact-checking, verification and clarification of fake news and false information

1. Competent functional agencies with the authority to fact-check, verify and clarify fake news and false information include ministries, ministerial-level agencies and People’s Committees at all levels, which shall fact-check information showing signs of being fake or false in accordance with Articles 17, 18, 19, 20 and 21 of this Decree. If, during fact-checking, information shows signs of a crime, the information and case shall be transferred to a competent procedure-conducting agency in accordance with the current Criminal Procedure Code and Law on Organization of Criminal Investigation Bodies.

2. Fact-checking, verifying and clarifying information showing signs of being fake or false:

a) Classifying fake news and false information: The agency detecting or receiving the information shall classify information under Clauses 1 and 2, Article 4 of this Decree for fact-checking or transfer it to competent functional agencies or units in accordance with Articles 17, 18, 19, 20 and 21 of this Decree. Competent functional agencies shall prioritize the fact-checking, verification and clarification of information specified at Point a, Clause 1, Article 4 of this Decree after classification;

b) Verifying information showing signs of being fake or false:

To determine the identities of individuals and organizations that state, create, store, possess, provide, post, disseminate, share or comment on fake news or false information. Where ministries, ministerial-level agencies or People’s Committees at all levels are unable to determine the identities, they shall coordinate with the Ministry of Public Security in determining the identities of individuals and organizations that state, create, store, possess, provide, post, disseminate, share or comment on fake news or false information;

During verification if signs of a crime are detected, the case shall be transferred to a competent procedure-conducting agency in accordance with the current Criminal Procedure Code and Law on Organization of Criminal Investigation Bodies;

c) Conclusion of the fact-checking of information showing signs of being fake or false: Authenticating the information as fake news or false information; information that is not fake news or false information; or information for which conditions for authentication are unavailable;

d) Conclusion on the individuals and organizations that state, create, store, possess, provide, post, disseminate, share or comment on fake news or false information, and the severity of their violations.

3. The status of information during fact-checking, verifying and clarifying fake news and false information shall be displayed as follows:

a) During the fact-checking, verification and clarification of fake news and false information, the agency or unit directly conducting fact-checking, verification and clarification shall display the status “Under handling” on portal of the agency or unit directly conducting fact-checking;

b) Upon completion of the fact-checking, verification and clarification of fake news and false information, the agency conducting shall display the status “Handling completed” on the portal of the agency or unit directly conducting the fact-checking.

Article 10. Labelling fake news and false information

1. Agencies and units directly fact-checking, verifying and clarifying fake news and false information shall label fake news and false information, except information specified at Point a, Clause 2, Article 4 of this Decree and information otherwise provided by relevant laws.

2. Cases of labelling fake news and false information include:

a) Information authenticated as fake news or false information specified at Point c, Clause 2, Article 4 of this Decree;

b) Information authenticated as fake news or false information specified at Point b, Clause 2, Article 4 of this Decree, in compliance with the law on access to information;

c) Fake news and false information generated by an artificial intelligence system that has not yet been labelled as fake news or false information.

3. The form of labelling fake news and false information is marking or displaying a warning using a sign or an icon, or displaying the words “FAKE NEWS, FALSE INFORMATION” with respect to information authenticated as fake news or false information.

4. The labelling process consists of the following steps:

a) Within 24 hours from the time a competent functional agency conducting the fact-checking, verification and clarification of fake news and false information concludes that the information is fake news or false information, the information shall be labelled;

b) After fake news or false information is labelled, the competent functional agency shall request enterprises providing Internet services, enterprises providing telecommunications services, organizations and enterprises providing social networks, and organizations and enterprises providing cross-border information that operate in the territory of Vietnam or provide services to Vietnamese organizations and individuals to review the labelled information against similar information appearing on their platforms to block, remove or issue warnings;

c) For fake news and false information which, after being authenticated as fake news or false information, fall within Point a, Clause 2, Article 4 of this Decree, no labelling shall be carried out, however, where a competent functional agency considers it necessary to remove or block the information to protect the common interests of the community, the interests of the State, security, national defence or external relations, it shall request enterprises providing Internet services, enterprises providing telecommunications services, and organizations and enterprises providing social networks or cross-border information to remove or block the information and not permit the posting, sharing or dissemination of the information.

5. A label shall be removed in the following cases:

a) A competent functional agency issues a conclusion affirming that the label was incorrectly applied;

b) The labelled information, at the time of review, no longer constitutes fake news or false information;

c) The labelled information, through inspection or examination, is determined to have been incorrectly labelled.

Article 11. Publicizing and warning about fake news and false information

1. Publicizing and warning about fake news and false information shall be carried out after the fact-checking, verification and clarification of the fake news and false information and the authentication of the information as fake news or false information.

2. Contents to be publicized and warned about include:

a) Publicizing and warning that information constitutes fake news or false information after it has been labelled as fake news or false information, for information specified at Point c, Clause 2, Article 4 of this Decree. For information specified at Point b, Clause 2, Article 4 of this Decree, its publicization must comply with the law on access to information;

b) Cases in which information is not publicized but a warning is issued for individuals and organizations to exercise caution or refrain from using, posting or disseminating information include:

Where it is concluded that there are insufficient conditions for authenticating the information;

Where the information is authenticated as fake news or false information specified at Point b, Clause 2, Article 4 of this Decree;

c) There shall be no publicization of or warning about fake news and false information falling within Point a, Clause 2, Article 4 of this Decree, but blocking and removal measures shall be applied to the fake news and false information;

d) The publicization of the identities of individuals and organizations that state, create, store, retain, provide, post, disseminate, share or comment on fake news or false information, after a conclusion on the fact-checking, verification and clarification of fake news or false information is issued, must comply with the law on access to information, unless otherwise provided by relevant laws.

3. Competent functional agencies, based on the nature, severity and harmful consequences of fake news and false information, shall publicize and warn about fake news and false information in the following forms:

a) Sending to the residential community where the individual or organization states, creates, stores, retains, posts, disseminates, shares or comments on fake news or false information, and to the residential community affected by such fake news or false information, for publicization and warning;

b) Sending to the agency or organization where the individual works, and to the agency or organization affected by fake news or false information, for publicization and warning;

c) Publicizing and warning about fake news and false information on the public website, portal or application of the agency or unit;

d) Publicizing and warning on the portal of the competent functional agency directly conducting the fact-checking;

dd) Publicizing and warning in the mass media;

e) Making an official state-level publicization and warning.

4. Time limits for publicizing and warning about fake news and false information:

a) For fake news and false information specified at Point a, Clause 1, Article 4 of this Decree, a competent functional agency shall publicize it immediately after labelling;

b) For fake news and false information specified at Point b, Clause 1, Article 4 of this Decree, publicization and warning shall be carried out within 12 working hours after labelling.

Article 12. Blocking and removal of fake news and false information

1. Competent agencies may take measures in accordance with law to block, or request related individuals and organizations to block and remove fake news and false information after a conclusion that the information constitutes fake news or false information is issued.

2. Press and media agencies, enterprises providing Internet services, enterprises providing telecommunications services, organizations and enterprises providing social networks, and organizations and enterprises providing cross-border information that operate in the territory of Vietnam or provide services to Vietnamese organizations and individuals shall block or not permit the posting of, or shall remove fake news and false information after a competent functional agency labels, notifies or publicizes it as fake news or false information, or requests its removal or blocking in accordance with law.

Article 13. Reports, denunciations and feedback concerning fake news and false information

1. The handling of reports, denunciations and feedback concerning fake news and false information shall be carried out as follows:

a) Reports, denunciations and feedback concerning fake news and false information showing signs of a crime shall be handled in accordance with criminal law and relevant regulations;

b) Other reports, denunciations and feedback concerning fake news and false information that do not fall under Point c, Clause 5, Article 5 of this Decree shall be handled according to the procedures for handling fake news and false information.

2. The reporting, denunciation and provision of feedback concerning information showing signs of being fake or false shall be carried out through direct contact or hotlines; through the portals of agencies, ministries, commissions and sectors; through the VNeID application; or by sending written documents to agencies and organizations in accordance with law.

3. Individuals, agencies and organizations that detect fake news or false information shall notify competent functional agencies for settlement and handling according to the procedures for handling fake news and false information.

4. Competent functional agencies shall receive and process information sources in accordance with law.

5. If an individual, agency or organization is detected to have abused the reporting or denunciation of fake news or false information to commit an act prohibited by the Law on Citizen Reception, the competent functional agency shall handle in accordance with law.

Article 14. Preservation and provision of documents serving as grounds for fact-checking, verifying and clarifying fake news and false information

1. Ministries, ministerial-level agencies and People’s Committees at all levels, after fact-checking, verifying, clarifying, labelling, publicizing, warning about and handling fake news and false information, shall send the results to the Ministry of Public Security for compilation and monitoring.

2. Ministries, ministerial-level agencies and People’s Committees at all levels shall preserve documents identifying fake news and false information and provide them to competent agencies when necessary for the handling of fake news and false information.

3. Individuals, agencies and organizations that lodge complaints or denunciations concerning the handling of fake news and false information or are involved in the handling of fake news and false information shall, upon request, provide competent functional agencies with documents and relevant information serving as grounds for fact-checking, verifying and clarifying fake news and false information.

Article 15. Review and detection of information showing signs of being fake or false

Competent functional agencies specified in Articles 17, 18, 19, 20 and 21 of this Decree shall:

1. Review and detect information in cyberspace, on social networks, and on services and applications that provide information in cyberspace.

2. Review and detect information and communication activities in the fields of press, publication, radio, television and advertising.

3. Organize the monitoring, review and examination of information and communication activities in other fields.

4. Organize review and detection by establishing a mechanism for receiving citizens’ feedback concerning information showing signs of being fake or false through hotlines, portals or digital applications.

5. Review and detect within their assigned scope, geographical areas and fields of management.

Article 16. Inspection and examination of the prevention and combat of fake news and false information

1. The Ministry of Public Security shall assume the overall responsibility for organizing the inspection and examination of the prevention and combat of fake news and false information by ministries, ministerial-level agencies and People’s Committees at all levels, including the fact-checking, publicization, warning and labelling of fake news and false information and other activities for preventing and combating fake news and false information within the scope of this Decree.

2. Ministries, ministerial-level agencies and People’s Committees at all levels shall organize the inspection and examination of the prevention and combat of fake news and false information within scope, geographical areas and fields of management; and coordinate with functional units of the Ministry of Public Security in inspecting and examining the prevention and combat of fake news and false information within the scope of this Decree.

 

Chapter III

RESPONSIBILITIES AND POWERS OF AGENCIES, ORGANIZATIONS AND INDIVIDUALS IN THE PREVENTION AND COMBAT OF FAKE NEWS AND FALSE INFORMATION

 

Article 17. Responsibilities and powers of the Ministry of Public Security

1. Assisting the Government in performing the state management of the prevention and combat of fake news and false information.

2. Advising the Government and the Prime Minister on promulgating legal provisions on the prevention and combat of fake news and false information.

3. Coordinating, guiding, supporting and cooperating with ministries, sectors and People’s Committees at all levels in connecting, integrating, updating, supplementing and linking data on the prevention and combat of fake news and false information with the Ministry of Public Security.

4. Conducting public communication, issuing warnings, identifying methods and tricks used to violate law, and disseminating skills for detecting, fact-checking and handling fake news and false information and the results of handling.

5. Providing guidance on the prevention and combat of fake news and false information:

a) Guiding agencies, committees, sectors and organizations in preventing and combating fake news and false information;

b) Guiding enterprises providing Internet services, enterprises providing telecommunications services, organizations and enterprises providing social networks, and providing cross-border information that operate in the territory of Vietnam or provide services to Vietnamese individuals and organizations in verifying, blocking and removing fake news and false information in accordance with Vietnamese law and relevant treaties;

c) Guiding competent agencies and units in applying measures for preventing and combating fake news and false information;

d) Providing guidance and legal support to individuals and organizations affected by fake news and false information to protect their honour, reputation, and lawful rights and interests;

dd) Guiding the application of handling measures to individuals and organizations that state, create, store, retain, provide, post, disseminate, share or comment on fake news or false information;

e) Directing units within the Ministry of Public Security to conduct public communication and dissemination of the law on the prevention and combat of fake news and false information.

6. Organizing the review and detection of information showing signs of being fake or false.

7. Supervising activities for preventing and combating fake news and false information.

8. Inspecting and examining the prevention and combat of fake news and false information by ministries, ministerial-level agencies and People’s Committees at all levels within the scope of this Decree.

9. Receiving and settling reports, denunciations and feedback concerning fake news and false information.

10. Fact-checking, verifying and clarifying information showing signs of being fake or false in the fields of national security or social order and safety, or information showing signs of being fake or false that relates to the functions, tasks or fields under the state management of two or more ministries or ministerial-level agencies or two or more provincial-level People’s Committees, or other agencies and units in the political system outside the system of state administrative agencies.

11. Labelling as fake news or false information the information that the Ministry of Public Security directly fact-checks, verifies and clarifies as showing signs of being fake or false.

12. Publicizing and warning about fake news and false information, including:

a) On the portal of the Ministry of Public Security, the VNeID application, and communication channels and pages serving the prevention and combat of fake news and false information;

b) Coordinating with the Ministry of Culture, Sports and Tourism in broadly publicizing and warning in the mass media about fake news and false information that risks causing a media crisis or seriously affecting national security, social order and safety, or economic management order;

c) Coordinating with the Ministry of Foreign Affairs in making an official state-level publicization of fake news and false information that affects the Party’s and the State’s guidelines, lines and policies on foreign-affairs, international issues, or Vietnam’s external relations with its partners;

d) Coordinating with the residential community where an individual or organization states, creates, stores, retains, posts, disseminates, shares or comments on fake news or false information, and with the residential community affected by fake news or false information, for publicization and warning;

dd) Coordinating with the agency or organization where an individual who states, creates, stores, retains, posts, disseminates, shares or comments on fake news or false information works, and with the agency or organization affected by fake news or false information, for publicization and warning.

13. Organizing measures to block and remove fake news and false information.

14. Requiring individuals and organizations related to fake news and false information to coordinate, exchange and provide information for fact-checking, verifying, clarifying, blocking and removing fake news and false information.

15. Handling fake news and false information in cases in which the Ministry of Public Security directly conducts the fact-checking, verification and clarification, and in cases in which ministries and ministerial-level agencies lack handling competence.

16. Assuming the prime responsibility for, and coordinating with related agencies in, carrying out international cooperation activities for preventing and combating fake news and false information.

17. Generally coordinating the organization of the prevention and combat of fake news and false information.

18. Ensuring funds and conditions for the Ministry of Public Security to carry out the prevention and combat of fake news and false information.

Article 18. Responsibilities and powers of the Ministry of Culture, Sports and Tourism

1. Assuming the prime responsibility for organizing the implementation of measures for the prevention and combat of fake news and false information in the field in which it is assigned by the State to exercise state management authority.

2. Conducting public communication, issuing warnings, identifying methods and tricks used to violate law, and disseminating skills for detecting, fact-checking and handling fake news and false information and the results of handling in the fields in which it is assigned by the State to exercise state management authority.

3. Guiding agencies and units under the Ministry of Culture, Sports and Tourism, provincial-level Departments of Culture, Sports and Tourism, enterprises providing Internet services, enterprises providing telecommunications services, organizations and enterprises providing social networks, providing cross-border information that operate in the territory of Vietnam or provide services to Vietnamese organizations and individuals in preventing and combating fake news and false information:

a) Guiding enterprises providing Internet services, enterprises providing telecommunications services, organizations and enterprises providing social networks, providing cross-border information that operate in the territory of Vietnam or provide services to Vietnamese organizations and individuals in verifying, blocking and removing fake news and false information in accordance with Vietnamese law and relevant treaties;

b) Guiding agencies and units under the Ministry of Culture, Sports and Tourism and provincial-level Departments of Culture, Sports and Tourism in applying measures for preventing and combating fake news and false information; providing legal support to individuals and organizations affected by fake news and false information to protect their honour, reputation and lawful rights and interests; and applying handling measures to individuals and organizations that state, create, store, retain, provide, post, disseminate, share or comment on fake news or false information.

4. Receiving reports, denunciations and feedback concerning fake news and false information and transferring them to other functional units for handling if the information showing signs of being fake or false relates to other fields, or if signs of a crime are detected, transferring them to competent functional agencies in accordance with the current Criminal Procedure Code.

5. Organizing the review and detection of information showing signs of being fake or false in the fields placed under its state management.

6. Supervising the prevention and combat of fake news and false information in the fields in which it is assigned by the State to exercise state management authority.

7. Fact-checking, verifying and clarifying fake news and false information in the fields in which it is assigned by the State to exercise state management authority. If signs of a crime are detected, the case shall be transferred to competent functional agencies in accordance with the current Criminal Procedure Code.

8. Labelling fake news and false information in the fields in which it is assigned by the State to exercise state management authority.

9. Publicizing and warning about fake news and false information in the fields in which it is assigned by the State to exercise state management authority.

10. Handling fake news and false information according to its competence. If it lacks handling competence, it shall transfer the case to another competent agency or to the Ministry of Public Security for handling.

11. Coordinating with functional units of the Ministry of Public Security in organizing the prevention and combat of fake news and false information in accordance with law.

12. Ensuring funds and conditions for the Ministry of Culture, Sports and Tourism to carry out the prevention and combat of fake news and false information in accordance with law.

Article 19. Responsibilities and powers of the Ministry of National Defence

1. Assuming the prime responsibility for organizing the implementation of measures for the prevention and combat of fake news and false information in the military and national defence fields.

2. Conducting public communication, issuing warnings, identifying methods and tricks used to violate law, and disseminating skills for detecting, fact-checking and handling fake news and false information and the results of handling in the military and national defence fields.

3. Guiding agencies and units under the Ministry of National Defence in preventing and combating fake news and false information, applying measures for preventing and combating fake news and false information; providing legal support to individuals and organizations affected by fake news and false information to protect their honour, reputation and lawful rights and interests; and applying handling measures to individuals and organizations that state, create, store, retain, provide, post, disseminate, share or comment on fake news or false information.

4. Organizing the review and detection of information showing signs of being fake or false in the military and national defence fields.

5. Preventing and combating fake news and false information in the military and national defence fields.

6. Fact-checking, verifying and clarifying fake news and false information in the military and national defence fields falling within the competence of the Ministry of National Defence in accordance with law.

7. Labelling, publicizing and warning about fake news and false information in the military and national defence fields.

8. Receiving and handling reports, denunciations and feedback concerning fake news and false information and complaints and denunciations concerning the handling of fake news and false information in the military and national defence fields, or transferring them to other functional units if the information showing signs of being fake or false relates to other fields.

9. Handling fake news and false information in the military and national defence fields falling within the competence of the Ministry of National Defence.

10. Directing subordinate functional agencies and units to coordinate with functional agencies and units of the Ministry of Public Security in organizing measures for preventing and combating fake news and false information in accordance with law.

11. Requiring individuals and organizations related to fake news and false information to coordinate, exchange and provide information for fact-checking, verifying, clarifying, blocking and removing fake news and false information within the competence of the Ministry of National Defence in accordance with law.

12. Inspecting and examining the prevention and combat of fake news and false information in the military and national defence fields.

13. Ensuring funds and conditions for the Ministry of National Defence to carry out the prevention and combat of fake news and false information in accordance with law.

Article 20. Responsibilities and powers of the Ministry of Foreign Affairs

1. Assuming the prime responsibility for organizing the implementation of measures for the prevention and combat of fake news and false information in the field in which it is assigned by the State to exercise state management authority.

2. Conducting public communication, issuing warnings, identifying methods and tricks used to violate law, and disseminating skills for detecting, fact-checking and handling fake news and false information and the results of handling in the fields in which it is assigned by the State to exercise state management authority.

3. Guiding agencies and units under the Ministry of Foreign Affairs in preventing and combating fake news and false information, applying measures for preventing and combating fake news and false information; providing legal support to individuals and organizations affected by fake news and false information to protect their honour, reputation and lawful rights and interests; and applying handling measures to individuals and organizations that state, create, store, retain, provide, post, disseminate, share or comment on fake news or false information.

10. Handling fake news and false information according to its competence. If it lacks handling competence, it shall transfer the case to another competent agency or to the Ministry of Public Security for handling.

11. Coordinating with functional units of the Ministry of Public Security in organizing the prevention and combat of fake news and false information in accordance with law.

12. Ensuring funds and conditions for the Ministry of Foreign Affairs to carry out the prevention and combat of fake news and false information in accordance with law.

Article 21. Responsibilities and powers of other ministries, ministerial-level agencies, and People’s Committees at all levels

1. Assuming the prime responsibility for organizing the implementation of measures for the prevention and combat of fake news and false information in the field in which it is assigned by the State to exercise state management authority.

2. Conducting public communication, issuing warnings, identifying methods and tricks used to violate law, and disseminating skills for detecting, fact-checking and handling fake news and false information and the results of handling in the fields placed under their state management.

3. Guiding their subordinate agencies and units in preventing and combating fake news and false information, applying measures for preventing and combating fake news and false information; providing legal support to individuals and organizations affected by fake news and false information to protect their honour, reputation and lawful rights and interests; and applying handling measures to individuals and organizations that state, create, store, retain, provide, post, disseminate, share or comment on fake news or false information.

4. Receiving reports, denunciations and feedback concerning fake news and false information and transferring them to other functional units for handling if the information showing signs of being fake or false relates to other fields, or if signs of a crime are detected, transferring them to competent functional agencies in accordance with the current Criminal Procedure Code.

5. Organizing the review and detection of information showing signs of being fake or false in the fields in which it is assigned by the State to exercise state management authority.

6. Supervising the prevention and combat of fake news and false information in the fields in which it is assigned by the State to exercise state management authority; and, according to their competence, inspecting and examining the prevention and combat of fake news and false information by subordinate agencies and units within the scope of their management.

7. Fact-checking, verifying and clarifying fake news and false information in the fields in which it is assigned by the State to exercise state management authority. If signs of a crime are detected, the case shall be transferred to competent functional agencies in accordance with the current Criminal Procedure Code.

8. Labelling fake news and false information in the fields in which it is assigned by the State to exercise state management authority.

9. Publicizing and warning about fake news and false information in the fields and geographical areas in which it is assigned by the State to exercise state management authority.

10. Handling fake news and false information according to their competence. If it lacks handling competence, it shall transfer the case to another competent agency or to the Ministry of Public Security for handling.

11. Coordinating with functional units of the Ministry of Public Security in organizing measures for preventing and combating fake news and false information in accordance with law.

12. Ensuring funds and conditions for their respective units to carry out the prevention and combat of fake news and false information in accordance with law.

Article 22. Responsibilities of individuals and organizations

1. Individuals and organizations specified in Article 2 of this Decree, except enterprises providing Internet services, enterprises providing telecommunications services, organizations and enterprises providing social networks, providing cross-border information that operate in the territory of Vietnam or provide services to Vietnamese organizations and individuals, shall:

a) Comply with the law on the prevention and combat of fake news and false information and relevant regulations;

b) Coordinate and exchange and provide information with functional units of the Ministry of Public Security and other competent agencies for organizing activities for preventing and combating fake news and false information;

c) Denounce fake news and false information to competent agencies.

2. Enterprises providing Internet services, enterprises providing telecommunications services, organizations and enterprises providing social networks, providing cross-border information that operate in the territory of Vietnam or provide services to Vietnamese organizations and individuals shall:

a) Comply with legal provisions on the prevention and combat of fake news and false information;

b) Ensure security and safety of information and communication activities;

c) Organize control measures for preventing and combating fake news and false information, including:

Establishing measures to detect, block and remove fake news and false information after it has been labelled as fake news or false information in accordance with the Law on Cybersecurity No. 116/2025/QH15 and relevant laws;

Establishing a mechanism for users to report violations, and not permitting the posting, dissemination or sharing of information after a functional agency has authenticated it as fake news or false information.

d) Promptly coordinate and exchange and fully provide information at the request of functional units of the Ministry of Public Security and other competent agencies for organizing measures to prevent and combat fake news and false information;

dd) Establish a focal point available to coordinate on a 24/7 basis with functional agencies of the Ministry of Public Security and other competent agencies in receiving requests to label, publicize, warn about, block or remove information after it has been authenticated as fake news or false information, or to temporarily or permanently lock social network accounts, community pages or content channels containing fake news or false information; or to block or remove applications containing fake news or false information in accordance with law.

 

Chapter IV

IMPLEMENTATION PROVISIONS

 

Article 23. Effect

This Decree takes effect on October 05, 2026.

Article 24. Responsibility for implementation

Ministers, heads of ministerial-level agencies, chairpersons of People’s Committees at all levels, and related individuals and organizations shall implement this Decree.
