Defining the functions, tasks, powers and organisational structure of the Ministry of Science and Technology^[1]

Pursuant to Law No. 63/2025/QH15 on Organisation of the Government;

At the proposal of the Minister of Science and Technology;

The Government promulgates the Decree defining the functions, tasks, powers and organisational structure of the Ministry of Science and Technology.

Article 1. Position and functions

The Ministry of Science and Technology is an agency of the Government, performing the state management of scientific research, technological development, innovation, development of high technologies and strategic technologies, and development of scientific and technological potential; intellectual property; standards, technical regulations, measurement and product and goods quality; atomic energy and radiation and nuclear safety; post; telecommunications; radio frequencies; digital technology industry; application of information technology; artificial intelligence; e-transactions; national digital transformation; and public services in the sectors and fields under the Ministry’s management in accordance with law.

Article 2. Tasks and powers

The Ministry of Science and Technology shall perform the tasks and exercise the powers in accordance with the Law on Organisation of the Government, and the Government’s regulations on the functions, tasks, powers and organisational structures of ministries and ministerial-level agencies, and has the following specific tasks and powers:

1. To submit to the Government drafts of: laws and resolutions of the National Assembly, ordinances and resolutions of the National Assembly Standing Committee, and decrees of the Government under the Government’s annual law-making programmes and plans, and resolutions, projects and schemes as assigned by the Government or the Prime Minister.

2. To submit to the Government or the Prime Minister strategies, master plans, and long-term and medium-term development plans; national important works, programmes, projects and schemes in the sectors and fields assigned to the Ministry for management; and decisions, directives and other documents within the Prime Minister’s competence.

3. To promulgate circulars, decisions, directives and other documents on the sectors and fields falling under the Ministry’s state management.

4. To formulate and promulgate 5-year overall plans on science, technology and innovation; and 5-year science, technology and innovation plans of the Ministry; to guide the formulation of, summarise and inspect, annual science, technology and innovation plans of ministries, sectors and localities; to approve science, technology and innovation programmes and tasks falling under the Ministry’s state management and as decentralised or authorised by the Government or the Prime Minister.

5. To direct, guide, inspect and organise the implementation of approved legal documents, strategies, master plans, plans, programmes and schemes.

6. To issue, re-issue, recognise, modify, supplement, extend, suspend, cease, revoke, terminate and invalidate licences, certificates, letters of confirmation, recognition papers and registration papers within the scope of the Ministry’s state management of sectors and fields in accordance with law.

7. Regarding science, technology and innovation activities

a/ To perform the state management of science, technology and innovation nationwide, including: basic research; applied research; development of technologies and social solutions; trial production; technology application and transfer; innovation based on technological innovation, technological creation and technological performance improvement; innovative star-tup activities; provision of science, technology and innovation services; initiatives, technical improvements, knowledge creation and other related activities;

b/ To provide ministries, sectors and localities with professional guidance on the management of science, technology and innovation activities;

c/ To manage science, technology and innovation tasks and programmes under the Ministry’s management; to guide, formulate, appraise and manage special science, technology and innovation tasks, special national science, technology and innovation programmes, and national science, technology and innovation programmes;

d/ To periodically review and evaluate, and submit to the Government or the Prime Minister for promulgation, the list of high technologies prioritised for investment and development and the list of hi-tech products encouraged for development, the list of strategic technologies and strategic technology products, the list of technologies promoted for transfer, the list of technologies restricted from transfer and the list of technologies banned from transfer;

dd/ To perform the state management and organise the evaluation of science, technology and innovation activities under regulations;

e/ To perform the state management of high technology and strategic technology activities; to formulate, and guide and organise the implementation of, mechanisms and policies on development of technologies, high technologies, strategic technologies and core technologies; to promote technology application and transfer, and technological innovation; to develop the science and technology market in Vietnam; to develop the innovation system; to promote initiatives, technical improvements and production rationalisation;

g/ To formulate, and guide and organise the implementation of, mechanisms and policies on incentives, support, funding and order placement to promote innovation and mobilise investment resources for innovation;

h/ To formulate and submit to the Government specific regulations on the competence, order, procedures and conditions for issuance of certificates of eligibility for provision of technology evaluation and assessment services; and specific conditions on human resources and physical-technical foundations for organisations engaged in technology valuation, and organise the implementation thereof after they are promulgated;

i/ To formulate, and guide and organise the implementation of, mechanisms and policies on technology evaluation, appraisal, assessment and transfer in accordance with law; to manage the import of used machinery, equipment and technological lines; to manage the identification of investment projects using outdated technologies that are likely to cause environmental pollution and involve overexploitation of natural resources; to assess the quality and value of machinery, equipment and technological lines of investment projects in accordance with law; to appraise, or give opinions on, technologies in accordance with law;

k/ To guide the process of identifying and accepting risks in state budget-funded science, technological development and innovation activities;

l/ To guide the establishment, management and development of innovation networks, innovation and innovation support organisations and centres; to set, and guide and organise the implementation of, criteria for identifying innovation centres in accordance with law;

m/ To support and encourage organisations and individuals to apply, transfer and innovate technologies; to decode technologies and purchase technology know-how;

n/ To organise the evaluation, selection and announcement of technologies created from outcomes of scientific research, technological development and innovation; 

o/ To formulate, and guide and organise the implementation of, regulatory sandbox for technology-based new products, services and business models under the Ministry’s management;

p/ To formulate, and guide and organise the implementation of, mechanisms and policies on identification, recognition, incentives and support for the development of; to manage, and guide the establishment of; to build, operate and develop, entities and institutions supporting innovative start-up activities, including: innovative start-up support organisations, innovative start-up support centres, technology incubators, science and technology enterprise incubators, technical facilities, co-working spaces to support innovative start-up activities, individuals, groups of individuals and enterprises engaged in innovative start-up activities, science and technology enterprises, innovative start-up advisors, innovative start-up investors, and innovative venture capital funds, infrastructure, networks and start-up ecosystems in accordance with law;

q/ To formulate and implement programmes, schemes and projects on support for innovative start-up activities, development of science and technology enterprises, technology incubators and science and technology enterprise incubators; to guide the provision of support for, and manage the establishment of, or participation in establishing, enterprises, or contribution of capital to enterprises in order to commercialise outcomes of scientific research and technological development in accordance with law.

8. Regarding the development of science, technology, innovation and digital transformation potential

a/ To guide the implementation of the autonomy and self-responsibility mechanism for public science and technology organisations; to submit to the Prime Minister for promulgation the list of basic and essential public non-business services in the field of science and technology; to assume the prime responsibility for, and coordinate with the Ministry of Finance and related ministries and agencies in, submitting to competent authorities for promulgation, and organise the implementation of, mechanisms and policies to increase the autonomy of public science and technology organisations;

b/ To establish, appraise the establishment of, reorganise and dissolve, public science and technology organisations in accordance with law;

c/ To organise the implementation of mechanisms and policies on training, further training, management, employment and preferential treatment of human resources and talents in the fields of science, technology, innovation and digital transformation; to formulate, and organise the implementation of, plans on training, further training and improvement of professional qualifications in science, technology, innovation and digital transformation;

d/ To manage, guide and organise information, library and statistics collection activities in science, technology and innovation; to evaluate and rank scientific journals; to supplement centralised international scientific and technological information sources; to invest in the development of the National Information System on Science, Technology and Innovation.

9. Regarding intellectual property

a/ To formulate, and guide and organise the implementation of, processes and procedures for the establishment and assignment of industrial property rights of organisations and individuals; to manage the licensing of use rights over subject matters of industrial property, industrial property representation, industrial property assessment and intellectual property services;

b/ To perform the state management of initiative activities;

c/ To manage the use of national geographical indications in the registration of certification marks and collective marks for Vietnam’s national products and services; to build, and organise the management of the use of, Vietnam’s national geographical indication symbols; to take measures to protect the lawful rights and interests of the State, organisations and individuals in the field of industrial property;

d/ To provide guidance on industrial property operations to management agencies, and organisations and individuals; to support organisations and individuals in managing, exploiting and developing intellectual assets and determining the value of intellectual property rights; to promote the commercialisation, transfer and development of intellectual assets in accordance with law;

dd/ To assume the prime responsibility for settling industrial property disputes and related commercial disputes in accordance with law.

10. Regarding standards, technical regulations, measurement, and product and goods quality

a/ To perform the state management of standards and technical regulations; to assume the prime responsibility for, and coordinate with ministries, sectors and localities in, organising the formulation, appraisal and declaration of national standards; to act as the national focal point for implementing commitments on technical barriers to trade (TBT), including notification, enquiry, resolution of trade concerns, negotiation participation and TBT network coordination in accordance with law;

b/ To perform the state management of measurement activities regarding measurement standards, measuring devices, measurements, pre-packaged goods quantity, and inspection, calibration and testing of measuring devices; to manage the system of measurement standards; to approve national measurement standards; to designate an organisation preserving national measurement standards; to support the innovation and development of measurement activities at enterprises; to carry out the state inspection of measurement in accordance with law;

c/ To act as the focal-point agency responsible to the Government for performing the unified state management of product and goods quality; to assume the prime responsibility for, and coordinate with line ministries and provincial-level People’s Committees in, formulating, and guiding and organising the implementation of, mechanisms, policies and plans on product and goods quality, and traceability of products and goods; to perform the state management of the quality of products and goods produced, and products and goods imported, exported and circulated on the market, in the digital environment, on digital platforms and in e-commerce; to organise quality inspection and supervision in accordance with law;

d/ To perform the state management of, and guide, deploy and inspect, conformity assessment activities; to accredit the capacity of conformity assessment organisations; to designate conformity assessment organisations in accordance with law; to organise the implementation of treaties, international agreements and mutual recognition on conformity assessment results;

dd/ To organise activities to improve productivity and quality of products and goods and support innovation in enterprises; to manage, and organise the implementation of, the National Quality Award; to manage the consideration for conferment of goods quality awards for organisations and individuals; to organise the application of advanced quality management systems in agencies, organisations and enterprises;

e/ To perform the state management of article numbers, barcodes, product labels, electronic labels, digital passports and traceability of products and goods; to build, manage, operate, maintain and exploit the national product and goods quality monitoring system;

g/ To perform the state management of the National Quality Infrastructure (NQI).

11. Regarding atomic energy and radiation and nuclear safety

a/ To perform state management of atomic energy in econo-technical sectors; to implement national-level priority projects, programmes, schemes and tasks in the field of atomic energy; to monitor and urge the implementation of priority projects, programmes, schemes and tasks of ministries, sectors and localities in the field of atomic energy;

b/ To perform the state management of radiation and nuclear safety assurance, nuclear security and safeguards, and response to radiation and nuclear incidents;

c/ To carry out inspection and examination and handle violations in the assurance of radiation safety and nuclear safety for activities in the field of atomic energy; to supervise radiation safety, nuclear safety and nuclear security;

d/ To manage the national environmental radiation monitoring and warning network and the system of radiation and nuclear measurement standards;

dd/ To perform the state management of safety and security of nuclear fuels, spent nuclear fuels, nuclear materials, source nuclear materials, radioactive wastes, and the provision of services in support of atomic energy application; to manage the import and export of radiation equipment technology, nuclear fuels, spent nuclear fuels, nuclear materials and radioactive sources nationwide;

e/ To regulate the control and handling of radiation incidents and nuclear incidents; to participate in responding to radiation incidents and nuclear incidents within competence; to regulate the control of occupational exposure, medical exposure and radiation safety for the public;

g/ To organise notification and declaration of radioactive substances, radiation equipment, nuclear materials and nuclear equipment and issue licences to perform radiation jobs within the Ministry's competence, and issue certificates of registration for atomic energy application support service activities.

12. Regarding post

a/ To organise the inspection of the list of, support mechanisms for, and provision of, public postal services in accordance with law;

b/ To set and manage prices and quality of public postal services, private postal services, postal services serving agencies of the Party and the State, and other postal services in accordance with law;

c/ To manage postage stamps and safety in postal activities according to the Ministry’s competence;

d/ To manage national postal codes and Vietnam’s postage stamp codes;

dd/ To provide according to the Ministry’s competence, and guide the operation of, the public postal network and the postal network serving the operation of the agencies of the Party and the State.

13. Regarding telecommunications

a/ To promulgate charge rates of public telecommunications services and mechanisms for public telecommunications activities; to organise the implementation of the programme on provision of public telecommunications services;

b/ To assume the prime responsibility for formulating, and organising the implementation of, regulations on market surveillance and competition in the field of telecommunications and the Internet; to manage domain name registration and maintenance services; to protect the interests of telecommunications service users and Internet users in accordance with law;

c/ To promulgate, and organise the implementation of, master plans and regulations on management and use of telecommunications number stores and Internet resources; to allocate, distribute and recover telecommunications number stores and Internet resources; to organise the auction and transfer of the rightd to use telecommunications codes and numbers and the Vietnam national domain name “.vn”;

d/ To promulgate mechanisms, policies and regulations on, and organise the management of, charge rates in the field of telecommunications and the Internet in accordance with law; to control, and terminate the application of, telecommunications service charge rates when telecommunications enterprises impose or dump telecommunications service charge rates, making the telecommunications market unstable and harming the lawful rights and interests of telecommunications service users, other telecommunications enterprises and the State; to direct and guide the implementation of the regulations on reporting, accounting and auditing serving the management of telecommunications and Internet service charge rates;

dd/ To promulgate, and organise the implementation of, regulations on management of the connection of telecommunications networks;

e/ To provide according to the Ministry’s competence and guide the operation of private telecommunications networks serving the agencies of the Party and the State;

g/ To guide the formulation and implementation of plans and options on development of the telecommunications network; to direct, guide and inspect the sharing and shared use of telecommunications infrastructure;

h/ To assume the prime responsibility for ensuring the safety of telecommunications and Internet infrastructure;

i/ To manage telecommunications and Internet quality; to build, manage and operate testing and calibration laboratories specialised in telecommunications and the Internet in accordance with law;

k/ To establish, manage, operate and exploit the telecommunications data collection and management system and the land mobile telecommunications switching system with telecommunications subscriber numbers unchanged (switching centres);

l/ To establish, manage, operate and exploit safely the national domain name server system, the Vietnam National Internet eXchange (VNIX) and the national Internet resource management system connected with regional and international systems;

m/ To establish systems and platforms for measuring Internet speed and IPv6; to collect, make statistics and publicise statistics on the Internet and Internet resources;

n/ To formulate programmes on, and promote, the application and transformation of the Internet into IPv6, and develop industrial Internet and the Internet of Things (IoT); to promote the safe and sustainable development of Internet resources, and universalise the Vietnam national domain name “.vn”;

o/ To register, receive, transfer and maintain Vietnam’s Internet resources with regional and international organisations.

14. Regarding radio frequencies

a/ To guide and organise the implementation of the master plan on national radio frequency spectra; and transmission and broadcasting activities under the Prime Minister-approved master plan on information and communication infrastructure; to develop and implement solutions and policies to promote radio applications in socio-economic sectors;

b/ To assume the prime responsibility for, and coordinate with the Ministry of National Defence and the Ministry of Public Security in, formulating, submitting to the Prime Minister for approval, and guiding the implementation of, decisions on the allocation of frequency bands for national defence and security purposes; and coordination mechanisms for handling harmful interferences between radio stations serving socio-economic activities and radio stations serving national defence and security purposes;

c/ To promulgate, and organise the implementation of, the master plan on frequency bands, the master plan on frequency channel demarcation, and the master plan on the use of frequency channels, and specify conditions for allocation, determination and use of radio frequencies;

d/ To manage the quality of radio emissions, electromagnetic compatibility and radio radiation safety in accordance with law; to apply measures to prevent, detect, counter or mitigate harms of radio radiation on humans and the environment;

dd/ To specify lists, technical conditions and conditions for exploitation of radio equipment exempt from radio frequency use licence;

e/ To provide training and guidance on radio operations; to manage the training of radio operators and the issuance of radio operator certificates in accordance with law;

g/ To manage the fee for issuance of radio frequency use permits, the radio frequency use charge, and the fee for grant of radio frequency use rights in accordance with law;

h/ To inspect and control radio frequencies and equipment, and handle harmful interferences; to build, maintain and operate the national radio frequency monitoring and control system;

i/ To carry out international registration and coordination on radio frequencies and satellite orbits;

k/ To submit to competent authorities for promulgation, and organise the implementation of, regulations on auction, selection and licensing of radio frequency used rights.

15. Regarding digital technology and artificial intelligence (AI)

a/ To submit to competent authorities for promulgation or promulgate according to the Ministry’s competence policies, incentives and priorities for investment in the development of products and services in digital technology, semiconductors, AI, digital technology industry and semiconductor industry; criteria for evaluation and certification of functions and technical specifications of products and services in digital technology, semiconductors and AI; and mechanisms and policies for the management and development of centralised digital technology zones; to announce lists of key digital technology products and services;

b/ To appraise programmes, plans and projects on development of products and services in digital technology, semiconductors, AI, digital technology industry and semiconductor industry;

c/ To manage, coordinate and develop the national AI infrastructure and other infrastructure facilities to serve the development of products and services in digital technology, semiconductors and AI; to manage and supervise AI activities;

d/ To organise investment promotion and trade promotion support activities for products and services in digital technology, semiconductors, AI, digital technology industry and semiconductor industry;

dd/ To perform quality management and manage conformity assessment activities for products and services in digital technology, semiconductors and AI in accordance with law.

16. Regarding national digital transformation

a/ To deploy, manage, guide, inspect and urge the performance of tasks on national digital transformation, digital government, digital economy and digital society as approved or assigned by competent authorities;

b/ To build, maintain, update, and guide the implementation of, the national overall digital architecture framework; to formulate plans on and promulgate the system of national standards and technical regulations;

c/ To assume the prime responsibility for performing the state management of digital transformation; to perform the national coordination role, coordinate and urge the performance of national, inter-sectoral and inter-regional digital transformation tasks; to manage, guide, inspect and urge the performance of digital transformation tasks, investment projects, procurement and service leases in accordance with regulations;

d/ To assume the prime responsibility for performing the state management of digital systems, manage compliance with architectural and design principles and minimum requirements for digital systems; to give advice on the promulgation of criteria, minimum technical requirements and lists of national shared-use digital platforms; to manage and monitor the building, operation and exploitation of national shared-use digital platforms;

dd/ To formulate, promulgate and update a unified set of indicators for evaluating the digital transformation level; to build, manage and operate platforms for statistics, measurement, monitoring and evaluation of the digital transformation level and announce the digital transformation level at the national, ministerial, sectoral and local levels;

e/ To formulate, promulgate and update the Digital Competency Framework; to guide and organise training, further training, coaching, evaluation, analysis and summarisation of information and communication to raise awareness and universalise digital capacity; to attract diverse resources for digital transformation;

g/ To formulate, and guide and organise the implementation of, the Digital Government Architecture Framework, the information and communication technology (ICT) Architecture Framework for the development of smart cities, and provincial-level Intelligent Operations Centre (IOC) models, and provide technical guidelines on building and applying urban digital twins;

h/ To guide, measure, make statistics, and evaluate the quality of digital services, online public services and the system of information for settlement of administrative procedures of state agencies;

i/ To build, manage and operate information system laboratories; to maintain, operate and develop the National Data Exchange Platform (NDXP); to build and develop platforms for statistics, measurement, monitoring and evaluation of digital transformation and digital platforms serving the Government within the Ministry’s competence;

k/ To organise evaluation and quality inspection of digital systems, information systems, digital platforms, databases and digital services for digital government development;

l/ To assume the prime responsibility for coordinating, monitoring and evaluating the performance of digital economy development tasks in the sectors, fields and localities;

m/ To assume the prime responsibility for and coordinate digital transformation support and promotion programmes and activities for enterprises, cooperatives and business households; to announce and update assessment tools, manuals and lists of digital platforms for digital transformation in enterprises;

n/ To guide and promote the formation and development of new business models based on digital technologies, digital data and innovation in accordance with law;

o/ To assume the prime responsibility for, coordinate, monitor and evaluate the implementation of digital society development programmes, schemes and tasks; to formulate criteria for measurement of digital society and annually survey, collect and announce digital society measurement results at the national and local levels;

p/ To guide, support and encourage citizens to participate in digital society; to coordinate in bridging the digital divide.

17. Regarding e-transactions

a/ To formulate and implement technical requirements, and requirements on technical auditing and quality of products and services in e-transactions;

b/ To manage e-transaction reporting, measurement and statistics; to manage the safety supervision of information systems serving e-transactions by information system operators; to build, manage and operate the system for receiving and synthesising data to serve the state management of e-transactions by state agencies;

c/ To manage digital signatures, trust services and trust service providers; to recognise foreign e-signatures, foreign e-signature certificates, and foreign e-signature authentication service providers in Vietnam in accordance with law;

d/ To manage and organise the establishment, exploitation and development of the national electronic authentication infrastructure, the inspection system of digital signature certificate status; and issuance and revocation of digital signature certificates.

dd/ To stipulate the interoperability between systems providing public digital signature services and those providing official digital signatures.

18. To build, manage, operate and exploit private post and telecommunications networks and special-use data transmission networks to serve the direction and administration by agencies of the Party and the State.

19. To decide on measures to mobilise information transmission networks, services, media and equipment to serve the handling of cases of national security emergency, disasters and enemy sabotage as assigned by the Government or the Prime Minister.

20. To manage, guide and organise the conferment of the Ho Chi Minh Prize and State Prizes in Science, Technology and Innovation; and other awards in the sectors and fields under the Ministry’s management in accordance with law; to organise the conferment of prizes and perform the emulation and commendation work in accordance with law.

21. To decide on, and organise the implementation of, preventive and deterrent measures against information-related violations within the ambit of the Ministry’s functions and tasks in accordance with law.

22. To carry out inspection and supervision, settle complaints and denunciations, receive citizens, prevent and combat corruption, negative practices and waste, and handle violations in the fields under the Ministry’s state management in accordance with law.

23. To train, further train and develop human resources in the fields under the Ministry’s management; to forecast demands and set orientations for development of human resources within the Ministry’s management.

24. To build, guide, and organise media activities regarding mechanisms, policies, programmes, schemes and plans on science, technology, innovation and digital transformation under the Ministry’s management; to perform tasks for disseminating science, technology, innovation and digital transformation knowledge nationwide.

25. Regarding international cooperation and integration

a/ To guide and organise the implementation of international integration activities in the sectors and fields under the Ministry’s management under regulations;

b/ To propose the conclusion and organise the implementation of treaties and international agreements in the name of the State and the Government in the sectors and fields under the Ministry’s management in accordance with law;

c/ To decide on the conclusion and organise the implementation of international agreements in the name of the Ministry and regional and international integration schemes; to manage, guide and examine the conclusion and implementation of international agreements in the Ministry’s attached units in the sectors and fields under the Ministry’s management in accordance with law;

d/ To assume the prime responsibility for negotiating and consider granting donations for joint programmes and projects with international partners within the framework of bilateral, multilateral, regional and inter-regional treaties and international agreements; to join international organisations as assigned by competent agencies; to establish a network of overseas science and technology representatives as directed by the Government or the Prime Minister.

26. To perform the state management of public non-business services in the fields under the Ministry’s management; to carry out supervision, evaluation and quality inspection of public non-business services, and operation efficiency of public non-business units in the fields under the Ministry’s management; to perform the state management of prices of public non-business services in accordance with law.

27. To decide or submit to competent authorities for promulgation expenditure regimes, criteria and norms for the field of science, technology, innovation and digital transformation; to guide, summarise and propose state budget expenditure estimates for the field of science, technology, innovation and digital transformation (including development investment expenditures and recurrent expenditures) of ministries, ministerial-level agencies, other central agencies and localities in accordance with regulations.

28. To build, manage and operate national digital platforms, shared-use digital platforms, inspection and supervision systems, information systems, national databases and specialised databases in the fields under the Ministry’s management in accordance with law.

29. To manage finances and assets and organise the implementation of the Ministry’s assigned budget funds in accordance with law.

30. To manage off-budget state financial funds under the Ministry’s management in accordance with law; to manage, and organise the implementation of, investment projects falling within the Ministry’s competence in accordance with law.

31. To exercise rights and fulfil responsibilities and obligations of the state owner’s representative with respect to state enterprises and state capital amounts invested in other enterprises in accordance with law.

32. To manage the Ministry’s organisational apparatus, working positions, payroll of civil servants, number of employees of public non-business units and the number of employees working under contracts; to recruit, employ and manage cadres, civil servants, public employees and workers under regulations and as decentralised by competent agencies.

33. To manage associations, funds and non-governmental organisations operating in sectors and fields under the Ministry’s state management in accordance with law.

34. To organise the implementation of the Ministry’s administrative reform plan under the state administrative reform programme approved by the Government or the Prime Minister.

13. The Authority of Central Posts.

14. The Authority of National Digital Transformation.

15. The Authority of Digital Technology and Artificial Intelligence.

16. The State Agency for Technology and Innovation.

17. The Department of Start-ups and Technology Entrepreneurship.

18. The Intellectual Property Office of Vietnam.

The units specified in Clauses 1 thru 21 of this Article are administrative organisations assisting the Minister in performing the state management function; the units specified in Clauses 22 thru 25 of this Article are public non-business units serving the Ministry’s state management function.

The Vietnam Agency for Radiation and Nuclear Safety is a grade-1 agency. The Vietnam Agency for Radiation and Nuclear Safety and the Commission for Standards, Metrology and Quality of Vietnam may use seals bearing the national emblem.

The Minister of Science and Technology shall submit to the Prime Minister for promulgation a list of other public non-business units attached to the Ministry.

The Minister of Science and Technology shall define the functions, tasks, powers and organisational structures of units attached to the Ministry according to his/her competence.

Article 4. Transitional provisions

The Academy of Science and Technology Strategy, the Vietnam Science and Technology Magazine (specified in the Prime Minister’s Decision No. 17/2025/QD-TTg of June 16, 2025, defining the functions, tasks, powers and organisational structure of the Academy of Science and Technology Strategy under the Ministry of Science and Technology); the Department of Social, Human and Natural Sciences, the Department of Digital Economy and Society, the National Agency for Science and Technology Information and Statistics, the Authority of Information Technology Industry, the Vietnam Agency for Radiation and Nuclear Safety and the Information Technology Centre (specified in the Government’s Decree No. 55/2025/ND-CP of March 2, 2025, defining the functions, tasks, powers and organisational structure of the Ministry of Science and Technology) shall continue performing their tasks and exercising their powers in accordance with law until the Minister of Science and Technology issues Decisions defining the functions, tasks, powers and organisational structure of the Academy of Science and Technology Strategy, the Vietnam Science and Technology Magazine, the Department of Social and Natural Sciences, the Department of Digital Economy and Digital Society, the National Agency for Science and Technology Information, Statistics and Assessment, the Authority of Digital Technology and Artificial Intelligence, the Vietnam Agency for Radiation and Nuclear Safety and the Digital Transformation Centre.

Article 5. Effect

1. This Decree takes effect on July 1, 2026, and replaces the Government’s Decree No. 55/2025/ND-CP of March 2, 2025, defining the functions, tasks, powers and organisational structure of the Ministry of Science and Technology.

Article 6. Implementation responsibility

Ministers, heads of ministerial-level agencies, and Chairpersons of provincial-level People’s Committees shall implement this Decree.-
