Decree No. 124/2018/ND-CP dated September 19, 2018 of the Government on amending and supplementing a number of articles of the Government’s Decree No. 63/2011/ND-CP of July 28, 2011, detailing and guiding the implementation of a number of articles of the Law on Commercial Arbitration

DECREE

Amending and supplementing a number of articles of the Government’s Decree No. 63/2011/ND-CP of July 28, 2011, detailing and guiding the implementation of a number of articles of the Law on Commercial Arbitration

Pursuant to the June 19, 2015 Law on Organization of the Government;

Pursuant to the June 17, 2010 Law on Commercial Arbitration;

At the proposal of the Minister of Justice;

The Government promulgates the Decree amending and supplementing a number of articles of the Government’s Decree No. 63/2011/ND-CP of July 28, 2011, detailing and guiding the implementation of a number of articles of the Law on Commercial Arbitration  

Article 1. To amend and supplement a number of articles of the Government’s Decree No. 63/2011/ND-CP of July 28, 2011, detailing and guiding the implementation of a number of articles of the Law on Commercial Arbitration

1. To annul Point d, Clause 1 of Article 8.

2. To annul Point dd, Clause 1 of Article 10.

3. To amend and supplement Clauses 2 and 3 of Article 21 as follows:

a/ To amend Point dd, Clause 2 of Article 21 as follows:

“dd/ Documents proving the head of the branch permanently residing in Vietnam;”

b/ To annul Points b, c and e, Clause 2 of Article 21;

c/ To amend and supplement Clause 3 of Article 21 as follows:

“3. A dossier for establishment of a representative office must comprise the following papers:

a/ A written request for permission for establishment of representative office;

b/ A certified copy of the charter of the foreign arbitration.”

4. To annul Points b and d, Clause 2 of Article 22.

Article 2. Responsibilities for organization of implementation

1. The Minister of Justice shall organize the implementation of this Decree.

2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees and related organizations and individuals shall implement this Decree.

Article 3. Effect

This Decree takes effect on the date of its signing.-
