DECREE

Amending and supplementing a number of articles of the Government’s Decree No. 116/2017/ND-CP dated October 17, 2017, prescribing the conditions for manufacture, assembly and import of automobiles and provision of automobile warranty and maintenance services

 

Pursuant to the Law on Organization of the Government No. 63/2025/QH15;

At the proposal of the Minister of Industry and Trade;

The Government hereby promulgates the Decree amending and supplementing a number of articles of the Government’s Decree No. 116/2017/ND-CP dated October 17, 2017, prescribing the conditions for manufacture, assembly and import of automobiles and provision of automobile warranty and maintenance services.

 

Article 1. To amend Point a, Clause 2 of Article 2

“a) Automobiles manufactured or assembled:

- For national defense and security purposes;

- From chassis including cabins or from complete automobile units with technical quality and safety and environmental protection certificates;

- Only for operation within certain areas, not on public roads.

- For export purposes.”.

Article 2. To amend a number of points of Article 3

1. To amend Point a, Clause 12 as follows:

“a) A certified copy (in case of dossiers submitted by post, via the administrative mail channel or directly);”.

2. To amend Point c, Clause 12 as follows:

“c) An electronic copy (in case of dossiers submitted electronically).”.

Article 3. To amend and annul a number of points of Article 8

1. To annul Point b, Clause 2.

2. To amend Point a, Clause 3 as follows:

“a) The enterprise shall submit one dossier set made under Clause 2 of this Article directly or via the postal system to the Ministry of Industry and Trade or through the online form on the National Public Service Portal;”.

3. To amend Point c, Clause 3 as follows:

“c) If finding the dossier complete and valid, within 5 working days after receiving it, the Ministry of Industry and Trade shall notify the specified time of physical inspection and assessment at the enterprise. The inspection shall be carried out within 15 working days from the date of notification. The inspection contents must be recorded in writing using (Form No. 09 provided in Appendix II to this Decree).

In case the inspection and assessment results are unsatisfactory, within 5 working days after the inspection is completed, the Ministry of Industry and Trade shall notify such to the enterprise for satisfaction of the prescribed conditions;”.

4. To amend Point dd, Clause 3 as follows:

“dd) Enterprises shall receive certificates of eligibility for automobile manufacture or assembly directly at the Ministry of Industry and Trade or by post (if they so request) or through the National Public Service Portal.”.

Article 4. To amend and annul a number of points of Article 9

1. To annul Point b, Clause 2.

2. To amend Point a, Clause 3 as follows:

“a) The enterprise shall submit one dossier set made under Clause 2 of this Article directly or via the postal system to the Ministry of Industry and Trade or through the online form on the National Public Service Portal;”.

3. To amend Point d, Clause 3 as follows:

“d) Within 5 working days after obtaining the satisfactory results of the dossier examination and physical inspection (if any), the Ministry of Industry and Trade shall consider and renew the certificate of eligibility for automobile manufacture or assembly for the enterprise, using Form No. 04 provided in Appendix II to this Decree. In case of refusal to renew the certificate, the Ministry of Industry and Trade shall issue a written reply clearly stating the reason.”.

Article 5. To amend a number of points of Article 10

1. To amend Point a, Clause 2 as follows:

“a) The enterprise shall submit one dossier set made under Clause 1 of this Article directly or via the postal system to the Ministry of Industry and Trade or through the online form on the National Public Service Portal;”.

2. To amend Point c, Clause 2 as follows:

“c) Within 5 working days after receiving a complete and valid dossier, the Ministry of Industry and Trade shall consider and re-grant the certificate of eligibility for automobile manufacture or assembly to the enterprise, using Form No. 04 provided in Appendix II to this Decree. In case of refusal to re-grant the certificate, the Ministry of Industry and Trade shall issue a written reply clearly stating the reason.”.

Article 6. To annul Clauses 2 and 3 of Article 14.

Article 7. To amend and annul a number of points of Article 16

1. To annul Point b, Clause 2.

2. To amend Point a, Clause 3 as follows:

“a) The enterprise shall submit one dossier set made under Clause 2 of this Article directly or via the postal system to the Ministry of Industry and Trade or through the online form on the National Public Service Portal;”.

3. To amend Point d, Clause 3 as follows:

“dd) Enterprises shall receive automobile import permits directly at the Ministry of Industry and Trade or by post (if they so request) or through the National Public Service Portal.”.

Article 8. To amend and annul a number of points of Article 17

1. To annul Point b, Clause 2.

2. To amend Point a, Clause 3 as follows:

“a) The enterprise shall submit one dossier set made under Clause 2 of this Article directly or via the postal system to the Ministry of Industry and Trade or through the online form on the National Public Service Portal;”.

Article 9. To amend Point a, Clause 2 of Article 18

“a) The enterprise shall submit one dossier set made under Clause 1 of this Article directly or via the postal system to the Ministry of Industry and Trade or through the online form on the National Public Service Portal;”.

Article 10. To amend and annul a number of points of Article 22

1. To annul Point b, Clause 2.

2. To amend Point a, Clause 3 as follows:

“a) An automobile warranty and maintenance facility shall submit one dossier set made under Clause 2 of this Article directly or via the postal system to the inspection agency or through the online form on the National Public Service Portal;”.

3. To amend Point dd, Clause 3 as follows:

“dd) An automobile warranty and maintenance facility may receive its certificate directly at the inspection agency or by post (if it so requests) or through the National Public Service Portal;”.

Article 11. To amend and annul a number of points of Article 23

1. To annul Point b, Clause 2.

2. To amend Point a, Clause 3 as follows:

“a) An automobile warranty and maintenance facility shall submit one dossier set made under Clause 2 of this Article directly or via the postal system to the inspection agency or through the online form on the National Public Service Portal;”.

Article 12. To amend Point a, Clause 2 of Article 24

“a) An automobile warranty and maintenance facility shall submit one dossier set made under Clause 1 of this Article directly or via the postal system to the inspection agency or through the online form on the National Public Service Portal;”.

Article 13. To amend Clause 1, Section V of Appendix I

“1. The product quality inspection line must be equipped with specialized inspection equipment corresponding to each stage of the assembly process and equipment for inspection of ex-work criteria as prescribed.”

Article 14. To replace phrases and a number of forms in Appendix II

1. To replace the phrase “the Ministry of Transport” in the legal basis section; Clause 3, Article 6; Clause 1, Article 22; Point a, Clause 1, Clause 2, Article 29; Clause 1, Article 33; Form No. 15 of Appendix II with the phrase “the Ministry of Construction”.

2. To replace the phrase “the Ministry of Natural Resources and Environment” in Clause 5, Article 29 with the phrase “the Ministry of Agriculture and Environment”.

3. To replace the phrase “the Department of Transport” in Clause 2, Article 30 with the phrase “the Department of Construction”.

4. To replace Forms No. 01, 04, 08, 09 in Appendix II respectively with Forms No. 01, 04, 08, 09 to this Decree.

Article 15. Transitional provisions

1. Certificates of eligibility for automobile manufacture and assembly and automobile import permits granted to enterprises before the effective date of this Decree shall continue to remain valid until they are replaced or re-granted.

2. Valid dossiers received by competent agencies for processing before the effective date of this Decree shall continue to be processed in accordance with the Government’s Decree No. 116/2017/ND-CP dated October 17, 2017, prescribing the conditions for manufacture, assembly and import of automobiles and provision of automobile warranty and maintenance services, as amended and supplemented under the Government’s Decree No. 17/2020/ND-CP dated February 5, 2020, amending and supplementing a number of Articles of Decrees concerning business investment conditions under the state management of the Ministry of Industry and Trade.

Article 16. Effect

1. This Decree takes effect from the date of its signing for promulgation.

2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, and chairpersons of provincial-level People’s Committees shall implement this Decree.
