DECREE

Defining the functions, tasks, powers and organizational structure of Vietnam Television

Pursuant to the Law on Organization of the Government of June 19, 2015;

Pursuant to the Government's Decree No. 10/2016/ND-CP dated February 01, 2016, on government-attached agencies;

At the request of the Minister of Information and Communications;

The Government hereby promulgates the Decree defining the functions, tasks, powers and organizational structure of Vietnam Television.

Article 1. Position and functions

1. Vietnam Television is a governmental agency - a state broadcaster, which performs the function of informing and propagating the Party's guidelines and policies as well as the State’s laws; contributes to educating people, and raising their intellectual standards and serving their spiritual life through television programs and various types of press and multimedia communications.

2. Vietnam Television is its international transaction name in English, with the abbreviation of THVN in Vietnamese and VTV in English.

3. Vietnam Television is subject to the Ministry of Information and Communications’ state management of press and television.

Article 2. Tasks and powers

1. To formulate and submit to the Government or the Prime Minister its strategies, master plans, long-term, medium-term and annual plans, and other key projects of Vietnam Television and organize to implement them after they are approved.

2. To study and propose the formulation of, and submit to the competent authorities for announcement of national standards; promulgate manufacturer standards in accordance with law provisions.

3. To organize the production of programs, transmission and broadcasting, publication and storage of television programs, online press or print press in accordance with law provisions.

4. To participate in developing development strategies and master plans for Vietnam's television system.

5. To decide on, and take responsibility for its daily broadcasting contents, programs and time volume on Vietnam Television’s program channels in accordance with law provisions.

6. To directly manage the special-use technical system of Vietnam Television for the production of programs, transmission of signals and broadcasting of programs and channels at home and abroad in accordance with law provisions.

7. To assume the prime responsibility for, and coordinate with local television stations and radio-television station in, working out plans on the production of television programs broadcasted on Vietnam Television’s channels.

8. To manage and decide on investment and construction projects under its competence according to law; to participate in appraising important schemes and projects related to its professional operations as assigned by the Prime Minister.

9. To operate on the principle of autonomy and accountability for its task performance, organizational apparatus, and number of employees; to be entitled to apply the financial and wage mechanisms applicable to enterprises in accordance with law provisions.

10. To assume the prime responsibility for, and coordinate with concerned agencies in, working out a financial mechanism for Vietnam Television suitable to its functions, tasks and powers in accordance with the law provisions, and submit it to the competent authority for promulgation.

11. To act as a representative of the owner of state capital at enterprises of which the establishment is decided by Vietnam Television, and act as a representative of the owner of the capital contribution portions at enterprises in accordance with law provisions.

12. To conduct scientific research into and apply television technological and scientific advances; to conduct international operation in terms of television and multimedia communications in accordance with law provisions.

13. To provide training and retraining in television operations in accordance with law provisions.

14. To decide on, and direct the implementation of, its administrative reform program according to the objectives and contents of the State's administrative reform program as approved by the Prime Minister or the Prime Minister.

15. To manage its organizational apparatus and number of employees, decide on appointment, re-appointment, relief of duty, recommendation and discipline; to direct the implementation of the wage regime, and mechanisms and policies on preferential treatment, training and retraining for cadres, civil servants and employees under its management according to current law.

16. To manage and use the assigned State budget and properties in accordance with law provisions.

17. To settle complaints and denunciations according to its competence; to prevent and combat corruption and waste in accordance with law provisions.

18. To organize the provision of services in accordance with law provisions.

19. To implement the mechanism on reporting to the Government, the Prime Minister, the Ministry of Information and Communications and competent agencies in accordance with law provisions.

20. To perform other tasks and exercise other powers in accordance with law provisions.

20. Vietnam Television Center in Hue City.

21. Vietnam Television Center in Da Nang City.

22. Vietnam Television Center in Nha Trang City.

23. Vietnam Television Center in Can Tho City.

24. Vietnam Television’s overseas resident bureaus established in accordance with law.

25. Program Production Technique Center.

26. Transmission and Broadcasting Technique Center.

27. Fine Arts Center.

28. Television Training Center.

29. Television Advertising and Services Center.

30. Television Technology and Informatics Center.

31. Television Magazine.

The units specified from Clause 1 thru Clause 6 of this Article shall assist the General Director. The units specified from Clause 7 thru Clause 27 are program production and broadcasting units. The units specified from Clause 28 thru Clause 31 are other non-business units.

The General Director of Vietnam Television may make a report and request for consultancy from the Prime Minister on the establishment, dissolution and reorganization of other units under his/her competence in accordance with law provisions.

The Editorial Secretariat Department shall be organized with 15 divisions; the Office, 10 divisions.

Article 4. Leadership

1. Vietnam Television is headed by the General Director and no more than 4 Deputy General Directors.

2. The General Director and Deputy General Directors of the Vietnam Television are appointed and relieved from office by the Prime Minister in accordance with law.

3. The General Director shall take responsibility before the Government and Prime Minister for all activities of the Vietnam Television. Deputy General Directors shall assist the General Director in, and take responsibility before the General Director and law for, their assigned fields.

4. The General Director shall appoint and relieve from office heads and deputy heads, and define the functions, tasks, powers, organizational structures and working relations, of units of the Vietnam Television.

Article 5. Effect

1. This Decree takes effect on the date of this signing.

2. The Government's Decree No. 18/2008/ND-CP dated February 04, 2008, defining the functions, tasks, powers and organizational structure of Vietnam Television, and the Government’s Decree No. 72/2014/ND-CP dated July 22, 2017, amending and supplementing Article 3 of the Government’s Decree No. 18/2008/ND-CP dated February 04, 2008, defining the functions, tasks, powers and organizational structure of Vietnam Television is repealed.

Article 6. Implementation responsibility

The General Director of Vietnam Television, ministers, heads of ministerial-level agencies, heads of government-attached agencies and chairpersons of People’s Committees of provinces and centrally-run cities shall implement this Decree./.
