PROVIDING FOR THE RATES AS WELL AS MANAGEMENT AND USE OF CHARGES FOR USE OF THE BACH LONG VY PORT AND ANCHORAGE AREA, HAI PHONG CITY
THE MINISTER OF FINANCE
Pursuant to the Government's Decree No. 57/2002/ND-CP of June 3, 2002, detailing the implementation of the Ordinance on Charges and Fees;
Pursuant to the Government's Decree No. 77/2003/ND-CP of July 1, 2003, defining the functions, duties, powers and organizational structure of the Ministry of Finance;
At the proposals of the People's Committee of Hai Phong city (in Official Letter No. 3897/CV-UB of August 21, 2002, and Official Letter No. 2888/CV-UB of June 28, 2004) and the director of the Tax Policy Department,
DECIDES:
Article 1.- To promulgate together with this Decision the Table of charges for use of the Bach Long Vy Port and Anchorage Area, Hai Phong city.
Subject to the charge rates provided for in this Decision are marine resource- fishing and -procuring ships, vessels that transport marine resources, cargoes being aquatic products, cargoes in service of marine resource fishing, procurement and preservation, going through the Bach Long Vy Port and Anchorage Area.
Article 2.- The Bach Long Vy Port and Anchorage Area Authority, which is assigned by competent state agencies to manage the operation of the Bach Long Vy Port and Anchorage Area, shall collect charges for use of the Bach Long Vy Port and Anchorage Area (hereinafter referred to as the charge-collecting unit) at the rates set in this Decision.
For cargo or passenger ships that call at the port, the Bach Long Vy Port and Anchorage Area Authority may collect charges for use of piers, harbors and mooring buoys within the seaport area at the rates set under the current provisions of law on maritime charges and fees.
Article 3.- Charges collected for use of the Bach Long Vy Port and Anchorage Area defined in this Decision constitute a state budget revenue, which shall be managed and used as follows:
1. The charge-collecting unit shall keep 90% of the collectable charge amount to cover charge collection expenses according to the spending contents specified at Point 4-b, Section C, Part III of the Finance Ministry's Circular No. 63/2002/TT-BTC of July 24, 2002, guiding the implementation of the existing legislation on charges and fees;
2. The charge-collecting unit shall declare and remit 10% of the collectable charge amount into the state budget, and settle it according to the provisions of the current State Budget Index and the Finance Ministry's Circular No. 63/2002/TT-BTC of July 24, 2002.
Article 4.- This Decision takes effect 15 days after its publication in "CONG BAO."
Other matters relating to charge collection, remittance, management and use not mentioned in this Decision shall comply with the guidance in the Finance Ministry's Circular No. 63/2002/TT-BTC of July 24, 2002, guiding the implementation of the existing legislation on charges and fees.
Article 5.- Charge payers, the charge-collecting unit and concerned agencies shall have to implement this Decision.
