ISSUINGREGULATIONONREGIME OF INSPECTION REPORTS

GENERAL INSPECTOR

 

Pursuant to the Law on Inspection,dated June15,2004;

Pursuant to the Law on Complaints and Denunciations dated December02,1998,the Law Amending, Supplementing the Law on Complaints and Denunciations in2004and2005;

Pursuant to the Prevention of Corruption dated November 29, 2005;

Pursuant to Decree No.55/2005/ND-CP dated April 25, 2005 of the Government regulating functions, duties, powers and apparatus organizational structure of the Government Inspectorate;

At the proposal of the Chief Inspector to the Government Inspectorate Office,

DECIDES:

Article 1.Issue together with this Decision the "Regulationonregime of inspection reports."

Article 2.Chief Inspectorof Ministries, Ministerial-level agencies, Governmentalagencies;Chief Inspectorsof provinces and cities directly under the Central Government;and the heads of departments and units under the Inspectorate of Government shall be responsible fortheimplementation ofthisprovisions.

Chief Officer ofInspectorate of Government shall be responsible for guidingandinspectingthe implementation;during theimplementationif anyproblems need tobeamendedand supplemented, it should be reported tothe Inspector Generalfordecision.

Article 3.This Decision shall take effect 15 days afteritssigningdate./.

PROVISIONS

ONREGIME OF INSPECTION REPORT
(
Issuing together with Decision No: 822/QD-TTCPdated25/4/2007of General Inspector)

 

Chapter1:

GENERAL PROVISIONS

Article 1.Reportof inspection,reception ofpeople, settlement ofcomplaints and denunciations, theprevention ofcorruption (hereinafter referred to as the inspection report) in this regulation is asummary documentto reflectfullythe results of inspection activities of ministries,branches,provinces and cities directly under the Central Government,ofthe agencies and units under themanagementof theirbranches and localities; it mustensure accuracy, objectivity, completeness, timelinessof allinspection activities on economyand society,people reception, settlement ofcomplaints and denunciations and the preventionofcorruption;build forces and other activities according to their functions and tasks of theinspectionorganizations of ministries and central branches(hereinafter referred to as theministerialinspection), inspections of provinces and cities under central authority (hereinafter referred to as the provincial inspector), inspectionofdepartments,branches;inspectionof urban and ruraldistricts, towns and provincially-run cities andinspectionin communes, wards and townships.

Article 2.Directors, Heads of units of the Government Inspectorate;Chief inspectorsat all levels andbranches; chairmenof commune People’s Committeesshallbe responsible formakingthe inspection reportsandsending to thesuperior inspection organizations and the heads of theagencies at the same level asprovided for by law for inspection, complaints and denunciations and preventionofcorruption and under this provision.

Article 3.The units of the Government Inspectorate report contentsof implementation according tothe functions and tasks assigned;provincial inspectorates report full contents ofinspection under the jurisdiction of state; ministerialinspectoratereports contents ofinspectiondirectlyimplementedbythis agency.

Article 4.Ministers,provincial People’s Committeesreport the receptionof peopleand settlement of complaints and denunciations of citizens and report results ofimplementingthe preventionofcorruption in accordance withprovisions ofthe Law on Complaints and Denunciations;and the Law on thePreventionof Corruption.

Chapter2:

CONTENTS AND REGIME OF REPORT

Article 5.Monthly inspection report (monthlyreport).

Made for the monthsof the year (exceptforMarch,June,Septemberand December).

Contents of the report:

Results of implementation of the Inspection Law, include:

Number oftheeconomic and social inspections deployedina month;

Number oftheeconomic and social inspections ended, issuance of conclusionin inthe month,specificresults (by each field, detection of violationsand proposal of handlingmeasures for economy, administration, crime.In particular, it should reportspecifically theviolations related to corruption and waste). Specify the resulttodirect the inspectionhandling ofthe competent authority;

The results of implementing the proposals on economy, administration, crime;

The results of implementing the Law on Complaints and Denunciations, include:

The situationof reception ofcitizens of thepeoplereceptionheadquarters,ofthe chairmenof People’s Committeesand the heads of all levels and sectors;number of delegationsofcrowdedpeople in a month (report specificallyeachdelegation andthe contentof complaints anddenunciations).

To receive and handlewrittencomplaints and petitions;

Verification results, conclusions and decisions of handling complaints under thejurisdiction(number of cases, number ofcases organized fordialoguebefore the conclusion, right and wrong results and settlement decisions of competent authorities).

To receive and handlewritten denunciations(specific reportson the denunciationsrelated to corruption).

Verification results, conclusions and decisions of handlingdenunciationsunder thejurisdiction(number of cases, number ofcases organized fordialoguebefore the conclusion, right and wrong results and settlement decisions of competent authorities).

Resultsof inspection,examination ofthe implementation of the Law on Complaints and Denunciations;

The results of implementing the decisionsto settle complaints and denunciations (economy, administration, crime);

Results of implementation of theLaw on Prevention of Corruption, include:

To receive and handlewrittendenunciations related to corruption (specific analysisby each fieldand subjectsdenunciated);

Results of review and issuance of documents for the preventionofcorruption (number of documents under review, number of documentsrequiredto edit, the newissuance must bespecific to eachfield...).

Resultsofdealing with corruption cases (transitionfrom the previous period, the detectionofnew case,handling resultsof economy, administration, crime...).

The number of cases related to corruption inthelocalities, ministries, branches,press agencies mentioned and handling results.

Results of implementation of specialized inspection tasks under the state management function of ministries, branches.Reportspecifically thefieldofinspection, thenumber ofinspected objects(group, individual,enterprise). Items recommended for treatment (economy, administration, crime). The results of implementing the inspection proposal.

Other contentsrelated to organizationand inspection activities; the difficulties and problems and recommendations (if any).

Monthly inspection reportshall besenttothe Government Inspectorate beforethe20thday of thereportmonth.

Article 6.Quarterly and annualinspection report:

1.Quarterlyinspection report:isa summary report on the inspection resultsofMarch and the first quarter, reportofJune and 6 months (from Januaryto June), reportofSeptember and 9 months (January to December). Contents of thequarterly inspection reportwiththe outline and report formstogetherwith instructions;

Thequarterly inspection reportshall besenttothe Government Inspectorate before before 20thof the lastmonth of the quarter.

2. Annual reports:isa summary report of inspection (Januaryto December). Contents of thesummaryreportwiththe outline and report formstogetherwith instructions.

Summary report on the inspection submitted to the Government Inspector before December 15 of report year.

Article 7. Irregular reports.

Irregular reports:are thereportsintheareas(provinces, cities), sectors(ministries, branches)ofmanagement arisingunusual, serious, complex,newcases ofthe fields of economy, social security, defense and relatedtopoliticaffectedsecurity and order directly related to the functions and tasks of theministerialinspectorate, provincial inspectorate which are required toreport to the Generalinspector fordirectingand coordinating to handle.

Content of theirregular reports should statebriefly, specifically the happeningofthe case, the cause, the remedial measures adopted, resultsoftreatmentandrecommendations, the contentsare required toconsultopinion forcoordination,anddirection of the General Inspector.

Article 8.Reportson special subjects

1.Reportson special subjects are thereports aimed at summing upthe results of operations of the branches ona fieldofinspection, settlement ofcomplaints and denunciations, prevention and fightagainst corruption, buildingofforces;Summary report on the implementation of the lawon Inspection, Law on Complaints and Denunciations, the Law on preventionofcorruption or by directionrequest of the Party and State.

The contents ofreportson special subjects shall beprovidedspecific guidance as required.

2. Summary report on the emulation,reward implemented according tothe Law on Emulation and Rewards andtheRegulationofemulationand rewardof the inspection

Article 9. The report onthe inspection program

Ministerial chiefinspectorandtheprovincialInspectoratesscheduletheinspection programofthe following yearof Ministerial Inspectorate,provincialInspectorates and submit tothe Government Inspectorate before November 15ofthe reportyear.

The report of the inspection program ofMinisterial Inspectorate,provincialInspectorates is required to have decision of approval ofministers, the provincial Chairmenof the People’s Committees.

Report on annual inspection programs and reportofregistration, emulation covenants of theMinisterial Inspectorate,provincialInspectorates sent tothe Government Inspectorate beforeJanuary31 of the report year.

Article 10. The reportuponrequestof leaders.

The Secretariat, the Politburo, National Assembly, the Government, central agencies, the Government Inspectorate require theMinisterial Inspectorate,provincialInspectorates to sendwritten report in the fastest timelimit, or the Government Inspectorate requiresspecific time limit for sending monthly,quarterly reportsforthe meetings of the National Assembly and the Government.

Article 11.Report of theMinisterial Inspectorate,provincialInspectorates sending tothe Government Inspectoratemust bethe originalwithseal and signaturesof the theMinisterial Inspectors,provincialInspectors. The reportsmust includethefull formsasprescribed for each type of report.

Article 12. The content and reportregimeofthe departments,units.

Directors, heads of units under the Government Inspectorate, must report weeklytheperformance oftasks in the week andthe workingplanof the following week ofthe units andsend toleadersofthe Government Inspectorate before14pm ofthe 6th day of the week.

Report the monthly,quarterly worksof thedepartmentsand units of the Government Inspectorate, contentof self-criticism;and evaluate the results of theperformance under theplanassigned, the difficulties, and problems, recommendations;suggest leadersofGovernment Inspectorateto settle, and identify the tasks of thefollowingmonth, quarter.

Monthly reports, quarterly reportssent toInspector General (viathe Office) before the 20th day of the report month.

Article 13.Government Inspectorate encourages the application of information technology in the informationwork, the inspection report.

Article 14.The observance of the provisions on report information regime, thereporttime limit is the standardto be considered to rewardthe emulation titles of the inspection organizations.

Chapter3:

IMPLEMENTATION PROVISIONS

Article 15.The management and copyofreports.

OfficeofGovernment Inspectoratehandlingin accordance withprovisions onthe management of documents and materials; is responsible for thecopyof the inspection report upon request.

The management and use of inspection reports in accordance with the lawregulationson protection of State archives.

Article 16.Chief Inspectors of Ministries, the provincial inspectors based onprovisions of this regimeofinformation, report shall specify thecommunication,report to theorganizations ofinspectionof ministries, sectors andtheirlocalities.

Article 17.Chiefofficer ofGovernment Inspectorateis responsible for organizing, guiding, monitoring,urging,inspecting the inspectionorganizations of ministries, provincial inspectorate, thedepartments,units of Government Inspectorate in implementation of report,information regime according to thisprovision.

The provisions of the previous inspection reportareannulled./.
