DECISION
PROMULGATING THE LIST OF ENERGY CONSUMPTION VEHICLES, EQUIPMENT FOR DISPOSAL AND BAN ON CONSTRUCTION OF LOW-EFFICIENCY POWER PLANTS
Pursuant to the Law on Government organization dated December 25, 2001;
Pursuant to the Law on effective and economical use of energy dated June 28, 2010;
Pursuant to the Prime Minister’s Decree No. 21/2011/ND-CP dated March 29, 2011 detailing the implementation of the Law on effective and economical use of energy;
At the proposal of the Minister of Science and Technology;
The Prime Minister promulgates the Decision on the list of low-efficiency energy consumption vehicles, equipment for disposal and ban on the construction of low-efficiency power plants
Article 1.The list of low-efficiency energy consumption vehicles, equipment for disposal and ban on construction of low-efficiency power plants comprise:
1. Household appliances: fluorescent lamps (tube type), compact fluorescent lamps, magnetic and electronic ballasts in fluorescent lamps, refrigerators, washing machines, rice cookers, electric fans and storage water heaters.
2. Industrial equipment: distribution transformers, electric motors, and boilers used in industrial factories
3. Coal-fired, gas-fired power plants in thermo-electric plants.
Article 2.Ban on import and manufacture of equipment with energy efficiency being lower than Minimum Energy Performance Standards (MEPS):
1. Household appliances:
Energy efficiency should not be lower than MEPS as defined in Vietnam’s Standards as follows:
a) Compact fluorescent lamps: | TCVN 7896:2008; |
a) Fluorescent lamps (tube type): | TCVN 8249:2009; |
a) Electronic ballasts in fluorescent lamps: | TCVN 7897:2008; |
a) Magnetic ballasts in fluorescent lamps: | TCVN 8248:2009; |
dd) Refrigerators: | TCVN 7828:2013; |
e) Washing machines: | TCVN 8526:2010; |
g) Rice cookers: | TCVN 8252:2009; |
h) Electric fans: | TCVN 7826:2007; |
i) Storage water heaters: | TCVN 7898:2009; |
2. Industrial equipment:
Energy efficiency should not be lower than MEPS as defined in Vietnam’s Standards as follows:
a) Distribution transformers: | TCVN 8525:2010; |
g) Electric motors: | TCVN 7450-1:2005; |
e) Boilers used in industrial factories: | TCVN 8630:2010; |
Article 3.Ban on the construction of coal-fired, gas-fired power plants with obsolete technology and energy efficiency at the date of initial operation being lower than MEPS as follows:
1. For coal-fired power plants, gross capacity at low calorific value at rated power of the power plants reduced to inlet water cooling temperature 28°C and environmental temperature 30oC should not be lower than the following values:
- Power plants with rated power ≥ 50MW and < 150MW: 34%
- Power plants with rated power ≥ 150MW and < 300MW: 38%
- Power plants with rated power ≥ 300MW and < 600MW: 39%
- Power plants with rated power ≥ 600MW and < 800MW: 41%
- Power plants with rated power ≥ 800MW: 43%
2. For gas fired power plants using simple cycle gas turbine, capacity of turbine assembly (ISO conditions) should not be lower than the following values:
- Power plants with rated power ≥ 100MW and < 150MW: 33%
- Power plants with rated power ≥ 150MW and < 200MW: 34%
- Power plants with rated power ≥ 200MW and < 300MW: 37%
- Power plants with rated power ≥ 300MW: 39%
3. For gas fired power plants using combined cycle gas turbine, capacity of turbine assembly (at ISO conditions) according to capacity of individual simple cycle gas turbine should not be lower than the following values:
- Power plants with rated power ≥ 100MW and < 150MW: 49.5%
- Power plants with rated power ≥ 150MW and < 200MW: 51.0%
- Power plants with rated power ≥ 200MW and < 300MW: 55.5%
- Power plants with rated power ≥ 300MW: 58.5%
Article 4.Ban on the import of outdated and obsolete equipment used in power plants with capacity of machine assembly exceeding the limit as stipulated in Article 3 hereof; Granting of construction permit for such power plants shall be considered separately and approved by competent agencies.
Article 5.Implementation process
1. For household appliances and industrial equipment:
As of January 01, 2015, any equipment with energy efficiency being lower than MEPS shall be banned from being imported and manufactured.
2. Since the effective date of this Decision, any investment in the construction of coal, gas fired power plants with energy efficiency being lower than MEPS shall be banned according to the provisions set out in Article 3 hereof.
Article 6.Implementation
1. The Ministry of Science and Technology shall:
a) Cooperate with the ministries, ministerial-level agencies, Governmental agencies, People’s Committee of central-affiliated cities and provinces in instructing, examining and monitoring the implementation of this Decision;
b) Cooperate with relevant ministries and departments in making submission to the Prime Minister for amendments and supplements to the list of low-efficiency vehicles and equipment for disposal and ban on the construction of low-efficiency power plants based on socio-economic development and state management requirements in each period of time.
2. The Ministry of Industry and Trade shall:
a) Cooperate with the Ministry of Science and Technology in instructing, examining and monitoring the disposal of low-efficiency energy consumption vehicles and equipment subject to disposal and the ban on the construction of low-efficiency power plants as stipulated hereof;
a) Cooperate with the Ministry of Finance, Ministry of Planning and Investment, Ministry of Science and Technology in establishing and developing measures to facilitate the disposal of all low-efficiency energy consumptionvehiclesand equipment subject to disposal and enable the ban on the construction of low-efficiency power plants as stipulated hereof;
3. Ministries, sectors and localities, within their scope of management, shall lead the disposal of low-efficiency energy consumption vehicles and equipment subject to disposal and enable the ban on the construction of low-efficiency power plants as stipulated hereof;
Article 7.This Decision takes effect since February 10, 2014.
Article 8.Ministers, Heads of ministerial-level agencies, Heads of Governmental agencies, the Presidents of People’s Committees of central-affiliated cities and provinces, heads of relevant agencies, organizations, enterprises and individuals shall be responsible for executing this Decision.
