Decision No. 72/2005/QD-BNN dated November 14, 2005 of the Ministry of Agricultural and Rural Development promulgating the list of objects subject to plant quarantine of the Socialist Republic of Vietnam

DECISION

PROMULGATING THE LIST OF OBJECTS SUBJECT TO PLANT QUARANTINE OF THE SOCIALIST REPUBLIC OF VIETNAM

THE MINISTER OF AGRICULTURAL AND RURAL DEVELOPMENT

Pursuant to Decree No.86/ 2003/ND-CP dated July 18, 2003 the Government on the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to 2001 Ordinance on Plant Protection and Quarantine;

At the proposal of the director of the Plant Protection Department,

DECIDES:

Article 1.

To promulgate the Socialist Republic of Vietnam's list of objects subject to plant quarantine, including:

1. Plants:

Trees and their live parts used for breeding purpose or other purposes.

2. Plant products:

a) Tubers, fruits, seeds, flours, fibers, and dried flowers of all kinds;

b) Broken grains, bran, mushroom, oil-cake, and material medica of all kinds;

c) Tobacco leaves and stems, tobacco shreds, beer yeast, liquor yeast, livestock feed yeast, tea, cotton, coconut fiber, sliced cassava, rattan, bamboo, sedge, mats, rice straw and stem, hay, water hyacinth, and sea plants;

d) Timber and timber products (except for timber and timber products already processed by soaking, chemical impregnation or heating under high pressure);

e) Handicrafts and fine-arts of plant origin;

f) Assorted packages of plant origin;

g) Livestock feed of plant origin.

3. Fish paste, silkworm cocoon without silk, silkworm cocoon, feather, skin, bone, horn, nail, and lac.

4. Assorted insects, spider, causal fungus, nematode, bacterium, virus, weeds, and assorted herbarium in service of expertise, training, biological prevention and scientific research.

5. Means of transport, equipment for production and preservation of objects subject to plant quarantine, and other objects capable of carrying objects subject to plant quarantine.

Article 2.

For export objects subject to plant quarantine specified in Article 18 of the Government's Decree No. 58/2002/ND-CP dated June 3, 2002, promulgating the Regulation on Plant Protection, the Regulation on Plant Quarantine and the Regulation on Management of Plant Protection Drugs, they shall be quarantined at the request of customers or in accordance with treaties to which Vietnam has signed or acceded, to which contain quarantine requirements.

Article 3.

This Decision takes effect 15 days after its publication in CONG BAO and replaces Decision No. 56/2001/QD-BNN dated May 23, 2001, of the Minister of Agriculture and Rural Development, publicizing the list of objects subject to plant quarantine upon their export, import, temporary import for re-export, temporary export for re-import or transit in the Socialist Republic of Vietnam.

Article 4.

The director of the Office, the director of the Plant Protection Department, heads of relevant units, and concerned individuals shall have to implement this Decision.
