DECISION
PROMULGATING THE LIST OF EQUIPMENT, MACHINERY AND SPECIAL-USE TRANSPORT MEANS WHICH CAN BE PRODUCED AT HOME; THE LIST OF CONSTRUCTION MATERIALS WHICH CAN BE PRODUCED AT HOME; THE LIST OF SUPPLIES IN SERVICE OF THE OIL AND GAS DEPOSIT PROSPECTION, EXPLORATION AND DEVELOPMENT, WHICH CAN BE PRODUCED AT HOME
THE MINISTER OF PLANNING AND INVESTMENT
Pursuant to the Government’s Decree No. 61/2003/ND-CP of June 6, 2003, defining the functions, tasks, powers and organizational structure of the Ministry of Planning and Investment;
Pursuant to the Government’s Decree No. 79/2000/ND-CP of December 29, 2000 detailing the implementation of the Value Added Tax Law and Decree No. 76/2002/ND-CP of September 13, 2002 amending and supplementing a number of articles of the Government’s Decree No. 79/2000/ND-CP of December 29, 2000 detailing the implementation of the Value Added Tax Law.
Pursuant to the Government’s Decree No. 24/2000/ND-CP of July 31, 2000 detailing the implementation of the Law on Foreign Investment in Vietnam and Decree No. 27/2003/ND-CP of March 19, 2003 amending and supplementing a number of articles of Decree No. 24/2000/ND-CP of July 31, 2000, detailing the implementation of the Law on Foreign Investment in Vietnam;
Pursuant to the Government’s Decree No. 48/2000/ND-CP of September 12, 2000 detailing the implementation of the Petroleum Law;
At the proposals of the concerned ministries and branches,
DECIDES:
Article 1.- To promulgate together with this Decision the list of equipment, machinery and special-use transport means which can be produced at home; the list of construction materials which can be produced at home; and the list of supplies in service of the oil and gas deposit prospection, exploration and development, which can be produced at home.
1. The list of equipment, machinery and special-use transport means which can be produced at home shall be used as a basis for distinction from:
a/ Equipment, machinery and special-use transport means which cannot be produced at home and need to be imported for the formation of fixed assets of enterprises not liable to value added tax as prescribed in Clause 4, Article 4 of the Government’s Decree No. 79/2000/ND-CP of December 29, 2000, detailing the implementation of the Value Added Tax Law; and Item a, Clause 2, Article 60 of the Government’s Decree No. 24/2000/ND-CP of July 31, 2000, detailing the implementation of the Law on Foreign Investment in Vietnam;
b/ Equipment, machinery, spare parts, special-use transport means which cannot be produced at home and need to be imported for carrying out oil and gas deposit prospection, exploration and development activities not liable to value added tax as prescribed in Clause 4, Article 4 of the Government’s Decree No. 79/2000/ND-CP of December 29, 2000, detailing the implementation of the Value Added Tax Law; and Clause 1, Article 55 of the Government’s Decree No. 48/2000/ND-CP of September 12, 2000, detailing the implementation of the Petroleum Law;
2. The list of construction materials which can be produced at home shall be used as a basis for distinction from those kinds of construction materials which cannot be made at home and need to be imported for the formation of fixed assets of enterprises which:

3. The list of supplies in service of the oil and gas deposit prospection, exploration and development, which can be produced at home, shall be used as a basis for distinction from those kinds of supplies which cannot be produced at home and need to be imported for carrying out oil and gas deposit prospection, exploration and development activities which:
a/ are not liable to valued added tax as prescribed in Clause 4, Article 4 of the Government’s Decree No. 79/2000/ND-CP of December 29, 2000 detailing the implementation of the Value Added Tax Law; and Clause 1, Article 55 of the Government’s Decree No. 48/2000/ND-CP of September 12, 2000, detailing the implementation of the Petroleum Law;
b/ are exempt from import tax as prescribed in Clause 1, Article 54 of Government’s Decree No. 48/2000/ND-CP of September 12, 2000, detailing the implementation of the Petroleum Law.
Article 2.- In the course of using the lists, if the customs offices’ opinions are different from those of enterprises, the customs offices shall coordinate with the provincial/municipal Planning and Investment Services in considering and handling the differences. If there remain any unresolved differences, the General Department of Customs shall propose the Ministry of Planning and Investment to consider and make decisions or amend and/or supplement the lists.
Article 3.- The list of equipment, machinery and special-purpose transport means which can be produced at home; the list of construction materials which can be produced at home; and the list of supplies in service of the oil and gas deposit prospection, exploration and development, which can be produced at home, promulgated together with this Decision, shall be considered and supplemented to suit the practical situation at the proposals of specialized State management bodies.
Article 4.- This Decision replaces Decisions No. 214/1999/QD-BKH of April 26, 1999; No. 462/2000/QD-BKH of September 15, 2000; No. 227/QD-BKH of May 17, 2001, and No. 229/2001/QD-BKH of May 18, 2001, already promulgated by the Minister of Planning and Investment, and takes effect 15 days after its publication in the Official Gazette.
