DECISION
APPROVING THE FEASIBLE INVESTMENT PROJECT FOR THE CONSTRUCTION OF PU MAT NATIONAL PARK, NGHE AN PROVINCE
THE PRIME MINISTER
Pursuant to the Law on Organization of the Government of December 25, 2001;
Pursuant to the Law on Forest Protection and Development of August 12, 1991;
Pursuant to the Prime Minister’s Decision No. 174/2001/QD-TTg of November 8, 2001 on upgrading Pu Mat nature conservation zone, Nghe An province, into a national park;
Considering the proposals of the Ministry of Planning and Investment (Official Dispatch No. 3438 BKH/VPTD of May 31, 2002) and of the People’s Committee of Nghe An province (Report No. 364 TT/UB of January 31, 2002),
DECIDES:
Article 1.- To approve the feasible investment project for the construction of Pu Mat national park, Nghe An province, with the following major contents:
1. The project’s name: Feasible investment project for the construction of Pu Mat national park, Nghe An province.
2. The project-managing agency: The People’s Committee of Nghe An province.
3. The investor: The Management Board of Pu Mat national park, Nghe An province.
4. The project execution duration: 10 years, from 2002 to 2011.
5. Objectives:
- To conserve and preserve the natural forests, typical of the ecological system of primary forests belonging to tropical wet forests in north Truong Son of Vietnam.
- To conserve the bio-diversity with 1,792 flora and 938 fauna species, of which many rare and precious ones are in the danger of extinction, including 37 plant species listed in Vietnam’s Red book and 20 in the World’s Red book and 77 animal species listed in Vietnam’s Red book and 62 in the World’s Red book.
- To enhance the function of headwater protection forests for Ca river system in direct service of production and daily-life activities of the local population communities.
- To develop and expand ecological tourism, create conditions for the local people to have more jobs and increase incomes, thus contributing to hunger elimination and poverty alleviation and, at the same time raising the people’s awareness of natural resource and environment protection.
- To attract international aid sources for nature conservation purposes.
6. The project scope and scale:
The project shall be executed in the whole area of 91,170 ha managed by Pu Mat national park, including the strictly-protected sub-zone of 89.517 ha, the ecological rehabilitation sub-zone of 1,596 ha, the administrative-service sub-zone of 57 ha (in Chi Khe commune, Con Cuong rural district, Nghe An province), and a number of construction works: traffic roads, the power transmission lines from the main axis to the national park as well as the relocation of population from the strictly-protected sub-zone of the national park shall be executed in the communes lying within the buffer zone of the national park.
7. Investment contents: The project shall invest in several action programs of the national park, including:
a) The protection program: shall be tasked to well protect the existing 91,113 ha of forests and forest land as well as rare, precious and endemic indigenous fauna and flora species and species being in the danger of extinction, comprising the following operation contents:
- To arrange personnel at fixed control stations and organize mobile patrol forces.
- To build botanical gardens.
- To deploy conservation activities with the participation of people.
- To effect the contractual assignment of forest protection to households, individuals and population communities living the buffer zones and areas adjacent to the national park.
b) The ecological rehabilitation program:
- To zone off natural forest for tending and regeneration in the area of 961 ha of the ecological rehabilitation sub-zone I
- To plant and enrich the forest with indigenous trees in the area of 635 ha of the ecological rehabilitation sub-zone II.
- To build a nursery for indigenous trees, an animal rescue center, a semi-wild animal-nurturing area, and create new places for wild animals.
c) The scientific research program:
- To conduct comprehensive surveys of and research into the forest ecological system of the national park.
- To research into typical forest types and rare, precious, and endemic fauna and flora species of the national park such as fokienia hodginsii, cunninghamia chinensis of plant species, and pseudoryx nghetinhsis, elephants, tigers of animal species.
- To study and evaluate the situation of trading in and use of forestry products, as well as the hunting of wild animals in the region.
d) The training, education and propagation program:
- Personnel training: To train the national park’s managers, tourism administrators, researchers, conservation workers, ecological tourist guides and other workers of the national park with a view to raising their professional qualifications for better performance of their assigned tasks.
- To train collaborators in villages and hamlets for participation in the activities of propagating and mobilizing the local people to actively take part in the protection of forests and ecological environment.
- To organize study tours on nature conservation at home and abroad.
- To organize conferences and seminars in order to exchange and disseminate information and experiences on the management, protection and development of the national park; to create a website of the national park.
e) The population relocation program:
To relocate 163 households of Dan Lai ethnic minority from the strictly-protected sub-zone of the national park to Con Cuong rural district, Nghe An province; to ensure better living conditions for those households as compared to those in their former places.
f) The ecological tourism program: To build some ecological tourist routes and points in the national park with a view to attracting domestic and international tourists, including: the central tourist resort in the administrative-service sub-zone; the tourist routes: Thac Kem, Pha Lai-Song Giang; and Sang Le forest tourist resort.
g) Investment in infrastructure construction and equipment:
- To invest in infrastructure construction and equipment in order to stabilize the working places for officials and employees of the national park, ensuring essential infrastructure works and facilities for them to perform the tasks of managing and protecting forests in the whole area of forests and forest land managed by the park, and, at the same time contributing to socio-economic development for people in the national park’s buffer zone, and attracting tourists.
- Construction works include: The system of works (working offices, dwelling houses, guest houses, meeting hall, expansion and upgrading of museum and support works) for the National Park Office in the administrative-service sub-zone; traffic roads (including bridges and sluices); and power lines.
8. On capital sources and investment mechanism:
- The project shall be invested with the following capital sources:
+ The State budget capital.
+ Aids from international organizations.
+ The State’s investment credit capital.
For the investment capital from the State budget, it is necessary to clearly declare investment capital and public-service capital (regular expenditures, including non-investment activities). For capital borrowed from the State’s investment credit (for investment in the tourism program), it is necessary to elaborate a specific project and clearly explain the debt repayment capability, the borrowing of capital for investment shall be effected only when the debt repayment capability is ensured.
Based on the objectives of the project, investment contents of the programs prescribed in Article 1 of this Decision, capital mobilization capability, and the necessity of each construction work and investment item, the People’s Committee of Nghe An province shall direct the investor to elaborate and submit constituent projects to competent authorities for approval (before submitting them to competent authorities for approval, the investor shall have to consult the Ministry of Planning and Investment, the Ministry of Finance and the Ministry of Agriculture and Rural Development).
A number of construction works and equipment, which are not subjects of first priority, shall be deployed in the early years of the project after the project is approved, provided that the project on social forestry and nature conservation (SFNC) in Nghe An province is executed with the source of aid capital from the European Community, already put on the agenda or committed to support.
- For the buffer zone of Pu Mat national park: It is necessary to elaborate a separate project in order to consider the investment therein in a comprehensive manner, aiming to develop socio-economic conditions, improve the living standards of ethnic minority people living around the park, reduce negative impacts on the forest resources managed by the national park and the forest resources in the locality; and, at the same time to prepare conditions for the deployment of the second stage of the social forestry and nature conservation project financed by the European Community.
- Annually, the Ministry of Planning and Investment shall, basing itself on the constituent projects already approved by the competent authorities, inscribe investment capital for these projects into separate accounts under the overall investment project on the construction of Pu Mat national park, Nghe An province.
- The Ministry of Finance shall guide the budget capital allocation mechanism suitable to the peculiarities of the assorted constituent projects, so as to ensure the smooth implementation of the project and the strict capital management.
- The investment projects shall have to strictly comply with the current regulations on construction and investment management.
Article 2.- This Decision takes effect 15 day after its signing.
Article 3.- The Minister of Planning and Investment, the Minister of Finance, the Minister of Agriculture and Rural Development, the Minister for Foreign Affairs, the Minister of Science, Technology and Environment, Vietnam State Bank Governor, the General Director of Land Administration, the heads of the concerned agencies and the president of the People’s Committee of Nghe An province shall have to implement this Decision.
