DECISION
ON THE EXPAND 12 SPECIES INTO THE LIST OF PROTECTED SPECIES IN VIETNAM AND THE ASSIGNMENT OF ORGANIZATIONS TO IMPLEMENTED DUS GROWING TEST.
THE MINISTER OF MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT (MARD)
Based on the Decree No 86/2003/NĐ-CP on 18th July, 2003 of the Government on stipulation of the functions, scopes and organizational frame of MARD;
Based on the Intellectual Property Law No 50/2005/QH11 issued on November, 29th , 2005;
Based on the Decree No 104/2006/NĐ-CP on 22nd September, 2006 on the detail stipulations and instruction of the implementation of some Articles of Intellectual Property Law on the Plant Breeder’s Right;
According to the Proposal of Director of Department of Crop Production.
DECISION:
Article 1. Supplement 12 species mentioned below to the List of Protected Species:
1. Orange (Citrus L.) (Rutaceae) | 7. Gerbera (Gerbera Cass.) |
2. Strawberry (Fragaria L.) | 8. Gladiolus (Gladiolus L.) |
3. Pepper (Capsicum anmum L.) | 9. Lily (Lilium L.) |
4. Pumpkin (Cucurbita maxima Duch.) | 10. Dianthus (Dianthus L.) |
5. Ginger (Zingiber officinale Rosc.) | 11. Carrot (Daucus carota L.) |
6. Mango (Mangifera Indica L.) | 12. Sugar - cane (Saccharum L.) |
Article 2. The following Organizations will be assigned to conduct of the Trial Growing Test for Distinctness, Uniformity and Stability (DUS Test) for the species mentioned at Article 1.
1. National Center for Testing of Variety, Crop’s Products and Fertilizers will be in charge of conducting DUS Test for Sugar - cane;
2. Research Institute for Vegetable and Fruits of Viet Nam Agriculture Academic Science Institute (VAAS) conduct DUS Test for Pepper, Lily, Gerbera, Carnation;
3. Dalat Research Center for Potato, Vegetable and Flower of Southern Agriculture and Science Research Institute to conduct DUS Test for Gladiolus, Carrot and Strawberry;
4. Southern Research Institute for Fruits responsible to conduct the DUS Test for Mango and Orange;
5. Plant Resource Center of Viet Nam Agriculture Academic Science Institute (VAAS) conduct DUS Test for Ginger and Pumpkin;
Article 3. This Decision enter into force after 15 days after publicize on National Gazette.
