Decision No. 55/2013/QD-TTg of October 3, 2013, providing levels of vocational training support for employees on unemployment allowance
THE PRIME MINISTER
Pursuant to the December 25, 2001 Law on Organization of the Government;
Pursuant to the June 29, 2006 Law on Social Insurance;
Pursuant to the November 29, 2006 Law on Vocational Training;
Pursuant to the Government’s Decree No. 127/2008/ND-CP of December 12, 2008, detailing and guiding a number of articles of the Law on Social Insurance regarding unemployment insurance;
Pursuant to the Government’s Decree No. 100/2012/ND-CP November 21, 2012, amending and supplementing a number of articles of Decree No. 127/2008/ND-CP;
At the proposal of the Minister of Labor, War Invalids and Social Affairs,
The Prime Minister promulgates the Decision providing levels of vocational training support for employees on unemployment allowance.
Article 1.Scope of regulation
This Decision provides levels of vocational training support for employees on unemployment allowance.
Article 2.Subjects of application
1. Employees enjoying unemploymentallowance under the Law on Social Insurance.
2. Vocational training centers, vocational intermediate schools and colleges; professional secondary schools, colleges, universities and other education institutions under the education law; provincial-level Labor, War Invalids and Social Affairs Departments’ centers for employment introduction; enterprises, cooperatives, and other production, business and service establishments that have vocational training registration certificates under the vocational training law (below collectively referred to as vocational training institutions) engaged in providing vocational training for employees on unemployment allowance.
3. Provincial-level Labor, War Invalids and Social Affairs Departments; social insurance agencies and agencies involved in vocational training support for employees.
Article 3.Levels,duration and mode of vocational training support
1. Levels of vocational training support for employees on unemployment allowance:
a/ For an employee attending a vocational training course for up to 3 months: The maximum level of support is VND 3,000,000/employee/course. Specific levels of support are calculated by month on the basis of each occupation and the actual training duration.
b/ For an employee attending a vocational training course for over 3 months: The maximum level of support is VND 600,000/employee/month. Specific levels of support are calculated by month on the basis of each occupation and the actual training duration.
2. Employees on unemployment allowanceattending vocational training with the cost higher than the levels of support specified in Clause 1 of this Article shall pay the difference.
3. The duration of vocational training support depends on the time of training for each occupation and employee, but must not exceed 6 months.
4. Employees on unemployment allowance attending vocational training shall be supported the cost of vocational training once for one occupation through vocational training institutions. No monetary support will be provided for employees for vocational self-training.
Article 4.Funds for implementation
Vocational training support is paid from the unemployment insurance fund by the Vietnam Social Security.
Article 5.Organization of implementation
The Ministry of Labor, War Invalids and Social Affairs shall assume the prime responsibility for, and coordinate with the Ministry of Finance and related agencies in, guiding the implementation of this Decision.
Article 6.Effect and implementationresponsibility
1. This Decision takes effect on December 1, 2013, and replaces previous regulations on levels of vocational training support for employees on unemployment allowance.
2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies and chairpersons of provincial-level People’s Committees shall implement this Decision.-
