DECISION
ON AUTHORIZATION TO DECIDE THE SALE, BUSINESS CONTRACTING OR LEASE OF STATE ENTERPRISES POSSESSING THE STATE CAPITAL OF BETWEEN 1 BILLION VND AND UNDER 5 BILLION VND
THE PRIME MINISTER
Pursuant to the Law on Organization of the Government of September 30, 1992;
Pursuant to the Government’s Decree No. 103/1999/ND-CP of September 10, 1999 on assigning, selling, business contracting or leasing State enterprises;
At the proposal of the Head of the Central Board for Renewal of Enterprise Management,
Pursuant to the Government’s Decree No. 103/1999/ND-CP of September 10, 1999 on assigning, selling, business contracting or leasing State enterprises;
At the proposal of the Head of the Central Board for Renewal of Enterprise Management,
DECIDES:
Article 1.- To authorize the ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government, the presidents of the People’s Committees of the provinces and centrally-run cities and the Management Boards of Corporations 91 to decide the sale, business contracting or lease of State enterprises under their respective management, which have possessed a State capital of between 1 billion VND and under 5 billion VND and suffered from prolonged losses but not yet fallen into the state of bankruptcy; except for enterprises being State farms, forestry farms and State enterprises engaged in the fields of consultancy, design and expertise.
Article 2.- Annually, basing themselves on the already approved overall plan for restructuring State enterprises, the ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government, the presidents of the People’s Committees of the provinces and centrally-run cities and the Management Boards of Corporations 91 shall report to the Prime Minister on the plan for and situation of implementing the sale, business contracting or lease of State enterprises as mentioned in Article 1 of this Decision.
Article 3.- The authorized persons shall have to coordinate with the concerned ministries, branches and agencies in handling matters relating to labor, finance, regime and policies towards the enterprises being transformed in the above-mentioned forms, ensuring the compliance with current laws.
Article 4.- This Decision takes effect 15 days after its signing.
The ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government, the presidents of the People’s Committees of the provinces and centrally-run cities, the Management Boards of Corporations 91 and the heads of the concerned agencies shall have to implement this Decision.
