DECISION
Promulgating the Plan on organization of the implementation of the Law on Survey and Mapping[1]
THE PRIME MINISTER
Pursuant to the June 19, 2015 Law on Organization of the Government;
Pursuant to the June 14, 2018 Law on Survey and Mapping;
At the proposal of the Minister of Natural Resources and Environment,
DECIDES:
Article 1. To promulgate together with this Decision the Plan on organization of the implementation of the Law on Survey and Mapping.
Article 2. This Decision takes effect on the date of its signing.
Article 3. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, and chairpersons of provincial-level People’s Committees shall implement this Decision.-

PLAN
On organization of the implementation of the Law on Survey and Mapping
(Promulgated together with the Prime Minister’s Decision No. 415/QD-TTg
of April 12, 2019)
I. PURPOSES AND REQUIREMENTS
1. Purposes
a/ To identify specific work contents, and schedules and time limits for their completion as well as responsibilities of agencies and organizations involved in the organization of the implementation of the Law on Survey and Mapping (below referred to as the Law), ensuring its timeliness, synchronism, consistency and effectiveness.
b/ To build a mechanism for coordination among ministries, ministerial-level agencies, government-attached agencies and provincial-level People’s Committees in organizing the implementation of the Law nationwide.
2. Requirements
a/ To follow the direction of the Government and Prime Minister in organizing the implementation of the Law.
b/ To identify work contents associated with responsibilities and bringing into play the proactive and active role of ministries, ministerial-level agencies, government-attached agencies and provincial-level People’s Committees according to their responsibilities assigned in the Law, ensuring the quality and schedule for completion of work.
c/ To ensure the regular and effective coordination among ministries, ministerial-level agencies, government-attached agencies, provincial-level People’s Committees and related organizations in organizing the implementation of the Law.
d/ To make detailed implementation plans to ensure the complete, uniform and synchronous implementation of the Law nationwide.
dd/ To regularly and promptly examine and urge, and guide the settlement of problems arising in the course of, the implementation of the Law to ensure its progress and effectiveness.
II. CONTENTS ON, AND RESPONSIBILITIES FOR, ORGANIZATION OF THE IMPLEMENTATION OF THE LAW
1. To disseminate the Law and documents detailing the Law
a/ At the central level
The Ministry of Natural Resources and Environment shall assume the prime responsibility for, and coordinate with ministries, ministerial-level agencies, government-attached agencies and related agencies in, organizing meetings on the implementation of the Law; disseminating the Law and documents detailing and guiding the implementation of the Law through specialized sections, programs, training courses, and compilation of materials, and in other forms in accordance with the law on law dissemination and education.
b/ At the local level
Provincial-level People’s Committees shall disseminate the Law and documents detailing the Law in forms suitable to their local practical conditions, specific target groups and geographical areas (through integrating special subjects into contents of workshops and training courses and updating legal knowledge under plans on law dissemination and education).
c/ Time of implementation: 2019 and subsequent years.
2. To review current legal documents on survey and mapping activities; to propose amending, supplementing, replacing or annulling existing legal documents or promulgating new ones in conformity with the Law.
a/ At the central level
- Responsible agency: The Ministry of Natural Resources and Environment shall act as the focal point in summarizing review results and reporting them to the Prime Minister;
- Coordinating agencies: Ministries, ministerial-level agencies, government-attached agencies and related agencies shall conduct review and send review results to the Ministry of Natural Resources and Environment.
- Time of completion:
+ The review results of ministries, ministerial-level agencies, government-attached agencies and related agencies shall be sent directly to the Ministry of Natural Resources and Environment in August 2019.
+ The Ministry of Natural Resources and Environment shall report the review results to the Prime Minister in September 2019.
b/ At the local level
- Provincial-level People’s Committees shall review documents promulgated by them according to competence, and submit review results to the Ministry of Natural Resources and Environment.
- Time of completion: August 2018.
3. To build, improve and announce data on national geodetic networks
- The Ministry of Natural Resources and Environment shall assume the prime responsibility for, and coordinate with localities in, reviewing and assessing the current status of data on national geodetic networks to serve as the basis for building and improving the data system of national geodetic networks, consisting of data of the national coordinate network, national elevation network, national gravity network and network of national satellite positioning stations; and announce data on national geodetic networks;
- Implementation duration: from 2019 through 2022.
4. To build and update the national fundamental geographic database and establish the national topographical map system
a/ The Ministry of Natural Resources and Environment shall assume the prime responsibility for:
- Building the national fundamental geographic database and national topographical map system the mainland of 1:10,000 and smaller scales;
- Building the databases and national topographic maps of islands, archipelagos and peninsulas and seabed topographic maps of 1:10,000 and smaller scales.
b/ Provincial-level People’s Committees shall assume the prime responsibility for, and coordinate with the Ministry of Natural Resources and Environment in, building the national fundamental geographic database and national topographical maps of 1:2,000 and 1:5,000 scales for land areas, islands, archipelagoes, estuaries and seaports under their management.
c/ Duration for completing the building of the national fundamental geographic database and establishment of the national topographical map system: from 2019 through 2022.
d/ Time for updating of the national fundamental geographic database and national topographical map system for areas for which such database and system are available: from 2019.
5. To build survey and mapping databases on national boundaries, and establish a set of standard national boundary maps
a/ Building survey and mapping databases on national boundaries
- Responsible agency: Ministry of Natural Resources and Environment;
- Coordinating agencies: Ministry of National Defense, Ministry of Foreign Affairs, Ministry of Public Security and provincial-level People’s Committees of the bordering localities.
b/ Establishing a set of standard national boundary maps
- Responsible agency: Ministry of Natural Resources and Environment;
- Coordinating agencies: Ministry of National Defense, Ministry of Foreign Affairs and provincial-level People’s Committees of the bordering localities.
c/ Time of implementation: from 2019 and after signing documents on border demarcation and border marker planting in the mainland between Vietnam and neighboring countries.
6. To build survey and mapping databases on administrative boundaries
- Responsible agency: Ministry of Natural Resources and Environment;
- Coordinating agencies: Ministry of Home Affairs and provincial-level People’s Committees;
- Implementation period: from 2019 through 2020. After 2020, to update the databases regularly under regulations.
7. To build the national geospatial data infrastructure
- The Ministry of Natural Resources and Environment shall assume the prime responsibility for organizing the materialization of development strategies and implementation plans for the national geospatial data infrastructure; integrating the national geospatial data; and building and operating the Vietnam Geospatial Portal;
- Ministries, ministerial-level agencies, government-attached agencies, and provincial-level People’s Committees shall organize the building of specialized data of the national geospatial data infrastructure under the Law and other relevant laws;
- Organizations and individuals shall participate in the building and development of geospatial data in accordance with law.
- Implementation durations:
+ Phase 1: From 2019 through 2021, to formulate mechanisms and policies and create resources for organizing the materialization of development strategies and implementation plans for the national geospatial data infrastructure; to formulate standards and technical regulations on the national geospatial data infrastructure; to build the Vietnam Geospatial Portal; to build and integrate framework data and specialized data;
+ Phase 2: From 2022 and subsequent years, to improve mechanisms and policies; to complete the Vietnam Geospatial Portal; to integrate geospatial data as planned; to update data regularly under regulations.
8. To conduct surveys and make specialized maps
a/ Conducting surveys and making maps related to national defense
- Responsible agency: Ministry of National Defense;
- Time of implementation: From 2019 and subsequent years to meet national defense and security requirements.
b/ Conducting surveys and making nautical charts
- The Ministry of National Defense shall conduct surveys and organize the making of nautical charts of the maritime zones of Vietnam and adjacent areas;
- The Ministry of Transport shall conduct surveys and organize the making of nautical charts of seaport waters and navigable passages and routes;
- Related ministries and ministerial-level agencies shall participate
in conducting surveys and making nautical charts as assigned by the Government;
- Time of implementation: From 2019 and subsequent years to meet socio-economic development requirements.
c/ Conducting surveys and making civil aviation maps
- Responsible agency: Ministry of Transport;
- Coordinating agencies: Ministry of National Defense and related ministries;
- Time of implementation: From 2019 and subsequent years to meet sector management and development requirements.
d/ Conducting surveys and making underground works maps
- Responsible agencies: Provincial-level People’s Committees;
- Coordinating agencies: Ministry of Construction and related agencies;
- Organizations and enterprises shall build underground works;
- Time of implementation: From 2020 and subsequent years to meet socio-economic development requirements of sectors and localities.
dd/ In addition to the activities mentioned at Points a, b, c and d above, ministries, ministerial-level agencies, government-attached agencies and provincial-level People’s Committees shall conduct specialized survey and mapping activities in accordance with the Law and relevant specialized laws.
III. ORGANIZATION OF IMPLEMENTATION
1. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, and chairpersons of provincial-level People’s Committees shall, within the ambit of their management, proactively and actively implement this Plan according to their assigned tasks, ensuring the implementation schedule, quality, effectiveness and efficiency and avoiding formalism and waste.
2. The Ministry of Planning and Investment shall, based on the proposals of ministries, sectors and localities, summarize and supplement medium-term public investment plans serving the implementation of the Law, and report them to the Prime Minister.
3. Ministries, ministerial-level agencies, government-attached agencies, and provincial-level People’s Committees shall allocate funds in accordance with the Law on the State Budget for performing the tasks mentioned in this Plan, specifically as follows:
a/ The Ministry of Finance shall coordinate with the Ministry of Natural Resources and Environment and related ministries, ministerial-level agencies, government-attached agencies in reserving central budget funds for regular expenditures to perform the assigned tasks;
b/ Provincial-level People’s Committees shall reserve local budget funds for the performance of tasks assigned to localities.
4. The Ministry of Natural Resources and Environment and provincial-level People’s Committees shall intensify the settlement of administrative procedures through the online public service system, ensuring the convenience and quickness for people and businesses.
5. The Ministry of Natural Resources and Environment shall assist the Prime Minister in monitoring and urging ministries, ministerial-level agencies, government-attached agencies, provincial-level People’s Committees and related agencies in performing the tasks specified in this Plan according to schedule, and report implementation results to the Prime Minister.-
