DECISION

Approving adjustments to the Scheme on elephant conservation in Vietnam for the 2013-2020 period^[1]

THE PRIME MINISTER

Pursuant to the June 19, 2015 Law on Organization of the Government; and the November 22, 2019 Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration;

Pursuant to the June 13, 2019 Law on Public Investment;

Pursuant to the November 15, 2017 Law on Forestry;

Pursuant to the Government’s Decree No. 06/2019/ND-CP of January 22, 2019, on management of endangered, precious and rare forest plants and animals and implementation of the Convention on International Trade in Endangered Species of Wild Fauna and Flora; and the Government’s Decree No. 84/2021/ND-CP of September 22, 2021, amending and supplementing a number of articles of Decree No. 06/2019/ND-CP;

Pursuant to the Government’s Decree No. 160/2013/ND-CP of November 12, 2013, on criteria for identifying, and management regimes applicable to, species on the List of endangered, precious and rare species prioritized for protection; and the Government’s Decree No. 64/2019/ND-CP amending Article 7 of Decree No. 160/2013/ND-CP;

Pursuant to the Prime Minister’s Decision No. 763/QD-TTg of May 21, 2013, approving the Scheme on elephant conservation in Vietnam for the 2013-2020 period (below referred to as Decision No. 763/QD-TTg);

At the proposal of the Ministry of Agriculture and Rural Development,

DECIDES:

Article 1. To approve adjustments to the Scheme on elephant conservation in Vietnam for the 2013-2020 period (below referred to as the Scheme) as follows:

1. The Scheme implementation duration: Through the end of 2025.

2. To add urgent elephant conservation projects in Ha Tinh and Quang Nam provinces as component ones to the Scheme, which shall be implemented during the 2021-2025 period.

3. Other contents not adjusted must comply with Decision No. 763/QD-TTg, and current regulations.

Article 2. Organization of implementation

1. Related ministries and sectors shall, within the ambit of their functions and tasks, guide, inspect, supervise and support localities in effective implementation of the Scheme.

2. The People’s Committees of Nghe An, Ha Tinh, Dak Lak, Dong Nai and Quang Nam provinces shall:

a/ Continue to implement the objectives and perform tasks assigned by the Prime Minister in this Decision and Decision No. 763/QD-TTg, and take full responsibility before law for the Scheme’s implementation results in their localities.

b/ Regularly inspect, urge and supervise the implementation of the Scheme in their localities, and efficiently manage and use capital for proper purposes in accordance with the laws on public investment and the state budget and relevant laws.

Article 3. This Decision takes effect on the date of its signing.

Article 4. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, heads of related agencies and chairpersons of the People’s Committees of Nghe An, Ha Tinh, Dak Lak, Dong Nai and Quang Nam provinces shall implement this Decision.-
