DECISION

On the interim regulation on measures for “safe and flexible adaptation and effective control over the COVID-19 pandemic” in Ho Chi Minh City

THE PEOPLE’S COMMITTEE OF HO CHI MINH CITY

Pursuant to the Law on Organization of the Government dated June 19, 2015;

Pursuant to the Law on Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Government’s Resolution No. 128/NQ-CP dated October 11, 2021 promulgating the Interim Regulation on “safe and flexible adaptation and effective control over the COVID-19 pandemic”;

Pursuant to the Decision No. 4800/QD-BYT dated October 12, 2021 of the Ministry of Health on issuing the Interim Guidance for implementation of the Resolution No. 128/NQ-CP;

Pursuant to the Directive No. 18/CT-UBND dated September 30, 2021 of the Chairperson of Ho Chi Minh City People’s Committee on continuing to control and revise COVID-19 prevention and control measures and gradually restore and develop the social economy in Ho Chi Minh City;

Pursuant to the Plan No. 3515/KH-UBND dated October 22, 2021 of Ho Chi Minh City People’s Committee on implementing the Government’s Resolution No. 128/NQ-CP dated October 11, 2021 promulgating the Interim Regulation on “safe and flexible adaptation and effective control over the COVID-19 pandemic” in Ho Chi Minh City;

At the request of the Director of the Department of Health in the Report No. 8487/TTr-SYT dated November 13, 2021 and opinions of the City's departments and sectors.

DECIDES:

Article 1. Promulgating together with this Decision the interim regulation on measures for “safe and flexible adaptation and effective control over the COVID-19 pandemic” in Ho Chi Minh City (the Appendices attached to the Decision).

Article 2. Effect

1. This Decision takes effect on the signing date.

2. This Decision replaces regulations of the Chairperson of City People’s Committee that are specified in: Clause 3, Clause 4 Section II of the Directive No. 18/CT-UBND dated September 30, 2021; Clause 1 of the Appendix issued together with the Plan No. 3515/KH-UBND; the Official Dispatch No. 3231/UBND-DT dated September 30, 2021; the Official Dispatch No. 3232/UBND-DT dated September 30, 2021 on coordination in transporting employees from provinces and cities to Ho Chi Minh City for working in the new situation; the Official Dispatch No. 3250/UBND-DT dated October 01, 2021; the Official Dispatch No. 3251/UBND-DT dated October 01, 2021 on coordination in supporting the citizens’ travel/movements when necessary; the Official Dispatch No. 3252/UBND-DT dated October 01, 2021 on creating favorable conditions for employees to move, restore safely production and business; the Official Dispatch No. 3569/UBND-KT dated October 27, 2021 of the City People's Committee on food and beverage service business.

Article 3. Organization of implementation

1. The Chief of Office of the City People's Committee, Heads of departments and sectors of the City, Chairpersons of People's Committees of districts and Thu Duc city, Chairpersons of People's Committees of wards, communes and townships and relevant organizations and individuals shall be responsible for the implementation of this Decision; continue to strictly implement the contents of the Directive No. 18/CT-UBND dated September 30, 2021 of the Chairperson of the City People's Committee, Plan No. 3515/KH-UBND dated October 22, 2021 of the City People's Committee that are not replaced according to regulations in Clause 2, Article 2 of this Decision and ensure the following principles:

a) Strictly implementing the directions of the Government, the Prime Minister, the National Steering Committee for COVID-19 Prevention and Control, regulations and guidance of the Ministry of Health. Regarding the application of personal QR code, from November 16, 2021, citizens shall use the “PC-COVID” application of the National Steering Committee for COVID-19 Prevention and Control when participating in the activities specified in this Decision.

b) Socio-economic activities must ensure the compliance with regulations of sets of safety assessment criteria in the COVID-19 prevention and control in the City.

c) The application of measures and socio-economic activities shall be implemented based on the assessment and development of pandemic situation.

d) Promote the initiative of citizens, enterprises and functional agencies in the COVID-19 pandemic prevention and control and the City's socio-economic recovery and development.

2. Heads of departments and sectors of the City shall, based on their functions and tasks assigned, promptly promulgate detailed guidance for the effective implementation of this Decision at their respective agencies, units and in their fields; manage and organize the inspection, supervision and handling of violations in accordance with regulations.

3. The Department of Health shall assume the prime responsibility for, and coordinate with relevant units in, promptly advising the City People's Committee to consider and adjust this Decision in accordance with the COVID-19 pandemic development in the City./.
