Decision No. 38/2013/QD-UBND dated September 19, 2013 of the People’s Committee of Hanoi City on promulgating domestic water price in geographical areas of Hanoi City

PEOPLE’S COMMITTEE OF HA NOI CITY

Pursuant to Law on Organizations of People’s Council and People’s Committee dated November 26, 2003;

Pursuant to the 2012 Law on Price;

Pursuant to the Government’s Decree No. 117/2007/ND-CP dated July 11, 2007, on clean water production, supply and consumption;

Pursuant to the Government’s Decree No. 124/2011/ND-CP dated December 28, 2011 on amending and supplementing a number of articles of the Decree 117/2007/ND-CP;

Pursuant to the Joint Circular No. 75/2012/TTLT/BTC-BXD-BNN dated May 15, 2012 of the Ministries of Finance - Construction - Agriculture and Rural Development, on guiding principles, method to determine and authority to decide clean water sale price at urban areas, industrial zones and rural areas;

Pursuant to the Circular No. 88/2012/TT-BTC dated May 28, 2012, of the Ministry of Finance, promulgating framework of clean water consumption;

At the proposal of Inter-sectors: the provincial Department of Finance, the provincial Department of Construction, the provincial Department of Labor – Invalids and Social Affairs, the Taxation Department, and the Hanoi clean water one member limited liability Company at Report No. 4879/TTrLN TC-XD-LĐTB&XH-CT-NSHN dated September 13, 2013, on requesting for approval of plan on adjustment of clean domestic water price in geographical areas of Hanoi City, the written appraisal No. 2314/STP-VBPQ dated September 19, 2013 of the provincial Department of Justice,

DECIDES:

Article 1.Provision on the clean-water sale unit price from the completed and concentrated water supply system in geographical areas of Hanoi City for daily-life purpose:

The above sale price has not yet included value- added tax and environmental protection charges for domestic sewage.

Article 2. Provisions on objects using water:

1. Administrative agencies, non-business units, public service providers:

a) State administrative agencies, agencies of Party, armed forces, mass associations and religious organizations;

b) Agencies in charge of foreign affairs: Offices of foreign affair agencies, non-governmental organizations;

c) Units operating in culture, art, research institutes, museums;

d) Hospitals, schools; fire fighting units;

dd) Social Policy Banks, social insurance agencies;

e) Other administrative agencies, non-business units, public service providers.

2. Enterprises, organizations, individuals operating material production:

a) Offices of companies, factories, plants operating material production…

b) Companies, factories, plants using water for material production;

c) The planting and husbandry establishments, establishments using water in serve of construction works;

d) Other enterprises, organizations, individuals operating material production.

3. Enterprises, organizations, individuals trading and providing service:

a) Trading in hotels, motels, restaurants, places of catering and beverage business;

b) Services of beauty, washing the vehicles, washing and ironing clothes, entertainment areas;

c) Markets, supermarkets, commercial service centers;

d) Units producing: Ice, alcohol, beer, ice cream, beverage;

dd) Other activities of organizations and individuals with nature of service provision.

4. Customers using water for various purposes:

The water suppliers and customers shall base on the actual water use to unify specific rate of water used for each purpose kind so as to apply water price conforming to each purpose use.

Article 3.For case of clean water provision not in the complete and concentrated water supply system of Hanoi city, the City People’s Committee shall approve the non- domestic water unit price for each specific project.

Article 4. Organization of implementation:

1. To assign enterprises of clean water production and provision:

a) To decide clean water price for objects being administrative agencies, non-business units, enterprises, organizations, individuals operating production, trading, service provision in geographical areas of Hanoi City, provided that it ensures the principle of not exceeding the maximum price level specified in Article 1, Article 2 of this Decision;

b) To collect the environmental protection charges for daily-life sewage on geographical areas of Hanoi City in accordance with current regulations.

c) To develop, expand, repair and upgrade the water provision network; raise water quality, quality of water provision service; regularly monitor, examine situation of clean water consumption, ensure not let water lost in local scope; collect water money at right price; with right objects; timely perform measures to remedy status of water loss and revenue loss from water money; recall and refund the borrowed funding in accordance with regulations.

2. To assign the provincial Department of Finance to assume the prime responsibility for, and coordinate with the provincial Department of Construction and relevant Departments and sectors in taking responsible for:

a) Conducting inspections at water provision units in application of clean water price specified in Article 1 of this Decision to users; submitting to the City People’s Committee for consideration and settlement of problems during the course of implementation.

b) Appraising the clean water price plans which are elaborated by water provision units not in the concentrated water supply system of City, submitting them to the City People’s Committee for consideration and approval.

3. To assign the provincial Department of Construction to assume the prime responsibility for, and coordinate with the relevant Departments and sectors in taking responsible for: Supervising, inspecting clean water providers about water quality, service quality, rate of clean water loss and revenue loss.

Article 4.This Decision takes effect 10 days after the day of its signing.The water price at Article 1 of this Decision is applied from October 01, 2013; the price levels apply in 2014, 2015 stated in Article 1 of this Decision may be adjusted on October 01, every year.

Article 5.The Chief of office of City People’s Committee, Directors of the provincial Departments:Finance, Construction, Planning and Investment, Labor - Invalids and Social Affairs; Taxation Department; Director of Hanoi State Treasuries; chairpersons of People’s Committees of districts, towns; units of clean water production and business in geographical areas of Hanoi City; Heads of relevant agencies, units and individuals, households shall implement this Decision.
