DECISION

On amendment and supplementation to the Decision No. 3585/QD-BCD dated October 15, 2021 of the Ho Chi Minh City Steering Committee for COVID-19 Prevention and Control on promulgating the set of criteria for assessment of safe operations in the COVID-19 prevention and control at food service and food business establishments in Ho Chi Minh City

THE HEAD OF CITY STEERING COMMITTEE FOR COVID-19 PREVENTION AND CONTROL

 

Pursuant to the Law on Organization of Local Administration dated June 19, 2015; the Law amending and supplementing a number of articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on Prevention and Control of Infectious Diseases dated November 21, 2007;

Pursuant to the Government's Resolution No. 128/NQ-CP dated October 11, 2021, promulgating the interim regulation on "Safe and flexible adaptation and effective control over the COVID-19 pandemic";

Pursuant to the Government's Decree No. 101/2010/ND-CP dated September 30, 2010, detailing a number of articles of the Law on Prevention and Control of Infectious Diseases regarding the application of medical isolation measures, enforced isolation measures and specific anti-epidemic measures during the epidemic period;

Pursuant to the Prime Minister's Decision No. 447/QD-TTg dated April 1, 2020, on announcement of the COVID-19 pandemic;

Pursuant to the Decision No. 2194/QD-BCDQG dated May 27, 2020 of the National Steering Committee for COVID-19 Prevention and Control on promulgating "the Guidance on prevention, control, and assessment of the risk of COVID-19 infection at the workplaces and dormitories for workers";

Pursuant to the Ministry of Health's Decision No. 4800/QD-BYT dated October 12, 2021, issuing the interim guidance for implementation of the Government's Resolution No. 128/NQ-CP dated October 11, 2021, promulgating the interim regulation on "Safe and flexible adaptation and effective control over the COVID-19 pandemic";

Pursuant to the Ministry of Health's Official Dispatch No. 5522/BYT-MT dated July 12, 2021, regarding the COVID-19 prevention and control plan template for production and business establishments and the form of commitment to prevent pandemic at boarding houses for workers;

Pursuant to the Ministry of Health's Official Dispatch No. 6666/BYT-MT dated August 16, 2021, guiding the COVID-19 prevention and control at agencies and units;

Pursuant to the Decision No. 3201/QD-UBND dated September 1, 2021 of the Chairman of the City People's Committee on consolidating the Ho Chi Minh City Steering Committee for COVID-19 prevention and control ;

Pursuant to the Directive No. 18/CT-UBND dated September 30, 2021 of the Chairman of the City People's Committee, on continuing to control and revise COVID-19 prevention and control measures and gradually restore and develop the social economy in Ho Chi Minh City;

Considering the proposal of the Head of the Food Safety Management Board of Ho Chi Minh City in the Report No. 1777/TTr-BQLATTP dated October 26, 2021 and opinions of the Municipal Department of Health in the Official Dispatch No. 7853/SYT-NVY dated October 24, 2021.

 

DECIDES:

 

Article 1. To amend and supplement the set of criteria for assessing safety in the COVID-19 prevention and control for operations of food service establishments in Ho Chi Minh City specified in Article 1, Decision No. 3585/QD-BCD dated October 15, 2021 of the Ho Chi Minh City Steering Committee for COVID-19 Prevention and Control, on promulgating the set of criteria for assessment of safe operations in the COVID-19 prevention and control at food service and food business establishments in Ho Chi Minh City (the set of criteria enclosed herewith).

Article 2. This Decision takes effect on the date of its signing and replaces the Decision No. 3326/QD-BCD dated September 15, 2021, of the Ho Chi Minh City Steering Committee for COVID-19 Prevention and Control on promulgating the criteria for assessment of safe operations in the COVID-19 prevention and control at food service and food establishments in Ho Chi Minh City.

Article 3. The Chief of Office of the Ho Chi Minh City People's Committee, Director of Municipal Department of Health, Director of Municipal Department of Industry and Trade, Head of the City's Food Safety Management Board, heads of relevant departments and branches, chairpersons of People's Committees of Thu Duc city and districts, chairpersons of  People's Committees of wards, communes and townships and relevant organizations and individuals shall be responsible for the implementation of this Decision./.

THE SET OF CRITERIA

For assessing safety in the COVID-19 prevention and control for operations of food service establishments in Ho Chi Minh City

(Issued together with the Decision No. 3677/QD-BCD dated October 27, 2021 of the Head of the Ho Chi Minh City Steering Committee for COVID-19 Prevention and Control)

I. THE SET OF ASSESSMENT CRITERIA:

Food service establishments (hereinafter referred to as establishments) in Ho Chi Minh City shall only operate when they have fully satisfied the conditions for ensuring food safety and relevant regulations on COVID-19 prevention and control:

1. Criterion 1: applicable to establishments

- An establishment must have a certificate of eligibility for food safety (except for the establishments specified in Article 12, Decree No. 15/2018/ND-CP)1 and ensure food safety conditions in accordance with law provisions (regarding facilities, equipment, people, preservation, transportation, origin of raw materials and related documents, etc.).

- An establishment must arrange food delivery and receipt areas to ensure the regulations on COVID-19 prevention and control; being fully equipped with hand sanitizers, soap, antiseptic solution and equipment, tools and means for drying hands; self-organizing random and periodic SARS-CoV-2 testing for persons working at high-risk establishments;

- An establishment must register its QR code at the website address http://antoan-covid.tphcm.gov.vn/ and perform QR code scanning of all persons involved in the establishment (in accordance with the Directive No. 18/CT-UBND dated September 30, 2021 of the People's Committee of Ho Chi Minh City, on continuing to control and revise COVID-19 prevention and control measures and gradually restore and develop the social economy in Ho Chi Minh City).

+ Fully following such regulations: Qualified.

+ Failing to follow/fully such regulations: Unqualified.

2. Criterion 2: applicable to customers

Strictly adhering to the 5K rules (facemasks - distance - health declarations - disinfection - no gathering); performing QR code scanning and complying with COVID-19 prevention and control measures in accordance with the guidance of the health sector and establishments.

+ Fully following such regulations: Qualified.

+ Failing to follow/fully such regulations: Unqualified.

3. Criterion 3: applicable to servers, salespersons, goods deliverer - receiver, persons who come to establishments for work purpose (employees)

- Strictly adhering to the 5K rules (facemasks - distance - health declarations - disinfection - no gathering); performing QR code scanning and complying with COVID-19 prevention and control measures in accordance with the guidance of the health sector; employees shall be persons who have recovered from COVID-19 for less than 6 months or have been vaccinated for COVID-19 (receiving at least one dose for the 2-dose vaccine and vaccinated for at least 14 days).

- Being tested by SARS-CoV-2 screening method on a periodic basis or when an employee shows any of the symptoms of fever, cough, fatigue, sore throat, loss of smell and taste, shortness of breath, etc.

+ Fully following such regulations: Qualified.

+ Failing to follow/fully such regulations: Unqualified.

4. Criterion 4: applicable to establishment owners

- Formulating plans and being responsible for strictly implementing COVID-19 prevention and control measures at their establishments according to regulations.

- Having business organization plans, publicizing the maximum number of customers served on the spot at the same time (arranging clear notice board at their establishments) and ensuring the number of customers not exceeding the number announced at the same time.

- Reporting business organization plans and COVID-19 prevention and control measures at the grassroots level to People's Committees of wards, communes and townships for management, monitoring, inspection and supervision.

+ Fully following such regulations: Qualified.

+ Failing to follow/fully such regulations: Unqualified.

II. ASSESSMENT OF SAFETY INDICATORS

Depending on the pandemic situation, food service establishments eligible for operation must satisfy the 04 criteria mentioned above and complying with specific regulations of the People's Committee of Ho Chi Minh City./.
