DECISION
APPROVING THE PLAN ON THE NETWORK OF FISHING PORTS AND WHARVES THROUGH 2020, AND ORIENTATIONS TOWARDS 2030
THE PRIME MINISTER
Pursuant to the December 25, 2001 Law Organization of the Government;
Pursuant to the November 26, 2003 Fisheries Law;
At the proposal of the Minister of Agriculture and Rural Development (Report No. 3057/1 BNN-KTBVNL of September 23, 2009),
Article 1. To approve the Plan on the network of fishing ports and wharves through 2020, and orientations towards 2030, with the follow principal contents:
I. PLANNING VIEWPOINTS
1. To plan fishing ports and wharves on basis of tapping to the utmost the natural conditions, taking into consideration traditional customs and practices of local fish communities while ensuring compliance local and sectoral socio-economic development master plans to serve the catch of aquatic resources in the direction of industrialization modernization.
2. To attach importance to the construction of fishing ports and wharves in close association with storm shelters for fishing vessels in convenient places near large fishing grounds where operate large numbers of many vessels.
3. To speed up the socialization in the construction and management of fishing ports and wharves in order to mobilize sources from various economic sectors as well as financial support and assistance of foreign countries and international organizations, especially their experience in the construction and management of fishing ports and wharves.
II. PLANNING OBJECTIVES
1. To complete the system of fishing ports and wharves along the coast, on islands and at estuaries and bays with favorable natural conditions suitable for building large fishing ports or wharves aiming to provide docking places and logistics services for fishing vessels towards industrialization and modernization.
2. To step by step upgrade and consolidate people-founded fishing wharves, creating favorable conditions for inshore fishermen to improve production conditions and assure safety, partially meeting the demand for logistics services and contributing to economic, tourist, cultural and social development and environmental sanitation for coastal and island fishing communities.
III. PLANNING SCOPE
1. The Plan covers 28 coastal provinces and cities with coastal or island fishing ports and wharves.
2. The Plan is elaborated for the period through 2020, with orientations towards 2030.
IV. CLASSIFICATION AND DIRECTED CRITERIA FOR THE CONSTRUCTION OF FISHING PORTS AND WHARVES
Based on natural characteristics and traditional practices of fishermen, the network of fishing ports and wharves will be classified and built according to the following directed criteria:
1. Grade-I fishing ports:
A grade-I fishing port must satisfy the following conditions:
- Location: being built at a big estuary or bay or on an island near a major fishing ground where rally fishing vessels from different provinces; acting as the focal point for the distribution of aquatic products in the region in association with local fisheries centers.
- Equipment and facilities: having a complete and wholly mechanized cargo loading and uploading chain.
- Attractive zone: attracting fishing vessels from different localities.
- Available mode of transport: convenient waterways and roads.
- Designed throughput of aquatic products: 15,000 tons or more per year.
- Fishing vessels capable of entering the port: those of a capacity of under 800 h.p.
- The number of turns of vessels entering the port: 120 turns or more/day.
2. Grade-II fishing ports:
A grade-II fishing port must satisfy the following conditions:
- Location: being built at an estuary, canal, sea strait or coastal lagoon or on an island near a traditional fishing ground of local fishing vessels; acting as the focal point in purchasing aquatic products; and being connected to local fishing logistics service centers.
- Port equipment and facilities: having some mechanized equipment for cargo loading and uploading.
- Attractive zone: attracting fishing vessels of the province and some nearby provinces.
- Available mode of transport: relatively convenient roads and waterways.
- Designed throughput of aquatic products: 7,000 tons or more/year or 3,000 tons or more/ year, for island ports.
- Type of vessels capable of entering the port: fishing vessels of a capacity of under 400 h.p.
- The number of turns of fishing vessels entering the port: 50 turns/day.
3. Fishing wharves:
A fishing wharf must satisfy the following conditions:
- Location: Being built at an estuary, canal, ditch or coastal lagoon, on an island or coastal plain near a traditional fishing ground of local fishing vessels.
- Wharf equipment and facilities: having mainly rudimentary equipment or manual labor cargo loading and uploading.
- Attractive zone: serving local fishing communities.
- Available mode of transport: mostly waterways.
- Minimum throughput of aquatic products: 1,500 tons/year.
- Vessels capable of entering the wharf: Those of a capacity of under 100 h.p.
V. PLANNING ON THE NETWORK OF FISHING PORTS AND WHARVES UP TO 2020
(See the attached Appendix)
1. By 2020, there will be 211 fishing ports and wharves capable of handling 2,360,0001 of aquatic products per year, including:
a/ One hundred and seventy eight coastal pi and wharves capable of handling 2,145.0001 of aquatic products per year, including 14 grade- I fishing ports, 74 grade-II fishing ports and fishing wharves.
b/ Thirty three island ports and wharves capable of handling 215,000 tons of aquatic; products per year, including 1 grade-I fish port, 22 grade-II fishing ports and 10 fish wharves.
2. Sea area-based planning:
a/ In Tonkin Gulf (from Quang Ninh province to Quang Binh province): There will be 65 fish ports and wharves, including 9 island ones 56 coastal ones, classified into 4 grade-I fish ports, 24 grade-II fishing ports and 37 fish wharves.
b/ In Central Vietnam's sea area (from Quang Tri province to Binh Thuan province): There will be 73 fishing ports and wharves, including island ones and 64 coastal ones, classified into grade-I fishing ports, 41 grade-II fishing pi and 28 fishing wharves.
c/ In the Southeastern region's sea area (from Ba Ria -Vung Tau province to Ca Mau province There will be 45 fishing ports and wharves including 2 island ones and 43 coastal ones, classified into 5 grade-I fishing ports, 22 grade-II fishing ports and 18 fishing wharves.
d/ In the Southwestern region's sea area (from Ca Mau province to Kien Giang province): There will be 28 fishing ports and wharves, including 13 island ones and 45 coastal ones, classified into 2 grade-I fishing ports, 9 grade-II fishing ports and 17 fishing wharves.
3. Priority projects
In the 2009-2012 period, priority will be given to investment in the construction of grade-I fishing ports, urgent projects under construction and fishing ports possibly used as storm shelters which have been built or are under construction. After 2012, period, depending on the practical situation and development demand, to upgrade several fishing ports in some locations into international fishing ports.
VI. ORIENTATIONS TOWARDS 2030
The cargo throughput of the fishing ports is expected to be kept at the level planned for 2020.
Fishing ports and wharves will be developed towards industrialization and modernization on the basis of upgrading and expanding existing ports and wharves, focusing on fishing logistics service facilities so as to synchronize the system of fishing ports. Grade-I fishing ports will be upgraded to receive fishing vessels of up to 1,000 horsepower.
VII. SOLUTIONS FOR THE MANAGEMENT AND IMPLEMENTATION OF THE PLAN
1. Mechanisms and policies:
a/ To increase and concentrate capital for construction investment, especially for grade-I fishing ports, regional ports and ports located on islands in important positions or near major fishing grounds which may also be used as storm shelters for fishing vessels; to quickly form the network of fishing ports and wharves as planned to facilitate the development of effective aquatic resource exploitation.
b/ The State encourages and offers incentives for domestic and foreign organizations and individuals to invest in the construction of infrastructure and production and business support facilities in fishing ports and wharves under law.
c/ To continue collecting charges and dues, including wharfage and vehicle and cargo handling charges, first of all at large fishing ports, so as to create conditions for port managers to have more funds for port repair and maintenance.
d/ To further mobilize all social resources for investment in and management of fishing ports and wharves. In the immediate future, to adopt specific policies to attract enterprises to invest in the construction of, or sub-lease infrastructure facilities in fishing ports and wharves newly invested with state budget capital for production and business, and to participate in the management of these fishing ports and wharves.
2. Science and technology:
a/ To continue applying new scientific and technological advances to the construction and maintenance of fishing ports and wharves; to raise the mechanization and industrialization rate, first of all, in the loading and uploading of cargoes and the preservation and preliminary processing of aquatic products in fishing ports and wharves.
b/To study and formulate standards, technical regulations and econo-technical norms to be applied to the construction and management of fishing ports and wharves.
3. Environmental protection:
a/ To apply technical solutions to the construction of water supply and drainage systems, garbage and wastewater collection and treatment systems, first of all at fishing ports and wharves under construction or upgrading.
b/ To perfect legal documents on environmental protection in fishing ports and wharves.
c/ To promote propaganda about environmental protection among fishing communities right in fishing ports and wharves in brief and easy-to-understand forms.
d/ To assign local functional agencies to assume the prime responsibility for, and coordinate with one another in, directing and overseeing environmental protection activities; to enhance the inspection and control of, and impose administrative sanctions against, polluting acts.
4. Investment capital:
Investment capital for the implementation of the Plan will be raised from different sources: the central budget, local budgets, capital of domestic economic sectors and foreign investment capital and donations.
In which:
a/ Central budget capital will be used for the construction of essential infrastructure facilities of grade-I fishing ports, covering dredging entry and exit fairways and docking areas, building docksides, gangways, embankments, dikes, breakwaters, sand protection dikes, vessel-anchoring facilities, signal buoys and specialized information and communication systems; electricity and water supply systems, wastewater and garbage treatment systems, fire prevention and fighting devices and administration house
Central budget funds will be allocated und( five-year and annual plans or target programs o the basis of investment projects approved b competent authorities according to law.
b/ Local budgets will be allocated for the construction of essential infrastructure facilities of grade-II fishing ports and to support the construction of local fishing wharves; ground clearance compensation and resettlement; annual maintenance of infrastructure facilities an payment of expenses for post-investment management of fishing ports and wharves invested with state budget capital.
c/ Capital mobilized from domestic economic sectors will be used for the construction c infrastructure facilities in fishing ports an wharves according to approved project; production and business support works an fishing logistics service facilities in fishing poi and wharf areas; and management of fishing port and wharves and annual maintenance of work items.
d/ Foreign capital will be used for the synchronous development of grade-I fishing ports; procurement of new equipment an technologies and construction techniques; an management of and environmental protection at fishing ports and wharves.
5. Total investment capital demand investment phases:
a/ The total demand for investment capital for fishing port and wharf projects up to 202 will be VND 8 trillion.
b/ Investment phases:
- The 2009-2012 period: VND 2.303 trillion
To concentrate investment capital so as to complete the construction of grade-I fishing ports, priority projects, a number of grade-II fishing ports under construction and fishing wharves which can be used as storm shelters already built or under construction.
- The 2013-2015 period: VND 3.926 trillion
To concentrate investment capital in key fishing ports and wharves nationwide as planned.
- The 2016-2020 period: VND 1.771 trillion
To invest in the remaining fishing ports and wharves as planned.
VIII. ORGANIZATION OF IMPLEMENTATION
1. The Ministry of Agriculture and Rural Development shall:
a/ Direct and guide the implementation of this Plan nationwide; elaborate and promulgate criteria for. and model regulations on the management of, fishing ports and wharves; study and adopt mechanisms and policies to encourage economic sectors to participate in the investment in and management of fishing ports and wharves.
b/ Appraise and approve investment projects to construct grade-I fishing ports, ensuring conformity with set objectives and compliance with current laws and take responsibility for its decisions.
c/ Direct and guide coastal provinces to identify the locations of fishing ports and wharves and the order of investment priority, ensuring conformity with set objectives and criteria and the completion of each investment item.
d/ Coordinate with concerned ministries and branches and coastal localities in organizing reviews to draw experience in the construction of fishing ports in each period so as to ensure the successful implementation of this Plan.
2. People's Committees of coastal provinces and cities shall:
a/ Appraise and approve investment projects to construct grade-II fishing ports and fishing wharves, ensuring conformity with set objectives and compliance with current law, and take responsibility for their decisions.
b/ Organize the post-investment management and operation of fishing ports and wharves.
c/ Allocate land under planning and apportion capital under five-year and annual plans according to the construction investment schedule and allocate funds for the maintenance and management of facilities.
d/ Organize the collection of service charges at fishing ports on a trial basis; formulate a model of managing fishing ports and wharves with the participation of local fishing communities.
3. The Ministry of Planning and Investment and the Ministry of Finance shall apportion and allocate capital for the implementation of this Plan under 5-year and annual plans according to the investment construction schedule, ensuring capital for the completion of each investment item.
Article 2. This Decision takes effect on the date of its signing.
Article 3. Ministers of Agriculture and Rural Development; Planning and Investment; and Finance; and chairpersons of the People's Committees of coastal provinces and cities shall implement this Decision.
