THE PRESIDENT OF THE PEOPLE’S COMMITTEE OF QUANG BINH PROVINCE
Pursuant to the Law on Organization of Local Government dated June 19, 2015;
Pursuant to the Official Dispatch No. 1224/BNV-CCHC dated March 07, 2017 and Official Dispatch No. 3719/BNV-TCCB dated July 13, 2017 of the Ministry of Home Affairs on unifying organizational structures and operation of Public Administration Centers and establishment of Public Administration Center of Quang Binh Province;
Pursuant to the Decision No. 14/2016/QD-UBND dated June 28, 2016 defining functions, tasks, entitlements and organizational structure of the Office of the People’s Committee of Quang Binh province;
Pursuant to the Decision No. 2828/2017/QD-UBND dated August 08, 2017 of the People’s Committee on approval for the scheme for establishment of Public Administration Center of Quang Binh province;
In consideration of the request of the Director of the Department of Home Affairs in the Official Dispatch No. 1216/SNV-CCHC dated August 14, 2017,
HEREBY DECIDES:
Article 1.The Public Administration Center of Quang Binh province is established.
1. Location of the Center
The Public Administration Center of Quang Binh province(hereinafter referred to as “the Center”)is an organization affiliated to the Office of the People’s Committee of the province and is under the direction of the President the People’s Committee of the province, under the management of the Office of the People’s Committee of the province and under the supervision of competent authorities.
The Center has a separate legal status and seal to perform its tasks. The Center is located in Dong Hoi city, Quang Binh province.
2.Functions, tasks and entitlements of the Center
a) Functions of the Center
- Act as a contact point to which departments affiliated to the People’s Committee of the province second their officials to receive, provide guidance and cooperate in handling of documents serving administrative procedures and return results thereof to organizations and individuals.
- Provide guidance, supervise and expedite the handling of administrative procedures as prescribed; participate in proposing solutions for reforming administrative procedures and modernizing public administration with a focus on simplifying administrative procedures and promoting the application of information technology in order to computerize administrative transactions in handling administrative procedures and providing online public services at the Center.
b) Tasks of the Center
- Openly post administrative procedures (documents) as prescribed; fees, charges and time for handling issues; procedures for receiving and processing documents; responsibilities of relevant departments, organizations and individuals.
- Make necessary preparations regarding infrastructure, equipment and working environment; apply information technology to ensure that administrative procedures are handled in a quick, public and transparent manner.
- Instruct organizations and individuals at the Center.
- Supervise officials that are seconded to the Center to receive, provide instructions, appraise and approve documents or submit them to a competent authority for approval to ensure that results are returned to organizations and individuals on schedule.
- Collect information and submit reports on receipt of documents and handling of administrative procedures and results thereof by departments affiliated to the People’s Committee of the province.
- Supervise, receive, handle or report complaints about the handling of administrative procedures and performance of tasks by officials at the Center.
- Cooperate in handling relevant issues that arise during the handling of inter-agency administrative procedures; exchange work experience, provide professional training and cooperate in assessing performance of tasks by officials seconded to the Center.
- Cooperate with relevant authorities and units in considering the State’s regulations on reform of administrative procedures and e-government; consolidate and propose amendments to lists, procedures and other contents related to the handling of administrative procedures through the Center.
- Propose the upgrading of infrastructure and software; integrate operational data, ensure cybersecurity and perform other tasks within its competence.
- Propose the improvement in quality of services and quick and convenient handling of issues; organize or cooperate in organizing the dissemination of information about operation of the Center.
- Manage human resources, assets and infrastructure of the Center as prescribed by law; appropriately arrange areas for providing information, handling administrative procedures and equipment serving organizations and individuals at the Center. Provide information and submit reports as prescribed.
- Collect fees and charges (if any) as prescribed.
- Provide services related to the handling of administrative procedures upon request and with the competent authority’s approval in accordance with the State s regulation.
- Perform other tasks assigned by the Office of the People’s Committee of the province.
c) Entitlements of the Center
- Inspect, supervise and expedite the handling of administrative procedures by authorities and units at the Center in accordance with a procedure and on schedule. Proactively cooperate with authorities and units directly handling administrative procedures to resolve difficulties that arise during the handling of administrative procures; cooperate in uncovering reasons for delays in handling of administrative procedures before notifying the People s Committee of the province in writing (if necessary).
- Assess and comment on the receipt and time of processing documents; attitude and behavior of officials at the Center; request heads of supervisory authorities and units in providing reward or impose disciplinary penalties as prescribed.
- Proactively notify or request the Office of the People s Committee of the province or a competent authority to decide on the secondment of officials who violate work regulations and procedures for handling administrative procedures or whose qualifications are not suitable for the assigned tasks after reaching an agreement with the authority or unit employing such officials.
- Propose the provision of reward to units or individuals who well perform their task of receiving and handling administrative procedures and returning results.
Article 2.Organizational structure and financial structure of the Center
1. Organizational structure
a) Heads of the Centerinclude:
- 01 Director, who is the Deputy Chief of Office of the People’s Committee of the province.
- No more than 02 Deputy Directors, who work full time.
b) Officials and workersinclude:
- The Center’s permanently employed officials who are under the management of the Center and assigned to:
+ assist heads of the Center in performing the tasks related to information technology - network management and administration.
+ perform the task of supervision and control, and receive and handle complaints about administrative procedures.
+ Administrative officers and office cleaners.
- Officials performing professional tasks include:
+ The Center’s permanently employed officials who directly assist heads of the Center in performing the task of providing guidance on receiving documents serving administrative results and returning results.
+ Departments’ permanently employed officials seconded by the departments to receive documents and return results at the Center.
2. Permanently employed officials and workers
a) Center’s permanently employed officials working full time:firstly, appoint 10 permanently employed officials of all permanently employed officials of the province. To be specific:
+ Director;
+ 02 Deputy Directors;
+ 07 officials and workers.
* After being put into operation, the Center shall prepare an employment scheme and submit it to a competent authority for approval. To be specific:
+ Heads of the Center include 01 Director and 02 Deputy Directors.
+ 04 officials and workers perform the administration-related tasks.
+ 03 officials perform professional tasks.
b) Department’s permanently employed officials seconded to the Center:
Departments that receive documents serving administrative procedures and return results at the Center shall second from 01 to 02 officials to the Center (depending on the number of administrative procedures and volume of relevant work). Such officials shall work at the Center for at least 2 years. The work duration shall be decided by the heads of the departments that manage the officials but must not exceed 3 years.
c) The Center is entitled to contract (hire)security staff and cleaning staff by using the funding provided by the budget.
3. Financial mechanism
- The operating funding of the Center is provided by the state budget.
Article 3.This Decision takes effect on the signing date.
Article 4.Implementation
1. The Office of the People’s Committee of the province shall:
Assign its permanently employed officials and workers to work full time at the Center; take charge and cooperate with the Department of Home Affairs and relevant authorities and units to prepare a plan on appointment of personnel as heads of the Center and submit it to a competent authority for approval.
Prepare an employment scheme and submit it to a competent authority for approval; assign the authorities and responsibilities to the heads and deputy heads of the Center; adopt solutions for employing officials according to the position, official rank structure, credentials and qualifications to increase the quality and performance; make regulations on organizational structure and operation of the Center, submit them to the President of the People’s Committee of the province for approval and organize the implementation thereof.
2. The Department of Home Affairs shall cooperate with the Office of the People s Committee of the province and relevant authorities and units to prepare a plan on appointment of personnel as heads of the Center; assist the People s Committee of the province in deciding to second officials and workers of departments to work full time at the Center upon request.
3. Provincial departments that have administrative procedures handled at the Center shall appoint officials qualified for the task of receiving documents, handling administrative procedures and returning results at the center.
4. Chief of Office of People’s Committee of the province, Directors of departments, heads of provincial departments, Presidents of People’s Committees of districts and Director of the Public Administration Center are responsible for the implementation of this Decision./
