Decision No. 2270/QD-TCHQ dated August 9, 2018 of the General Department of Customs on issuing regulations on formating of data messages exchanged between customs authorities and processing, export manufacturing or export processing enterprises
Pursuant to the Law on Electronic Transactions No. 51/2005/QH11;
Pursuant to the Law on Information Technology No. 67/2006/QH11 dated June 29, 2006;
Pursuant to the National Assembly’s Law on Customs No. 54/2014/QH13 dated June 23, 2014;
Pursuant to the Government s Decree No.08/2015/ND-CP dated January 21, 2015 prescribing details and measures for implementation of the Law on Customs regarding customs procedures, customs inspection, supervision and control;
Pursuant to the Government s Decree No.59/2018/ND-CP dated April 20, 2018 amending and supplementing certain articles of the Government’s Decree No. 08/2015/ND-CP dated January 21, 2015 prescribing details and measures for implementation of the Law on Customs regarding customs procedures, customs inspection, supervision and control;
Pursuant to the Circular No. 38/2015/TT-BTC dated March 25, 2015 of the Ministry of Finance prescribing customs procedures; customs inspection and supervision; import and export duties and management of import and export duties;
Pursuant to the Circular No. 39/2018/TT-BTC dated April 20, 2018 amending and supplementing certain articles of the Circular No. 38/2015/TT-BTC dated March 25, 2015 of the Minister of Finance prescribing customs procedures; customs inspection and supervision; export and import duties and management of import and export duties;
Pursuant to the Decision No. 65/2015/QD-TTg dated December 17, 2015, defining the functions, tasks, powers and organizational structure of the General Department of Vietnam Customs affiliated to the Ministry of Finance;
Upon the request of the Director of the Customs Information Technology and Statistics Department,
DECIDES
Article 1.To attach the“Regulations on formatting of data messages exchanged between customs authorities and processing, export manufacturing or export processing enterprises” with this Decision.
Article 2.This Decision takes effect on the signing date and replaces the Decision No. 2228/QD-TCHQ dated July 5, 2018 of the General Department of Vietnam Customs on formatting of data messages exchanged between customs authorities and processing, export manufacturing or export processing enterprises.
Article 3.The Director of the Customs Information Technology and Statistics Department, and the Directors of the Customs Departments of cities and provinces shall implement this Decision./.

REGULATIONS
ON FORMATING OF DATA MESSAGES EXCHANGED BETWEEN CUSTOMS AUTHORITIES AND PROCESSING, EXPORT MANUFACTURING OR EXPORT PROCESSING ENTERPRISES

Chapter I
GENERAL PROVISIONS
Article 1. Scope of adjustment
These Regulations deal with formatting of data messages exchanged between customs authorities and processing, export manufacturing or export processing enterprises.
Article 2. Subjects of application
The format of data message must be used in the building of the information systems of the customs authorities which is consistent with the information systems of processing, export manufacturing or export processing enterprises.
Article 3. Formatting of data used for information exchange
XML language shall be used in the information exchange between the information systems of the customs authorities and the information systems of the processing, export manufacturing or export processing enterprises.
XML (eXtensible Markup Language) is a set of rules for dividing a material into different parts, marking and combining these parts to identify data easier.
A component of an XML message is a block creating an XML message that starts with an opening tag and ends with a closing tag. Both tags have the same name.
Property of a component: A component is designed to provide supplementary information about that component and is always put inside the tag of that component.
An XML message used for exchanging electronic data between the information systems of the customs authorities and the information systems of the processing, export manufacturing or export processing enterprises shall be considered complete and valid if that message is not in breach of the rules regarding the syntax and the structure of data message which are specified under these Regulations.
Chapter II
IMPLEMENTATION ORGANIZATION
Article 4. Responsibilities of Customs Information Technology and Statistics Department
- Preside over establishment, upgrade and operation of the information technology system that enables organizations and individuals to carry out processing, legal action with sanction of forging title, export manufacturing and export processing activities;
- Directly ensure conformity with technical and operational standards of the information system available for use at the General Department of Customs;
- Raise awareness of compliance with the format of data message amongst processing, export manufacturing, export processing and law software development enterprises for transmission and processing of data exchanged with customs authorities.
Article 5. Provisions
Customs Departments of cities and provinces shall, based on actual conditions of each Department,
- disseminate provisional regulations regarding the format of data messages exchanged between customs authorities and enterprises;
- take initiative in providing incentive and encouragement policies for enterprises in the development of law software used for connecting and exchanging data with the customs information system.
Should there be any issue arising from implementation of this Decision, the Customs Information Technology and Statistics, managed by the General Department of Customs, should be informed to give its further instructions./.
