THEPRIMEMINISTER

Decision No.20/2014/QD-TTg datedMarch 11, 2014 of the Prime Ministeron the establishment of Cao Bang province border-gate economic zone

Pursuant to the December 25, 2001 Law on Organization of the Government;

Pursuant to the November 29, 2005 Law on Investment;

Pursuant to the Government’s Decree No. 29/2008/ND-CP of March 14, 2008, providing industrial parks, export-processing zones and economic zones, and the Government’s Decree No. 164/2013/ND-CP of November 12, 2013, amending and supplementing a number of articles of the Government’s Decree No. 29/2008/ND-CP of March 14, 2008, providing industrial parks, export-processing zones and economic zones;

Pursuant to the Prime Minister’s Decision No. 1531/QD-TTg of August 30, 2013, approving the Scheme on revising the master plan on development of Vietnam’s border-gate economic zones through 2020, with a vision toward 2030;

At the proposals of the Minister of Planning and Investment and the chairperson of People’s Committee of Cao Bang province;

The Prime Minister promulgates the Decision on the establishment of Cao Bang province border-gate economic zone.

Article 1.To establish Cao Bang province border-gate economic zone

1. Cao Bang province border-gate economic zone has definite geographical boundaries within Vietnam’s territory and under national sovereignty, and a separate economic space.

Cao Bang province border-gate economic zone covers the (whole or partial) area of border communes, from Duc Long commune, Thach An district, to Can Nong commune, Thong Nong district, specifically:

- Thach An district: The whole area of Duc Long commune.

- Phuc Hoa district: Ta Lung and Hoa Thuan townships, My Hung, Dai Son and Cach Linh communes, and Tha Miang-Khuoi Rung, Khuoi Khuong, Khun Thuong and Khun Ha hamlets of Trieu Au commune.

- Ha Lang district: Thi Hoa, Ly Quoc and Minh Long communes; Ban Khua, Ban Thun and Na Thung hamlets of Co Ngan commune; Pac Lung, Coc Khot, Na Hoach, Ban Dau and Pac Khao hamlets of Thai Duc commune; Ban Cac, Vac Nhang, Ban Khoong, Pac Ty and Thom Thay hamlets of Viet Chu commune; Khi Rot, Lung Lac and Kieng Phac hamlets of Quang Long commune; and Cung-Bua-Man and Lung Nam hamlets of Dong Loan commune.

- Trung Khanh district: Dinh Phong, Ngoc Khe and Ngoc Con communes; Lung Niec, Ban Gioc, Co Muong, Ban Mom, Hang Thoang-Doc Ma, Lung Phiac and Na Deng-Lung Noi hamlets of Dam Thuy commune; Lung Hoat and Doong Deng hamlets of Chi Vien commune; Lung Ri and Da Be hamlets of Phong Nam commune; Lung Chuong and Lung Bang hamlets of Ngoc Chung commune; and Rang Rang, Dong Nieng and Lung Rang hamlets of Lang Yen commune.

- Tra Linh district: Hung Quoc township; Lung Lao, Binh Chinh Tren, Lung Nam, Cung Keo, Dong Cam and Lung Pau-Lung Thien hamlets of Tri Phuong commune; Lung Muoi hamlet of Xuan Noi commune; Thi Phong and Na Po hamlets of Quang Han commune; and Co To A-Co To B and Lung Tao hamlets of Co Muoi commune.

- Ha Quang districts: Cai Vien, Truong Ha and Soc Ha communes; Keo Sy, Lung Giong and Rang Dan hamlets of Tong Cot commune; Nguom Vai- Pac Tac hamlet of Noi Thon commune; Nam Niec hamlet of Cai Vien commune; Nhi Du, Pac Co and Pac Tem-Lung Rau hamlets of Van An commune; Keo Quen-Ang Bo, Nam San, Thieng Vai and Lung Co hamlets of Lung Nam commune; Cay Tac and Nam Rang hamlets of Keo Yen commune; and Ma Lip hamlet of Na Sac commune.

- Thong Nong district: Vi Quang commune; Na Thin, Na Vai and Na Lung hamlets of Can Yen commune; and Phia Rac, Lung Ri, Nam Dong and Na Tenh hamlets of Can Nong commune.

The total land area of the border-gate economic zone is 30,130.34 ha, covering 37 communes and 3 townships. The zone has geographical boundaries as follows:

- To the north, it borders on Napo and Jingxi counties (Guangxi province, China);

- To the east, it borders on Longzhou and Daxin counties (Guangxi province, China);

- To the south, it borders on Thach Anh district, Cao Bang province;

- To the west, it borders on Bao Lac district, Cao Bang province.

2. Cao Bang province border-gate economic zone is organized into a non-tariff area and functional areas such as international border gate, industrial park, financial center, urban area, administrative center, residential area, and other functional areas. The size and location of each functional area is determined in the general plan and detailed plan of Cao Bang province border-gate economic zone.

Article 2.The operation of, and mechanisms and policies applicable to, Cao Bang province border-gate economic zone comply with the Law on Investment and guiding documents, the Government’s Decree No. 29/2008/ND-CP of March 14, 2008, providing industrial parks, export- processing zones and economic zones, the Government’s Decree No. 164/2013/ND-CP of November 12, 2013, amending and supplementing a number of articles of the Government’s Decree No. 29/2008/ND-CP of March 14, 2008, providing industrial parks, export-processing zones and economic zones, the Prime Minister’s Decision No. 72/2013/QD-TTg of November 26, 2013, providing financial mechanisms and policies applicable to border-gate economic zones, and other relevant legal documents.

Article 3.Implementation provisions

1. This Decision takes effect on May 1, 2014.

To annul the Prime Minister’s Decision No. 83/2002/QD-TTg of June 26, 2002, on the scope of application of policies to Cao Bang province’s border-gate economic zones.

2. Ministers, heads of ministerial-level agencies, heads of government- attached agencies and the chairperson of the People’s Committee of Cao Bang province shall implement this Decision.-
