DECISION
Providing levels of vocational training support for workers covered by unemployment insurance[1]
Pursuant to the June 19, 2015 Law on Organization of the Government; and the November 22, 2019 Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration;
Pursuant to the November 16, 2013 Law on Employment;
Pursuant to the November 27, 2014 Law on Vocational Education;
Pursuant to the Government’s Decree No. 28/2015/ND-CP of March 12, 2015, detailing a number of articles of the Law on Employment regarding unemployment insurance;
Pursuant to the Government’s Decree No. 61/2020/ND-CP of May 29, 2020, amending and supplementing a number of articles of the Government’s Decree No. 28/2015/ND-CP of March 12, 2015, detailing a number of articles of the Law on Employment regarding unemployment insurance;
At the proposal of the Minister of Labor, Invalids and Social Affairs;
The Prime Minister promulgates the Decision providing levels of vocational training support for workers covered by unemployment insurance.
Article 1. Scope of regulation
This Decision provides levels of vocational training support for workers covered by unemployment insurance.
Article 2. Subjects of application
1. Workers eligible for vocational training support as specified in Article 55 of the Law on Employment (below referred to as workers).
2. Vocational education institutions and higher education institutions having registered vocational education at college level, and enterprises, agencies and organizations licensed to provide vocational education and engaged in vocational training for workers (below collectively referred to as vocational training institutions).
3. Provincial-level Departments of Labor, Invalids and Social Affairs; social insurance agencies; employment service centers established by state management agencies in charge of employment; and agencies involved in vocational training support for workers covered by unemployment insurance.
Article 3. Levels of vocational training support
1. Levels of vocational training support
a/ For workers attending a vocational training course of up to 3 months: The support amount shall be calculated based on the tuition fee charged by the vocational training institution and actual training duration but must not exceed VND 4,500,000/person/course.
b/ For workers attending a vocational training course longer than 3 months: The support amount shall be calculated on a monthly basis, the tuition fee and actual training duration but must not exceed VND 1,500,000/person/month.
In case workers attend vocational training courses of which the training duration has odd days that do not constitute a full month according to vocational training institutions’ regulations, the period of under 14 days shall be regarded as half a month and the period of 15 days or longer shall be regarded as 1 month.
2. Dossiers of request for vocational training and provision of vocational training support must comply with Articles 24 and 25 of the Government’s Decree No. 28/2015/ND-CP of March 12, 2015, detailing a number of articles of the Law on Employment regarding unemployment insurance (revised under the Government’s Decree No. 61/2020/ND-CP of May 29, 2020).
3. Vocational training institutions shall, on a monthly basis, carry out procedures for payment and account finalization of funds for vocational training support prescribed in Article 25 of the Government’s Decree No. 28/2015/ND-CP of March 12, 2015, detailing a number of articles of the Law on Employment regarding unemployment insurance (revised under the Government’s Decree No. 61/2020/ND-CP of May 29, 2020).
Article 4. Funds for implementation
Funds for vocational training support shall be allocated from the Unemployment Insurance Fund and paid by social insurance agencies.
Article 5. Effect and implementation responsibility
1. This Decision takes effect on May 15, 2021.
Workers who submit dossiers of request for vocational training support before the effective date of this Decision but have not yet obtained the decisions on vocational training support shall be eligible for levels of vocational training support provided in this Decision.
2. The Prime Minister’s Decision No. 77/2014/QD-TTg of December 24, 2014, providing levels of vocational training support for workers covered by unemployment insurance, ceases to be effective on the effective date of this Decision.
3. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, and chairpersons of provincial-level People’s Committees shall implement this Decision.-
