SUMMARY

Task assignment of the Prime Minister and 4 Deputy Prime Ministers

On September 06, 2021, the Prime Minister issues the Decision No. 1460/QD-TTg on task assignment of the Prime Minister and Deputy Prime Ministers.

Accordingly, Prime Minister Pham Minh Chinh, Politburo member, Secretary of the Government's Party Civil Affairs Committee shall comprehensively lead and manage all activities within the ambit of the Government’s functions, tasks and powers. He shall personally direct and administer the following fields: National socio-economic development strategies and plans; Personnel work, apparatus organization, administration reform, state administrative boundaries, and general issues on emulation and commendation, etc.

Deputy Prime Minister Pham Binh Minh, Politburo member, Deputy Secretary of the Government's Party Civil Affairs Committee shall act as Permanent Deputy Prime Minister and personally direct and administer the following fields on behalf of the Prime Minister: Institutional building, development of the socialist law-governed State, judicial reform; Official development assistance (ODA) and mobilization of concessional loans, foreign non-governmental aid, international non-governmental organizations, etc.

This Decision takes effect on the signing date.

DECISION

On task assignment of the Prime Minister and Deputy Prime Ministers

THE PRIME MINISTER

 

Pursuant to the Constitution of the 2013 Socialist Republic of Vietnam;

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

At the proposal of the Minister and Chairman of the Government Office,

 

DECIDES:

 

Article 1. Task assignment principles and working relationship between the Prime Minister and Deputy Prime Ministers

1. The Prime Minister shall fully perform tasks and powers as prescribed in the Constitution and the Law on Organization of the Government; comprehensively lead and manage all activities of the Government, members of the Government, heads of government-attached agencies, Chairpersons of People's Committees at all levels; personally direct and administer major, important and strategic matters in all fields within the ambit of the Government’s functions, tasks and powers.

The Prime Minister shall assign Deputy Prime Ministers to assist the Prime Minister in monitoring, directing and handling regular works within the ambit of the Prime Minister in each working field of the Government. The Prime Minister shall not settle tasks, fields and matters that had been assigned to the Deputy Prime Ministers.

2. The Deputy Prime Minister shall assist the Prime Minister in performing tasks under the Prime Minister’s assignment; make decisions on behalf of the Prime Minister and take direct and comprehensive responsibilities before the Prime Minister and law for the tasks, fields and agencies assigned to monitor, direct and ensure progress level and quality of work. Regarding works related to other Deputy Prime Ministers, the Deputy Minister assigned to preside over shall actively, closely and effectively coordinate in settlement; if there are different opinions among Deputy Prime Ministers, the presiding Deputy Prime Minister shall report the Prime Minister for consideration and decision.

3. Within the ambit of assigned fields, the Deputy Prime Minister shall be on behalf of the Prime Minister:

- To direct ministries, sectors and localities to actively develop strategies, master plans and plans, mechanisms and policies, especially legal documents to promulgate under their competence or submit the Government or the Prime Minister; prepare urgent, unexpected and necessary work contents and report to the Government, the Government Permanent and the Prime Minister for consideration and decision.

- To develop mechanisms, regularly monitor, inspect and urge the organization and implementation of policies, laws and tasks of ministries, agencies and localities according to schedule while ensuring quality.

- To preside over and timely handle issues requiring inter-sectoral coordination and consider, settle petitions of ministries, sectors and localities under the Prime Minister's competence as assigned.

- To sign on behalf of the Prime Minister the documents under the competence of the Prime Minister or the documents under the competence of the Government within the fields or works uniformly assigned by the Prime Minister.

- To monitor and direct to handle within the competence issues related to officers and internal affairs of ministries and agencies as assigned according to regulations of the Party and State.

4. In the absence of the Prime Minister, a Permanent Deputy Prime Minister or another Deputy Prime Minister delegated by the Prime Minister shall lead the work of the Government on behalf of the Prime Minister.

5. In case of necessity or in the absence of the Deputy Prime Minister, the Prime Minister shall directly or assign other Deputy Prime Ministers to timely direct the work that had been assigned to the Deputy Prime Minister.

6. Based on actual situation in implementation organization, the Prime Minister shall consider adjusting or supplementing the task assignment of the Prime Minister and Deputy Prime Ministers mentioned in this Decision or irregular and urgent work that the Prime Minister considers necessary to ensure the tasks and powers of the Government and the Prime Minister in a timely, uninterrupted and effective manner.

Article 2. Task assignment of the Prime Minister and Deputy Prime Ministers

1. Prime Minister Pham Minh Chinh, Politburo member, Secretary of the Government's Party Civil Affairs Committee

a) To comprehensively lead and manage all activities within the ambit of the Government’s functions, tasks and powers.

b) To personally direct and administer the following fields:

- National socio-economic development strategies and plans.

- National financial, credit, monetary strategies and policies.

- National defense, security diplomacy strategies and assurance of national defense and security.

- Personnel work; apparatus organization; administration reform; state administrative boundaries, and general issues on emulation and commendation.

- Coordination between the Government and agencies of the Party, the National Assembly, the State President, the Vietnam Fatherlands Front Central Committee, and socio-political organizations.

c) To monitor and direct the Ministry of National Defence, the Ministry of Public Security, the Ministry of Home Affairs, the Vietnam News Agency, the Vietnam Television, the Voice of Vietnam, and the Ho Chi Minh Mausoleum Management Board.

d) To act as Head of the State Steering Committee for the East Sea and Islands, Head of the National Committee for E-Government, Chairman of the National Emulation-Commendation Council, Head of the National Steering Committee for Cyber Safety and Security, Head of the Government’s Steering Committee for Administrative Reform, Chairman of other national committees, councils and steering committees.

2. Deputy Prime Minister Pham Binh Minh, Politburo member, Deputy Secretary of the Government's Party Civil Affairs Committee

a) To act as Permanent Deputy Prime Minister.

b) To personally direct and administer the following fields on behalf of the Prime Minister:

- Institutional building, development of the socialist law-governed State, judicial reform.

- External affairs (including Party’s external affairs, State’s and people-to-people diplomacy).

- Official development assistance (ODA) and mobilization of concessional loans, foreign non-governmental aid, international non-governmental organizations.

- International integration, monitoring and directing the negotiation and implementation of multilateral and bilateral international commitments, ASEAN single-window mechanism, national single-window mechanism and trade facilitation, settlement of international disputes and complaints.

- Foreign direct investment (FDI), outbound investment.

- Relations between Vietnam and international and regional organizations; border, the East Sea and island issues.

- Overseas Vietnamese affairs and issues related to foreigners in Vietnam; human rights affairs.

- Ethnic and religious affairs; poverty reduction and regular issues related to emulation and commendation.

- Assurance of traffic order and safety.

- Crime prevention and combat; smuggling and trade fraud prevention and combat.

- Special amnesty.

- Coordination between the Government and the Supreme People’s Court and the Supreme People’s Procuracy.

c) To act on behalf of the Prime Minister in monitoring and directing the Ministry of Home Affairs, the Ministry of Justice, the Committee for Ethnic Minority Affairs, the Government Office, and the Vietnam Bank for Social Policies.

d) To act as Head of the National Steering Committee for International Integration, Chairman of the Vietnam-China Steering Committee for Bilateral Cooperation; in charge of the Vietnam-Laos Inter-governmental Committee; Head of the State Steering Committee for Land Border Demarcation and Border Marker Planting; Head of the State Steering Committee for Human Rights; Head of the Central Steering Committee for 3 National Target Programs on New-countryside Building for 2021-2025 period, Sustainable Poverty Reduction for the 2021-2025 period, Socio-economic Development in ethnic and mountainous areas for the 2021-2030 period; Head of the National Steering Committee for Combating Smuggling, Trade Fraud and Counterfeit Goods; Chairman of the National Steering Committee for ASEAN Single-Window, National Single-Window and Trade Facilitation; Chairman of the National Steering Committee for Traffic Safety; Chairman of the National Civil Aviation Security Committee; Chairman of other national councils, committees, and head of other steering committees in relevant fields.

dd)  To direct affairs of the Government on behalf of the Prime Minister in the absence of the Prime Minister and as authorized by the Prime Minister.

d) To perform other tasks as assigned or authorized by the Prime Minister.

3. Deputy Prime Minister Le Minh Khai, Secretary of the Party Central Committee, member of the Government's Party Civil Affairs Committee

a) To personally direct and administer the following fields on behalf of the Prime Minister:

- General economic affairs, including planning, finance, pricing, monetary-banking, capital market, securities market, financial investment sources, State reserves, macroeconomic forecasts and policies.

- State budget expenditures and use of State budget reserves, financial reserve fund, foreign exchange reserve fund, and other funds of the State; issuance of Government stocks and bonds.

- Salary and social insurance policies.

- Development of types of enterprises.

- Cooperative economy, cooperatives.

- Rearrangement and innovation of State-owned enterprises

- Inspection, and settlement of complaints and denunciations; anti-corruption.

b) To act on behalf of the Prime Minister in monitoring and directing the Ministry of Planning and Investment, the Ministry of Finance, the State Bank of Vietnam, the Government Inspectorate, the Commission for Management of State Capital at Enterprises, the Vietnam Social Security, the National Financial Supervisory Commission, the Vietnam Development Bank, and the Deposit Insurance of Vietnam.

c) To act as Chairman of the National Advisory Council for Financial and Monetary Policies, Head of the Central Steering Committee on Reforming Salary, Social Insurance and Preferential Policies, Head of the Steering Committee for Development and Reform of Collective Economy and Cooperatives, Head of the Steering Committee for Development and Renewal of Enterprises, Head of the Steering Committee for Settlement of Shortcomings and Weaknesses of Several Inefficient Projects and Enterprises of the Industry and Trade Sector, Chairman of other national councils and committees and head of other steering committees in relevant fields.

d) To perform other tasks as assigned or authorized by the Prime Minister.

4. Deputy Prime Minister Vu Duc Dam, member of the Party Central Committee, member of the Government's Party Civil Affairs Committee

a) To personally direct and administer the following fields on behalf of the Prime Minister:

- Education and vocational training.

- Science and technology.

- Labor, employment, and social affairs.

- Information and communication.

- Culture; tourism; sport and physical activities.

- Healthcare, population, family and children affairs.

b) To act on behalf of the Prime Minister in monitoring and directing the Ministry of Education and Training; the Ministry of Labor, Invalids and Social Affairs; the Ministry of Information and Communications; the Ministry of Science and Technology; the Ministry of Health; the Ministry of Culture, Sports and Tourism; the Vietnam Academy of Science and Technology, the Vietnam Academy of Social Sciences, the Vietnam National University (Hanoi), and the Vietnam National University (Ho Chi Minh City).

c) To act as Chairman of the National Education and Human Resource Development Council; Chairman of the Central Council for National Defense and Security Education; Chairman of the National Council for Sustainable Development and Competitiveness Improvement; Head of the State Steering Committee for Tourism; Head of the Interdisciplinary Steering Committee for Food Hygiene and Safety; Chairman of the National Committee for AIDS, Drug and Prostitution Prevention and Control; chairman of other national councils and committees, head of other steering committees in relevant fields.

d) To perform other tasks as assigned or authorized by the Prime Minister.

5. Deputy Prime Minister Le Van Thanh, member of the Party Central Committee, member of the Government's Party Civil Affairs Committee

a) To personally direct and administer the following fields on behalf of the Prime Minister:

- Industry, agriculture and rural development, trade - import and export, construction, transport, natural resources and environment.

- Climate change response strategies.

- National-level master plans, regional master plans, provincial master plans.

- Assurance of energy supply and efficient energy consumption.

- National key works and capital construction investment projects as regulated by the laws.

- Economic zones, industrial parks, processing zones, etc.

- Flood and storm prevention and control, search and rescue work.

b) To act on behalf of the Prime Minister in monitoring and directing the Ministry of Agriculture and Rural Development; the Ministry of Industry and Trade; the Ministry of Construction; the Ministry of Transport; the Ministry of Natural Resources and Environment.

c) To act as Chairman of the National Planning Council, Chairman of the National Council on Water Resources, Head of the National Steering Committee for Power Development, Head of the State Steering Committee for Key Petroleum Projects, Head of the State Steering Committee for Key Projects and Works of the Transport Sector; Head of the Steering Committee for Coordinating Development of Key Economic Regions, Head of the Central Steering Committee for Natural Disaster Prevention and Control, Head of the Central Steering Committee for Housing Policies and Real Estate Market, Chairman of the Sub-Committee of the Vietnam-Russia Inter-governmental Commission, chairman of other national councils and committees and head of other steering committees in relevant fields.

d) To perform other tasks as assigned or authorized by the Prime Minister.

Article 3. This Decision takes effect on the date of its signing.

Government members, heads of government-attached agencies, Chairpersons of the People’s Councils, and Chairpersons of People's Committees of provinces and centrally-run cities shall be responsible for the implementation of this Decision./.
