DECISION

On perfecting the State Steering Committee for key petroleum projects

THE PRIME MINISTER

Pursuant to the Law on Organization of the Government dated June 19, 2015; Law on Amending and Supplementing a Number of Articles of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Petroleum Law dated July 06, 1993; the Law Amending and Supplementing a Number of Articles of the Petroleum Law dated June 09, 2000; and the Law Amending and Supplementing a Number of Articles of the Petroleum Law dated June 03, 2008;

Pursuant to the Prime Minister's Decision No. 34/2007/QD-TTg dated March 12, 2007 on promulgating the Regulation on the establishment, organization and operation of inter-sectoral organizations;

At the proposal of the Minister of Industry and Trade,

DECIDES:

Article 1. To perfect the State Steering Committee for key petroleum projects (hereinafter referred to as the Steering Committee for short) to support the Government and the Prime Minister in directing the implementation of key petroleum projects with the components as follows:

1. Head of the Committee: Deputy Prime Minister Le Van Thanh.

2. Permanent Deputy Head of the Committee: Minister of Industry and Trade Nguyen Hong Dien.

3. Deputy Heads of the Committee:

- Chairman of the Commission for the Management of State Capital at Enterprises Nguyen Hoang Anh;

- Deputy Minister of Industry and Trade Dang Hoang An;

- Deputy Minister of Construction Le Quang Hung.

4. The Committee’s members include:

- Vice Chairman of the Government Office Nguyen Cao Luc;

- Deputy Minister of Planning and Investment Vo Thanh Thong;

- Deputy Minister of Finance Nguyen Duc Chi;

- Deputy Minister of Natural Resources and Environment Tran Quy Kien;

- Deputy Governor of the State Bank of Vietnam Dao Minh Tu;

- Chairman of the People's Committee of Quang Nam province Le Tri Thanh;

- Vice Chairman of the People's Committee of Thanh Hoa province Nguyen Van Thi;

- Vice Chairman of the People's Committee of Ba Ria - Vung Tau province Le Ngoc Khanh;

- Vice Chairman of the People's Committee of Quang Ngai province Vo Phien;

- Chairman of the Members' Council of Vietnam Oil and Gas Group Hoang Quoc Vuong;

- General Director of the Vietnam Oil and Gas Group Le Manh Hung.

Depending on the actual situation, the Head of the Steering Committee may additionally invite leaders of a number of agencies (the Committees of the National Assembly, ministries, sectors and localities) to participate as members of the Steering Committee or request leaders of ministries, sectors and localities to attend meetings of the Steering Committee and report necessary issues.

Article 2. Tasks and powers of the Steering Committee

1. Tasks:

a) Directing, inspecting and speeding up the implementation of the Prime Minister’s decisions on construction investment in key petroleum projects.

b) Directing related ministries, sectors, People's Committees of provinces, together with project owners, domestic and foreign consulting organizations, contractors to carry out the contents according to the tasks to ensure the construction progress and quality of works of key petroleum projects.

c) Directing and coordinating with relevant sectors and localities in addressing obstacles related to compensation, support, migration, resettlement and site clearance for key petroleum projects.

2. Powers:

a) Under authorization of the Prime Minister, the Committee shall make decisions on mechanisms and policies and directly handle specific issues under the Prime Minister that arise in the process of implementation of key petroleum projects; handle inter-sectoral problems related to key petroleum projects.

b) Periodically and irregularly reporting to the Prime Minister on construction progress and quality of works of key petroleum projects; contents beyond their competence, submitting solutions to the Prime Minister for consideration and decision.

c) The Head of the Steering Committee shall sign directing documents and use the seal of the Prime Minister; the Permanent Deputy Head, Deputy Heads and members of the Steering Committee shall sign directing documents and use the seals of their own ministries or agencies.

Article 3. Regulation and organization of operation

1. The Steering Committee shall operate under the regulation promulgated by the Head of the Steering Committee.

2. The Head, Deputy Heads and members of the Steering Committee shall work on a part-time basis.

3. The Steering Committee Office based at the Ministry of Industry and Trade shall assist the Steering Committee in works. The Permanent Deputy Head of the Committee - the Minister of Industry and Trade shall decide the establishment, define the tasks and payroll of the Steering Committee Office.

4. The Steering Committee may invite Vietnamese and foreign experts for consultation when necessary.

Article 4. Operation funding

1. Funding and other necessary conditions for the effective operation of the Steering Committee shall be arranged by the state budget. The operation funding of the Steering Committee Office shall be arranged by the Vietnam Oil and Gas Group in accordance with the law regulations.

2. On an annual basis, the Ministry of Industry and Trade shall be responsible for making budget estimates for the Steering Committee's activities and approving the operation funding estimates of the Steering Committee Office. The use of funding for the operations of the Steering Committee and the Steering Committee Office must ensure the right purposes and comply with the current law regulations on financial regimes.

Article 5. This Decision takes effect on the signing date and replaces the Prime Minister’s Decisions 274/QD-TTg dated March 07, 2018 and 498/QD-TTg dated May 03, 2019.

Article 6. The Head of the State Steering Committee for key petroleum projects, ministers, heads of ministerial-level agencies, heads of government-attached agencies and chairpersons of People’s Committees of provinces and central affiliated cities, members of the Steering Committee and related units shall take responsibilities for the implementation of this Decision./.
