DECISION
Prescribing the roadmap for application of the National Technical Regulation on emissions of in-use motorcycles and mopeds
Pursuant to the Law on Organization of the Government No. 63/2025/QH15;
Pursuant to the Law on Organization of Local Administration No. 72/2025/QH15;
Pursuant to the Law on Environmental Protection No. 72/2020/QH14, as amended and supplemented by Law No. 11/2022/QH15, Law No. 16/2023/QH15, Law No. 18/2023/QH15, Law No. 47/2024/QH15, Law No. 54/2024/QH15 and Law No. 146/2025/QH15;
Pursuant to the Law on Road Traffic Order and Safety No. 36/2024/QH15;
At the proposal of the Minister of Agriculture and Environment;
The Prime Minister promulgates the Decision on the roadmap for application of national technical regulations on emissions of in-use motorcycles and mopeds.
Article 1. Scope of Regulation
This Decision prescribes the roadmap for application of national technical regulations on emissions of in-use motorcycles and mopeds in the territory of Vietnam.
Article 2. Subjects of application
1. This Decision applies to organizations and individuals involved in the management, inspection and use of in-use motorcycles and mopeds.
2. This Decision does not apply to motorcycles and mopeds under the management of the Ministry of National Defense or the Ministry of Public Security used for defense and security purposes.
Article 3. Interpretation of terms
1. In-use motorcycles mean motor vehicles specified at Point e, Clause 1, Article 34 of the Law on Road Traffic Order and Safety that have been granted with vehicle registration certificates and number plates in accordance with Vietnam's regulations.
2. In-use mopeds mean motor vehicles specified at Point g, Clause 1, Article 34 of the Law on Road Traffic Order and Safety that have been granted with vehicle registration certificates and number plates according to Vietnam's regulations.
3. Emission tiers (including Tier 1, Tier 2, Tier 3 and Tier 4) are the emission standards applicable to motorcycles and mopeds prescribed in the National technical regulation on emissions of in-use motorcycles and mopeds, promulgated by the Ministry of Agriculture and Environment.
Article 4. Roadmap for application of technical regulation on emissions
1. Commencement time for the implementation of exhaust emission inspection for in-use motorcycles and mopeds:
a) From July 1, 2027 for Hanoi and Ho Chi Minh City;
b) From July 1, 2028 for other centrally-run cities;
c) From July 1, 2030 for other provinces. Depending on practical conditions, these provinces may stipulate an earlier implementation date.
2. Motorcycles manufactured or imported before 2008 shall be subject to Tier 1 - Maximum allowable emission limit prescribed in the National Technical Regulation on emissions of in-use motorcycles and mopeds.
3. Motorcycles manufactured or imported from 2008 to the end of 2016 shall be subject to Tier 2 - Maximum allowable emission limit prescribed in the National Technical Regulation on emissions of in-use motorcycles and mopeds.
4. Motorcycles manufactured or imported from 2017 to June 30, 2026 shall be subject to Tier 3 - Maximum allowable emission limit prescribed in the National Technical Regulation on emissions of in-use motorcycles and mopeds.
5. Motorcycles manufactured or imported from July 1, 2026 shall be subject to Tier 4 - Maximum allowable emission limit prescribed in the National Technical Regulation on emissions of in-use motorcycles and mopeds.
6. Motorcycles manufactured or imported before 2016 shall be subject to Tier 1 - Maximum allowable emission limit prescribed in the National Technical Regulation on emissions of in-use motorcycles and mopeds.
7. Motorcycles manufactured or imported from 2017 to June 30, 2027 shall be subject to Tier 2 - Maximum allowable emission limit prescribed in the National Technical Regulation on emissions of in-use motorcycles and mopeds.
8. Motorcycles manufactured or imported from July 1, 2027 shall be subject to Tier 4 - Maximum allowable emission limit prescribed in the National Technical Regulation on emissions of in-use motorcycles and mopeds.
9. From January 1, 2028, in-use motorcycles and mopeds in traffic operating within Hanoi and Ho Chi Minh City must comply with the emission regulation of Tier 2 or higher.
10. In-use motorcycles and mopeds in traffic operating in the "low-emission zone" of Hanoi city under the Law on Capital must comply with regulations on emissions according to the Resolution of the People's Councils of Hanoi city.
Article 5. Organization of implementation
1. The Ministry of Agriculture and Environment shall
a) Organize the implementation; propagate and disseminate for the implementation of this Decision;
b) Based on the practical condition, continue to study and formulate regulations on raising the emission tier of in-use motorcycles and mopeds and submit them to the Prime Minister for promulgation of the following roadmap.
2. The Ministry of Construction shall
a) Formulate and provide guidance on organizing the implementation of regulations on inspection and certification of motorcycles and mopeds meeting the emission tiers prescribed in this Decision; provide regulations on the issuance of inspection certificates showing the tier of emissions achieved; inspect and supervise the implementation of emission inspections of motorcycles and mopeds in compliance with this Decision;
b) Assume the prime responsibility for developing an information system serving the management of exhaust emission inspections for motorcycles and mopeds; share information on inspection establishments and data on exhaust emission inspections of motorcycles and mopeds with the Ministry of Public Security, the Ministry of Agriculture and Environment and localities to perform the function of state management and the imposition of administrative sanctions;
c) Formulate and promulgate regulations on maximum prices for emission inspection services of motorcycles and mopeds in accordance with the Law on Prices;
d) Coordinate with the Ministry of Agriculture and Environment in carrying out activities of propagating and disseminating to the community about exhaust emission inspection of motorcycles and mopeds.
3. The Ministry of Industry and Trade shall
Assume the prime responsibility for, and coordinate with relevant ministries and sectors in, ensuring the production, importation and supply of fuels used for motorcycles and mopeds that are of a quality meeting the national technical regulations on gasoline, diesel fuel and biofuels; that conform to the technical regulations and roadmaps for application of emission tiers prescribed in this Decision.
4. The Ministry of Science and Technology shall
a) Study and review the national technical regulations on fuel in order to amend and supplement such regulations in conformity with the roadmap for application of emission tiers prescribed in this Decision;
b) Assume the prime responsibility for organizing the inspection of exhaust emission-measuring equipment in accordance with the law on measurement that meet the requirements for exhaust emission inspection of motorcycles and mopeds consistent with the roadmap for application of the emission tiers prescribed in this Decision.
5. The Ministry of Finance shall
Formulate preferential policies on taxes and fees; direct and indirect financial support policies to promote the development of exhaust inspection establishments for motorcycles and mopeds and to support users in vehicle transitioning.
6. The Ministry of Public Security shall
a) Direct and guide local police forces to inspect and control in-use motorcycles and mopeds in traffic to ensure compliance with the emission tiers prescribed in this Decision; based on exhaust emission inspection data, handle violations of regulations on emission tiers as prescribed;
b) Share the data on registration of motorcycles and mopeds with the Ministry of Construction and the Ministry of Agriculture and Environment to serve the exhaust emission inspection.
7. Ministries, ministerial-level agencies and government-attached agencies shall, within the ambit of their assigned functions and tasks, coordinate with the Ministry of Agriculture and Environment and the Ministry of Construction in implementing this Decision.
8. Provincial-level People's Committees shall
a) Formulate a plan for development of a system of exhaust emission inspection establishments for motorcycles and mopeds to ensure that the inspection needs within their locality are fully met, in accordance with the practical conditions in the locality, current regulations and the guidance of the Ministry of Construction;
b) Organize the exhaust emission inspections of motorcycles and mopeds in the localities under their management; coordinate with the Ministry of Science and Technology in managing, inspecting and supervising fuel quality when circulating on the market;
c) Based on the socio-economic conditions and requirements of environmental protection in the locality, where necessary, formulate and submit to the People's Councils of the same level for consideration and decision on promulgation of separate regulations on low-emission areas and zones or areas and zones of restriction of motorcycle and moped circulation; prescribe a more stringent roadmap for applying emission tiers in the locality than those prescribed in this Decision, ensuring compliance with the Law on Environmental Protection and the Law on Road Traffic Order and Safety; mobilize resources to support low-income groups in replacing vehicles that have been used for many years and have a high risk of causing pollution when they do not meet the emission levels in the areas under their management;
d) Adopt measures to mobilize and allocate resources to provide the exemption from the fee for the initial exhaust emission inspection for motorcycles and mopeds within the locality.
Article 6. Effect and implementation
1. This Decision takes effect from May 16, 2026.
2. Within 18 months from the commencement time of exhaust emission inspections of motorcycles and mopeds in the provinces and cities prescribed in Clause 1, Article 4 of this Decision, in-use motorcycles and mopeds in traffic must undergo exhaust emission inspection. After this period, the competent authorities shall conduct inspection, supervision and handling of violations according to regulations.
3. Citizens are encouraged to undergo the exhaust emission inspection of motorcycles and mopeds prior to the prescribed deadline for exhaust emission inspections.
4. Any difficulties or problems arising in the course of implementation of this Decision should be promptly reported by ministries and provincial-level People's Committees to the Ministry of Agriculture and Environment and the Ministry of Construction for study, report and submission to the Prime Minister for consideration of appropriate amendments and supplements.
5. Ministers, Heads of ministerial-level agencies, Heads of Government-attached agencies, chairpersons of provincial-level People's Committees and related organizations and individuals shall implement this Decision./.
