DECISION

On establishing Vietnam National Innovation Center

THE PRIME MINISTER

Pursuant to the Law on Organization of the Government of June 19, 2015;

Pursuant to the Decree No. 55/2012/ND-CP dated June 28, 2012 of the Government on the establishment, reform, and dissolution of public service providers;

Pursuant to the Decree No. 16/2015/ND-CP dated February 14, 2012 of the Government on the autonomy mechanism of public service providers;

Pursuant to the Decree No. 141/2016/ND-CP dated October 10, 2016 of the Government on the autonomy mechanism of public service providers in economic sector and other sector;

At the proposal of the Minister of Planning and Investment,

DECIDES:

Article 1. To establish Vietnam National Innovation Center as a public service provider in economic sector, guarantee their regular expenses and investment expenses by itself. This Center affiliates to the Ministry of Planning and Investment and aims to support and develop the startup ecosystem, innovation, contribute in the renewal of growth model on the basis of science and technology.

The international name of this Center shall be Vietnam National Innovation Center (arbitration is NIC).

Vietnam National Innovation Center shall have its headquarter located in Hanoi, operative facility in Hoa Lac Hi-Tech Park, have legal entity, have its own seal and be able to open bank account in commercial banks.

Vietnam National Innovation Center shall operate in autonomy regime under legal provisions.

Article 2. Implementation

1. The Ministry of Planning and Investment shall:

a) Detail functions, tasks, powers and organize structure of Vietnam National Innovation Center; approve the Regulation on organizing and operating of Vietnam National Innovation Center; decide on establishment and approve the regulation on organizing and operating of the Management Board of Vietnam National Innovation Center.  

b) To mobilize, manage and use legal resource of domestic and foreign organizations and individual to serve Vietnam National Innovation Center operation.  To take charge and cooperate with the Ministry of Finance in reviewing and suggesting competent agencies to use mobilized resource to serve the target of establishing and operating Vietnam National Innovation Center.

c) To construct infrastructure of Vietnam National Innovation Center in comply with public investment legal provisions (in case of using State budget) and other relevant legal provisions.

2. The Ministry of Science and Technology shall take charge and cooperate with Ministry of Planning and Investment in command the Management Board of Hoa Lac Hi-Tech Park to support for procedure completion of investment and operation implementation of Vietnam National Innovation Center in Hoa Lac Hi-Tech Park.

3. The Ministry of Finance shall take charge and cooperate with Ministry of Planning and Investment in review and issue guiding documents for management and usage of grants for Vietnam National Innovation Center.

4. Hanoi People’s Committee shall assist in location, investment procedures and construction of operation facility of Vietnam National Innovation Center.

Article 3. Implementation provision

1. This Decision takes effect on the date of its signing.

2. The Ministers, the Heads of the ministerial-level agencies, the Heads of agencies affiliated to the Government and the Chairmen of the provincial and central affiliated cities People’s Committees shall be responsible to implement this Decision.
