DECISION
On the promulgation of the List of imports (with HS codes)
subject to specialized inspection under the management of the Ministry of Industry and Trade

THE MINISTER OF INDUSTRY AND TRADE
Pursuant to the Law on Product and Goods Quality dated November 21, 2007;
Pursuant to the Law on Food Safety dated June 17, 2010;
Pursuant to the Law on Economical and Efficient Use of Energy dated June 17, 2010;
Pursuant to the Law on Foreign Trade Management dated June 12, 2017;
Pursuant to Decree No. 98/2017/ND-CP dated August 18, 2017 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decree No. 132/2008/ND-CP dated December 31, 2008 of the Government detailing a number of articles of the Law on Product and Goods Quality, of which a number of articles are amended and supplemented in the Government’s Decree. No. 74/2018/ND-CP dated May 15, 2018 and Decree No. 154/2018/ND-CP dated November 9, 2018;
Pursuant to Decree No. 15/2018/ND-CP dated February 2, 2018 of the Government detailing the implementation of a number of articles of the Law on Food Safety;
Pursuant to Decree No. 69/2018/ND-CP dated May 15, 2018 detailing a number of articles of the Law on Foreign Trade Management;
Pursuant to Decree No. 85/2019/ND-CP dated November 14, 2019 prescribing the performance of administrative procedures under the national single-window mechanism and ASEAN Single-Window mechanism and specialized inspection of imports and exports;
Pursuant to the Prime Minister's Decision No. 04/2017/QD-TTg dated March 9, 2017 on the List of equipment and appliances to which the mandatory energy labeling and minimum energy efficiency standards are applied, and the roadmap to their implementation;
Pursuant to the Prime Minister’s Decision No. 24/2018/QD-TTg dated May 18, 2018 on the promulgation of the list of low-efficiency equipment that has to be discarded and low-efficiency generating sets that are prohibited from being built, and the implementation roadmap thereof;
Pursuant to Circular No. 41/2015/TT-BCT dated November 24, 2015 of the Minister of Industry and Trade prescribing the list of potentially unsafe products and goods under the management responsibility of the Ministry of Industry and Trade, of which a number of articles are amended and supplemented in Circular No. 29/2016/TT-BCT dated December 13, 2016 and Circular No. 33/2017/TT-BCT dated December 28, 2017 of the Minister of Industry and Trade;
Pursuant to Circular No. 36/2019/TT-BCT prescribing the quality management of products and goods under the management responsibility of the Ministry of Industry and Trade;
Pursuant to Circular No. 43/2015/TT-BCT dated November 15, 2018 prescribing the management of food safety under the responsibility of the Ministry of Industry and Trade;
Pursuant to Circular No. 65/2017/TT-BTC dated June 27, 2017 of the Minister of Finance promulgating the List of Vietnam's exports and imports, of which a number of contents are amended and supplemented in Circular No. 09/2019/TT-BTC dated February 15, 2019 of the Minister of Finance;
At the proposal of the Director of the Department of Science and Technology,
HEREBY DECIDES:
Article 1. To promulgate a list of imports (with their respective HS codes) subject to specialized inspection under the management responsibility of the Ministry of Industry and Trade in Appendices No. 1, 2 and 3 to this Decision.
Article 2. Organization of implementation
1. The Department of Science and Technology is assigned: (i) To assume the prime responsibility for, and coordinate with relevant agencies and units in, reviewing, updating and announcing the list of good (with their respective HS codes) subject to specialized inspection under the management responsibility of the Ministry of Industry and Trade in line with the State management requirements over time; (ii) To promptly guide and solve arising problems (if any) related to the specialized inspection of goods stated in the list in Appendix 2 to this Decision.
2. The Industrial Safety Techniques and Environment Agency and the Vietnam Chemicals Agency are assigned to assume the prime responsibility for, and coordinate with relevant agencies and units in, promptly guiding and solving any arising problems (if any) related to the specialized inspection of goods stated in the list in Appendix 1 of this Decision.
3. The Energy Efficiency and Sustainable Development Department is assigned to assume the prime responsibility for, and coordinate with relevant agencies and units in, promptly guiding and solving any arising problems (if any) related to the specialized inspection of goods stated in the list in Appendix 3 to this Decision.
Article 3. Implementation provisions
1. This Decision takes effect from the date of signing for promulgation.
2. This Decision replaces Decision No. 1325A/QD-BCT dated May 20, 2019 of the Minister of Industry and Trade promulgating the list of goods (with HS codes) subject to specialized inspection under the management responsibility of the Ministry of Industry and Trade.
3. In cases where the legal documents referred to in this Decision are replaced or supplemented, the newly-promulgated ones shall prevail.
Article 4. Chief of Ministerial Office, Directors of the Department of Science and Technology and the Energy Saving and Sustainable Development Department, Directors of the Industrial Safety Techniques and Environment Agency and the Vietnam Chemicals Agency, Heads of units under the Ministry of Industry and Trade as well as relevant organizations and individuals shall be responsible for the implementation of this Decision./.
