DECISION

AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF THE PRIME MINISTER'S DECISION NO. 31/2000/QD-TTG OF MARCH 2, 2000 ON THE SETTING UP OF ANTI-DRUG FUNDS

THE PRIME MINISTER

Pursuant to the December 25, 2001 Law on Organization of the Government;

Pursuant to the December 16, 2002 Law on State Budget;

Pursuant to the action program on drug prevention and combat in the 2001-2005 period;

At the proposal of the Minister of Finance,

DECIDES:

Article 1.- To amend and supplement Article 4 and Clause 1 of Article 5 of the Prime Minister's Decision No. 31/2000/QD-TTg of March 2, 2000 on the setting up of Anti-Drug Funds as follows:

1. To amend and supplement Article 4 as follows:

"Article 4.-

1. Local Anti-Drug Funds shall be used for the following:

a/ To support units directly engaged in drug-related crime prevention and combat; and procurement of equipment in service of drug prevention and combat.

b/ To support relatives of those who die, get injured or fall sick due to their direct engagement in drug-related crime prevention and combat, narcotics-bearing plant elimination and replacement, or organization of drug detoxication.

c/ To commend and/or reward units and individuals that record achievements in the work of drug prevention and combat.

d/ To support other activities related to drug prevention and combat.

2. The Central Anti-Drug Fund shall be used to support unexpected or urgent tasks related to drug prevention and combat involving many provinces and centrally-run cities."

2. To amend and supplement Clause 1 of Article 5 as follows:

"1. The proceeds from drug-related criminal cases, which are tried by the People's Courts, prescribed in Clause 1, Article 2 of Decision No. 31/2000/QD-TTg of March 2, 2000, are distributed as follows:

a/ To deduct 30% to support or reward units and individuals directly engaged in detection or investigation of the cases;

b/ To deduct 60% for the Anti-Drug Funds of the provinces or the centrally-run cities where the cases are tried by the People's Courts;

c/ To deduct 10% for the Central Anti-Drug Fund."

Article 2.- This Decision takes implementation effect 15 days after its publication in the Official Gazette.

Article 3.- The Ministry of Finance shall assume the prime responsibility for, and coordinate with the Ministry of Public Security and the Ministry of Defense in, guiding the implementation of this Decision. The ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government and the presidents of the People's Committees of the provinces and centrally-run cities shall have to implement this Decision.
