Pursuant to Decree No. 215/2013/ND-CP dated 23/12/ 2013 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Finance;

Pursuant to the Resolution No. 19/NQ-CP dated 12/3/2015 of the Government on essential duties and solutions to continue improving the business environment and national competitiveness during 2016-2017 with a vision to 2020

Pursuant to the Resolution No. 19-2016/NQ-CP dated 28/4/ 2016 of the Government on essential duties and solutions to continue improving the business environment and national competitiveness during 2016-2017 with a vision to 2020;

Considering the recommendation of the Director General of Department of Legal Affairs,

DECIDES:

Article 1. To issue with this Decision is the Action Plan of the Ministry of Finance in implementing the Resolution No. 19-2016/NQ-CP dated 28/4/2016 of the Government on essential duties and solutions to continue improving the business environment and national competitiveness during 2016-2017 with a vision to 2020.

Article 2. This Decision takes effect on the signing date.

Article 3.Chief of Ministerial Office, Director General of Department of Legal Affairs and Heads of the relevant Ministries shall implement this Decision./.

ACTION PLAN

ON THE IMPLEMENTATION OF THE RESOLUTION NO. 19-2016/NQ-CP DATED 28/4/2016 OF THE GOVERNMENT ON ESSENTIAL DUTIES AND SOLUTIONS TO CONTINUE IMPROVING THE BUSINESS ENVIRONMENT AND NATIONAL COMPETITIVENESS DURING 2016-2017 WITH A VISION TO 2020
(Issued with Decision No. 1134/QD-BTC dated 23/5/2016 of the Minister of Finance)

I.Objectives and requirements

During 2016-2017 with a vision to 2020, with the objectives to continue improving the business environment and contribute to improving the national competitiveness. In the financial field, it is required to harmoniously and comprehensively carry out the solutions to administrative reform focusing on continuing to support and remove difficulties in production and business; promoting the reform of procedures for tax administration and customs, shortening the process of processing, modernization and applying information technology in state management, reducing the time to go through the administrative procedures to ensure the publicity and transparency and enhance the accountability of state administrative bodies; comprehensively reforming the regulations on specialized management over the goods and import and export services in accordance with the international practices to achieve the following objectives and requirements:

- Reaching the average level of ASEAN -4 concerning the tax administration reform including 03 indicator groups: tax refund; risk management in tax inspection and examination; time and settlement result of tax complaint.

- Reducing the time of customs clearance of goods across border up to 10 days for the imported goods and 12 days for imported goods.

- Annulling the administrative procedures which are no longer appropriate to ensure the reduction of at least 10% of costs of compliance with administrative procedures.

- Minimizing the paperwork, reducing the time and costs to go through the administrative procedures in the field of import and export. Basically change the mode of specialized management and inspection on the basis of risk management principles, widely apply the international practices, transfer from pre-customs clearance inspection to post-customs clearance inspection, electronize the procedures for specialized management and inspection; connect and share information between the bodies and organizations of specialized management and inspection and with customs bodies.

- Continuing to improve the institution to develop the financial market and services to create the favorable, fair and transparent business environment for enterprises and people; ensuring the availability indicator and adequacy of financial services of the group of 50 leading countries.

- Coordinating to restrict the non-tariff barrier of the group of 40 leading countries.

The goal by 2020 is that the time to pay tax is 110 hours/year maximally; the time of customs clearance of goods across borders is under 36 hours for exported goods and 41 hours for imported goods.

II.Duties

To improve the business and production environment, enhance the national competitiveness, strive to achieve the indicators specified in the Resolution No. 19/NQ-CP dated 28/4/2016 of the Government, the Ministry of Finance shall focus on the following duties (attached assignment Appendix).

1. In the field of customs

Based on the objectives, duties and solutions according to the management field of the Ministry of Finance, in the field of customs, there are 04 groups of duty with 39 solutions associated with the output products, particularly:

(i) About improving the legal system:

- Developing, amending and adding the document system detailing the Law on import and export tax with expected 14 Decrees and 01 Circular.

- Developing, amending and adding the document system detailing the Customs Law with expected 02 Decrees and 01 Decision of the Prime Minister and 01 Circular.

- Developing the legal normative documents to implement the one-stop shop mechanism with expected 01 Decision of the Prime Minister and 03 Circulars.

(ii) Improving the effectiveness of specialized inspection

- Actively coordinating with the Ministries and sectors to amend the legal normative documents related to the specialized management in the field of customs:

+ Amending the legal normative documents on specialized management under the Decision No. 2026/QD-TTg of the Prime Minister (87 documents).

+ Developing and fully issuing the List of items subject to specialized inspection towards narrowing the specialized inspection status, detail of HS code; issuing the national technical regulations and standards to the goods subject to specialized inspection as a basis for inspection of quality of products and goods.

+ Promoting and encouraging the assessment of suitability for participating in specialized inspection to the imported and exported goods towards the socialization to add the inspection grounds to meet the requirements for strong development of import and export activities and save the state investment resources.

+ Reforming the method of specialized inspection towards creating the favorable conditions for import and export activities, reducing costs and shortening the time of customs clearance of goods.

- Deploying the operation of Customs Inspection Department, establishing some Inspection Branches directly under the Customs Inspection Department situated at Customs Departments of some large cities and provinces.

- Expanding the specialized inspection with the inspection locations at border gate.

(iii) Improving the national one-stop shop and Asean one-stop shop mechanism:

- Developing the general Plan to implement the one-stop shop mechanism for the period 2016-2020.

- Strengthening and expanding nationwide with the administrative procedures officially connected implemented through the national one-stop shop mechanism.

- Expanding a number of administrative procedures based on the registered list of administrative procedures the Ministries and sectors.

- Making electronic payment on the national one-stop shop Portal.

- Expanding nationwide the procedures for vehicles and goods transported in and out of sea ports, inland water ports, offshore gas and oil port; the procedures for means of transportation in and out of airport via the one-stop shop mechanism.

- Applying the administrative procedures included in the list of the Ministries: Ministry of Industry and Trade, Ministry of Transport, Ministry of Science and Technology, Ministry of Agriculture and Rural Development, Ministry of Natural Resources and Environment and Ministry of Health.

- Applying all administrative procedures of the Ministries and sectors involved in management of imported and exported goods, goods in transit, people and means of transportation entering and exiting not via the national one-stop shop mechanism.

- Using the electronic documents (e-permit, e-certificate and equivalent electronic papers) issued via the national one-stop shop mechanism when carrying out the other relevant administrative procedures.

- Expanding the system to receive and process information about e- Manifest for all sea ports and airports on a national scale.

- Developing and studying to implement the connection with Asean in the framework of Protocol No.2 and No.7 on transit.

- Participating in connection with ASEAN one-stop shop mechanism right after the 10 member countries approve the Protocol on legal framework to apply e ASEAN one-stop shop mechanism.

- Exchanging and mutually accrediting the commercial documents issued in electronic form with ASEAN countries and the exchanges and processing of commercial documents with the countries, economic block - community under international agreements and commitments.

(iv) About other tasks

- Improving and enhancing the effectiveness of automatic customs clearance system VNACCS/VCIS:

+ Maintaining, monitoring and operating the VNACCS/VCIS system with stability, security and safety 24 hours a week.

+ Investing in procurement to improve the capacity of management, monitoring and operation 24 hours a week and material facility of data center of customs sector.

+ Ensuring the full and timely procurement of support, maintenance and warranty of VNACCS/VCIS system and technical infrastructure.

+ Procuring backup equipment for one-stop customs system of the customs sector.

+ Preparing the recommendations and necessary conditions to effectively implement stage 2 of VNACCS/VCIS Project upon approval from Japanese Government.

+ Successfully implementing JICA Project to technically support and improve the effectiveness of VNACCS/VCIS electronic customs clearance for the period 2015-2018.

- Connecting and exchanging information by the electronic method of goods at the port in order to reduce the paperwork and increase the state effective management for the goods and containers at sea ports.

+ Developing the legal documents to ensure the connection and exchange of information of bodies at sea ports.

+ Developing the procedures for connection and exchange of information.

+ Developing the goods management subsystem at sea ports.

- Coordinating with commercial banks to expand the electronic payment according to the Circular No. 184/2015/TT-BTC.

- Reducing the inspection rate of yellow and red lane:

+ Monitoring and inspecting the application of criteria based on the result of analysis and risk assessment towards the local Customs Departments in accordance with the provisions under Point d, Clause 2, Article 50 of Decision No. 464/QD-BTC dated 29/06/2015 of the Ministry of Finance on risk management in customs activities and Article 62 of Decision No. 282/QD-TCHQ dated 4/2/2015 of the General Department of Customs on recognizing the prioritized enterprises.

+ Strengthening the inspection to reduce the percentage of inspection channel transfer of the Customs Branch while strictly handling the cases of arbitrary channel transfer.

+ Developing and implementing the List of risk goods towards the non-compliant enterprises and high-risk enterprises.

- Developing the legal grounds to implement the model of document verification and actual goods verification in the direction of concentration for many Customs Branches.

- Developing the mechanisms to control the origin, intellectual property right and management regime for the types of goods and means of transportation in line with commitment to following the roadmap.

- Providing 49 online public services at level 3 in 2016. By the end of 2017, 100% public services must be provided online at least at level 3 and 70% of public services in the major fields of Customs sector is provided online at level 4.

2. In the field of taxation

Based on the objectives, duties and solutions in the field of management of the Ministry of Finance. In the field of taxation, there are 07 duties and 21 solutions, particularly as follows:

(i) About application of information technology

- Application of information technology reaches at least 95% in submission of declaration and tax payment:

+ During 2016-2017, there must be a percentage of 95% of enterprises making declaration and tax payment at level 4; applying the electronization from the General Department of Taxation to Taxation Branches; the tax officers and public servant perform duties from paper documents to be transferred to electronic documents.

+ Reviewing and studying the regulation on electronic trading in the financial field in the direction of expansion without limit of commercial banks involved in tax collection.

+ Reviewing and improving the tax law towards business households.

+ Studying and developing the central database on business households to be applied in the entire system of tax bodies.

+ Making plan and applying the electronic declaration and tax payment for business individuals.

- Applying the information technology in electronic tax refund; publicizing the database on tax refund to ensure 100% of tax refund files are verified:

+ Developing the legal grounds and infrastructure conditions for electronic refund of VAT, including: developing circulars guiding VAT refund; upgrading the application of tax management and database on tax refund; developing the risk criteria and classification of VAT refund; upgrading portal to receive and return the electronic tax refund documents.

+ Studying and improving the regulations on management of personal income tax (deduction of personal income tax upon income generation and late payment penalties on individuals with income).

- Studying the pilot electronic tax transaction for the automobile and motorcycle registration.

(ii) Ensuring 100% of complaint documents of taxpayers are settled on schedule as prescribed by law; carry out the publicity and transparency in accordance with regulations of tax management Law and the procedures for inspection and complaint settlement and VAT refund through the improvement of software and database of complaint settlement.

(iii) Continuing the issue of automatic tax code and decentralizing the management tax bodies towards the enterprises on a national scale:

- Studying and developing the mechanism of issue of automatic tax code to enterprises on a national scale.

- Continuing the coordination with the business registration bodies to issue the tax code automatically to the enterprises as guided in Circular No. 127/2015/TT-BTC.

- Developing the tax agent system and providing the VAT services on electronic transaction in tax payment (T-VAN).

- Strengthening the development of taxpayer assistance propagation Centers and providing the human resource to meet the management requirements.

(iv) Developing Decrees on prevention of price transfer and tax evasion.

 (v) Submitting the Resolution on removal of tax difficulties for enterprises for submission to the National Assembly in 2016; handling the late payment debts for enterprises with objective difficulties; studying and recommending the implementation of income offsetting from the immovable property with income from the business and production activities (bilateral clearing).

(vi) Ensuring the progress of development and submission to the competent level (National Assembly Standing Committee, Government) to issue the documents guiding and detailing the implementation of Law on fees and charges; reviewing and amending the regulations on specialized inspection towards reducing the costs for enterprises and transparency of fee payment responsibility.

Submitting the Decree detailing and guiding the implementation of Law amending 03 Tax Laws (VAT, Special Consumption Tax and the Law on Tax Administration).

(vii) Actively coordinating with the Ministries and sectors to:

- Develop the connected process between the tax bodies and land registration office/land use right registration office/police bodies.

- Coordinating with the Ministry of Transport to review, amend or add the relevant legal normative documents to ensure the publicity and transparency in charges and extra charges.

3. Other duties in the financial fields.

Based on the Objectives under the management area of the Ministry of Finance, in addition to tax and customs areas, there are 13 solutions in other areas, particularly:

(i) Ensuring the development of Decrees of the Government on conditions for investment and business in line with prescribed time limit of the Investment Law 2014.

(ii) Publicizing the conditions for investment and business on Portal.

(iii) Developing and basically completing the information technology infrastructure system of the financial sector; promoting the application of information technology in dealing with administrative procedures to ensure the provision online public services at level 3-4.

(iv) Publicizing the standardized administrative procedures on the national database before 30/6/2016; completing the standardization of set of administrative procedures according to the Decision No. 8/QD-TTg dated 6/1/2015 of the Prime Minister; making the public, full and timely listing of administrative procedures under settlement authority on internet and at head office of units.

(v) Implementing and dealing with reflections and recommendations and settlement results of administrative procedures so that people and enterprises can assess and reflect the policies and administrative procedures and the duty performance of officers and public servants who directly settle the administrative procedures.

(vi) Applying the ISO quality management system in activities of bodies and units.

(vii) Actively coordinating with the Ministry of Natural Resources and Environment to publicize the unused land fund, leased land, land fund assigned by the state,...

(viii) Coordinating with the Ministry of Foreign Affairs and the Ministry of Industry and Trade to portage, disseminate and provide information on the signed FTA and TPP Agreements and portage and disseminate the international commitments and provide assistance for enterprises to promote their trade in foreign countries.

(ix) Continuing the training to improve the quality of contingent of officials and public servants; upholding the spirit and attitude of serving people; strengthening law and discipline; focusing on effective implementation of Plan of promoting the reform of public duty and public servant regime according to Decision No. 1557/QD-TTg dated 18/10/2012 of the Prime Minister.

(x) Strengthening the apparatus to meet the requirements for administrative reform; transforming the management mode at the units of the Ministries to improve the effectiveness and efficiency of state management and implement the assigned duties in Resolution No. 19-2016 / NQ-CP.

(xi) Reviewing and simplifying the unnecessary administrative procedures to create favorable conditions, reduce time and 10% of cost of compliance and carry out the administrative procedures in the financial fields.

(xii) Making plans for simplifying the administrative procedures in the financial field related to the citizen papers and national database on population (Plan 896). On that basis, submitting the Resolution on simplification plan in the financial field to the Government.

(xiii) Strengthening the inspection of compliance with administrative procedures and publicizing and transparentizing the activities of bodies, organizations and units that deal with the administrative procedures; detecting and strictly handle the officials and civil servants who commit acts of harassment and obstruction to the  organizations and individuals while on duty.

III.Implementation

1. Heads of ministerial units

- Make plan to perform the assigned duties in the action Plan and concretizing the duties into solutions, Plans, activities and output results to build the work programs of their units.

On a quarterly basis (before the 10th date of the last month of quarter) and on a annual basis (before the 10th date of December), make report on result of assigned duty performance to the Department of Legal Affairs for aggregation and submission to the Ministry for report to the Prime Minister and the National Council for Sustainable Development and Competitiveness Building in accordance with the provisions in the Resolution No. 19/NQ-CP of the Government.

 - Effectively carry out the administrative reform at their units under the administrative reform Plan and the administrative procedure Plan approved by the Ministry.

2. The Department of Personnel Organization shall

- Coordinates with the relevant units to strengthen the apparatus and organization towards downsizing and improvement of effectiveness and quality of officials and public servants, upholding the spirit and attitude of serving people; strengthens the financial laws and discipline.

- Improves and implements the job placement plan for units under the ministerial management.

3. The Department of Legal Affairs shall

- Monitor, urge and inspect the units under the ministerial management to perform the duties assigned in the action Plan, promptly report to the Ministry On the problems and difficulties during the implementation and  on that basis to recommend the solutions to improve the national competitiveness within the ministerial management.

- On the quarterly and annual basis, aggregate the report on assessment of reality of implementation and result of compliance with the Resolution No. 19/NQ-CP of the Ministry of Finance for submission to the Ministry for approval and then to the National Council for Sustainable Development and Competitiveness Building (through the Sustainable Development Office - Ministry of Planning and Investment) and the Government Office for aggregation and report to the Prime Minister.

4. The Portal of Ministry of Finance, Financial Times, Financial Magazine, newspapers and managazine in the entire sector must provide information and propagate in a timely manner the activities of the sector concerning the implementation of action plan to comply with the Resolution No. 19/NQ-CP dated 28/4/2016 of the Ministry./.
