DECISION

Defining the functions, tasks, powers and organizational structure of the

Oversea Vietnamese Committee affiliated to the Ministry of Foreign Affairs

Pursuant to the Law on Organization of the Government dated June 19, 2015;

Pursuant to the Government’s Decree No. 123/2016/ND-CP of September 1, 2016, defining the functions, tasks, powers and organizational structures of ministries and ministerial-level agencies;

Pursuant to the Government’s Decree No. 26/2017/ND-CP dated March 14, 2017 defining the functions, tasks, powers and organizational structures of the Ministry of Foreign Affairs;

At the proposal of the Minister of Foreign Affair;

The Prime Minister issues the Decision the functions, tasks, powers and organizational structures of the Oversea Vietnamese Committee affiliated to the Ministry of Foreign Affairs.

Article 1. Position and functions

1. Oversea Vietnamese Committee affiliated to the Ministry of Foreign Affairs (herein after referred as Committee) is the directorate level agency affiliated to the Ministry of Foreign Affairs performing the function of state management of overseas Vietnamese affairs.
2. The Committee is based in Hanoi with legal status, holding seal of National Emblem and permitted to open accounts at the State Treasury according to law provisions. 

Article 2. Tasks and power

1. Advising the Minister of Foreign Affairs to submitting to the Government, the Prime Minister and competent agencies:

1. Bill of laws and National Assemble Resolution; draft of Oder and Resolution of the Standing Board of the National Assembly, draft of Government’s Decree and Resolution; draft of Decision and Directive of the Prime Minister on Oversea Vietnamese.
2. Important strategies, long-term plans, national target programs; action schemes, schemes and projects on Oversea Vietnamese;

2. Submit to the Minister of Foreign Affairs to consider and decide:

1. Draft of Circular, Decision, Directive and other documents on Oversea

Vietnamese;

2. Long-term, mid-term and annual plans on Oversea Vietnamese.

3. Implement policies, strategies, plans, programs, schemes and projects on Oversea Vietnamese after granted by the competent authority. 
4. Instruct the expert and professional work on Oversea Vietnamese within the granted power. 
5. Sum up and analyze the current situation of Oversea Vietnamese; support and facilitate Oversea Vietnamese to have stable life and fit in the local society, implementing national unity, preserving Vietnamese cultural identity; motivate and calling the source from Oversea Vietnamese to serve the improvement of the country; support and instruct Oversea Vietnamese organizations and individuals for domestic relationship.
6. Inform Oversea Vietnamese of the Communist Party guidelines and intensions, State policies and laws, and domestic situation. 
7. Conduct the international cooperation related to Oversea Vietnamese in accordance with laws provision.
8. Manage social organizations related to Oversea Vietnamese in accordance with laws.
9. Implement the commendation in the work related to Oversea Vietnamese.
10. Inspect and examine the implementation of laws provision in the field related to Oversea Vietnamese within the management range. 
11. Implement the administrative reform in accordance with the target and content approved by the competent authority.
12. Manage the organizational structure and staffing; implement the wage regime and policies on treating, training, retraining, commendation and discipline for public employees and worker under the management of the Committee in accordance with law provisions and decentralized by the Minister of Foreign Affairs.
13. Do the financial and assigned assets management and conduct the using of decentralized state budget in accordance with laws provision.
14. Organizing citizen reception, settling complaints and denunciations, preventing and combating corruption and thrift practice, combating wastefulness and negativity according to law provisions.
15. Implement other tasks and rights as assigned or represented by the Minister of Foreign Affairs and in accordance with laws.

Article 3. Organizational structure

1. General Research Department.
2. Information and Culture Department.
3. Economic - Science and Technology Relationship Department.
4. Legislation and Inspection Department.
5. Office Division.
6. Quê Hương Magazine.

The bodies prescribed from clause 1 to 5 this Article are administrative units that help the Chairman of the Committee on state management; the Quê Hương Magazine is the public service provider affiliated to the Committee. The Office is allowed to organize up to 05 divisions.

The detail on functions, tasks, power and organizational structure; appointment and resignation of the head, the deputy head of affiliated agencies shall comply with laws provision and the direction of the Ministry of Foreign Affairs.

Article 4. Head of the Committee

1. The Committee shall be organized with Chairman and no more than 04 Vice Chairman.
2. The Chairman of Committee shall be appointed, dismissed by the Minister of Foreign Affairs and shall takes the prime responsibility before the Minister of Foreign Affairs of the whole activities of the Committee. The Minister of Foreign Affairs shall appoint a Deputy Minister as the Chairman of the Committee. 
3. Vice Chairmen of the Committee are appointed and dismissed by the Minister of Foreign Affairs at proposal of the Chairman and they shall take the prime responsibility before the Chairman on assigned task.

Article 5. Effect and implementation responsibility

1. This Decision takes effect on May 04, 2019 and replaces the Decision No. 102/2008/QD-TTg dated July 18, 2008 of the Prime Minister on defining the functions, tasks, power and organizational structure of the Committee of Oversea Vietnamese affiliated to the Ministry of Foreign Affairs.
2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies and chairpersons of provincial-level People’s Committees, Chairman of the Committee of Oversea Vietnamese and relevant organization and individual shall implement this Decision.
